RESOLUTION NO. 256 -2023
A RESOLUTION OF THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS APPROVING A SPECIAL PERMIT
ALLOWING A TEMPORARY CONSTRUCTION STAGING AREA
FOR A CANAL RESTORATION/WATER QUALITY
IMPROVEMENT PROJECT AT PROPERTY LEGALLY
DESCRIBED AS BLOCK 7 LOT 29 GEIGER MOBILE HOMES,
GEIGER KEY PLAT BOOK 5 PAGE 77 HAVING REAL ESTATE
(RE) NUMBER: 00146530-000000.
1 WHEREAS, an application was filed for a special permit allowing a temporary construction
2 staging area at property located at 77 Sirius Lane,Geiger Key,approximate Mile Marker 11 (Oceanside
3 of the Overseas Highway); and
4
5 WHEREAS, the property is legally described as Block 7 Lot 29 Geiger Mobile Homes,
6 Geiger Key Plat Book 5 Page 77 having real estate (re) number: 00146530-000000; and
7
8 WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
9 grant the special permit allowing a temporary construction staging area; and
10
11 WHEREAS, the temporary construction staging area would facilitate a canal
12 restoration/water quality improvement project being carried out by Monroe County; and
13
14 WHEREAS, due notice has been carried out and a public hearing has been held in
15 accordance with Monroe County Section 6-3; and
16
17 WHEREAS, at said public hearing, the Board considered the argument of all parties
18 present wishing to speak on the matter; and
19
20 WHEREAS, the Board makes the following Findings of Fact and Conclusions of Law:

22 1. The temporary construction staging area is not inconsistent with any of the criterion
23 provided in Monroe County Code §6 3;
24
25 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
26 COMMISSIONERS OF MONROE COUNTY,FLORIDA,that the preceding Findings of Fact

1 and Conclusions of Law support its decision to approve the request for a special permit, subject to
2 the following conditions:

4 1. The temporary construction staging area shall only be used in association with the canal
5 restoration project for Canal #475 on Geiger Key.
6 2. The expected commencement date of the temporary construction staging area is July 2023.
7 The termination date of the temporary construction staging area shall be no later than
8 December 2023.
9 3. Other than fencing, no temporary structure associated with the temporary construction
10 staging area shall be located in any required setback.
11 4. Upon termination of the temporary construction staging area,the property shall be restored
12 to its prior condition.

14 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
15 Florida, at a regular meeting of the Board held on the 19'h day of July, 2023.
