III. LEGAL ELIGIBILITY AND OPTIONS
Eligibility for Administrative Relief Options:
Section 138-27 of the Monroe County Land Development Regulations and Policy 101.6.1 of the
2010 Comprehensive Plan provides a mechanism whereby an applicant who has not received an
allocation award in the ROGO system may apply to the Board of County Commissioners for
Administrative Relief. The applicant is eligible for Administrative Relief having complied with
all requirements of the dwelling unit allocation system and having been considered in at least the
first sixteen consecutive quarterly allocation periods, and not having received an allocation award.
The application was timely submitted for administrative relief in the form of one (1) ROGO
allocation award and the applicant has not expressed a desire to sell the property to the County.
Relief Options under Administrative Relief:
The remedies available to the Board of County Commissioners for Administrative Relief pursuant
to Section 138-27(f) include:
a. Offer to purchase the property at its fair market value as its preferred action if the
property is located within: a) a designated Tier I area; b) a designated Tier II area
(Big Pine Key and No Name Key); c) a designated Tier III-A area (Special
Protection Area); or d) a designated Tier III area on a non-waterfront lot suitable
for affordable housing.
b. Grant the applicant an allocation award for all or a number of dwelling units
requested in the next succeeding quarterly allocation period or extended pro rata
over several succeeding quarterly allocation periods as the preferred action for
buildable properties not meeting any of the criteria in (1) above.
c. Suggest or provide such other relief as may be necessary and appropriate.
In the event purchase is recommended and the owner refuses the purchase offer, the
applicant may remain in the ROGO System and continue earning perseverance points
according to Monroe County Code Section 138-28.
IV. RECOMMENDATION
It is recommended that the Board of County Commissioners find that the applicant has met the
criteria and qualifies for Administrative Relief. It is further recommended that a Resolution be
adopted that establishes this relief awarding one (1) ROGO allocation in the next quarterly
ROGO allocation period which closes 1/12/2010, or a succeeding quarterly allocation period in
which administrative relief allocations are available.

OF COUNTY COMMISSIONERS APPROVING THE
REQUEST FOR ADMINISTRATIVE RELIEF MADE BY
DAVID & JEAN MARTONE ON PROPERTY
DESCRIBED AS LOT 20, BLOCK 14, LARGO SOUND
PARK, KEY LARGO, RE # 00473360.000000 IN THE
FORM OF ONE (1) DWELLING UNIT ALLOCATION
AWARD.
WHEREAS, David & Jean Martone submitted an application for administrative
relief under Sec. 138-27 of the Monroe County Land Development Regulations; and
WHEREAS, the Monroe County Board of County Commissioners makes the
following findings offact and conclusions of law:
1. The application for administrative relief from David & Jean Martone is
for Lot 20, Block 14, Largo Sound Park, and Key Largo in Monroe
County, Florida having RE # 00473360.000000.
2. The date of the ROGO application is 2/16/2005.
3. The ROGO allocation application has been in the ROGO system for at
least four (4) consecutive years and qualifies for administrative relief
under Policy 101.6.1 of the Monroe County Year 2010 Comprehensive
Plan.
4. Monroe County Code (Me C) Section 138-27 provides a mechanism
whereby an applicant who has not received an allocation award in
ROGO may apply to the Board of County Commissioners for
administrative relief.
5. The Board of County Commissioners (BOCC) has the authority to grant
administrative relief under Section 138-27(f) and may grant the
applicant a building allocation, offer to purchase the property at fair
market value, or provide such other relief as may be necessary and
appropriate.
6. The applicant applied for administrative relief on 9/23/2009, under
Section 138-27 of the MCC and Policy 101.6.1 of the 2010
Comprehensive Plan.
7. Policy 101.6.5 of the 2010 Comprehensive Plan provides criteria to be
used for determining lands that are appropriate for acquisition and the
criteria includes the environmental sensitivity of the vegetative habitat
on the lot and the applicable Tier designation.

8. The subject property has the land use district designation of Improved
Subdivision (IS-M), is located in the Largo Sound Park Subdivision and
is located in a Tier 3 designated area.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Administrative relief is granted to David & Jean Martone, for Lot 20, Block 14, Largo
Sound Park, Key Largo in the form of one (1) dwelling unit allocation, subject to the
following conditions:
1. The timing of the issuance of the permit shall be in accordance with the annual
number of residential allocations defmed by Policy 101.2.13 of the Momoe County
Year 2010 Comprehensive Plan and as required by Section 138-27 of the Momoe
County Code.
2. The allocation award shall be taken out of the next quarterly allocation which closes
on 1/12/2010 or in the succeeding quarterly allocation period in which administrative
relief allocations are available.

County, Florida at a regular meeting held on the 16th day of December, 2009.

The property adjoins a vacant wooded lot to the east and developed lots to the south, north, and
west. The property hac;; been at least partially cleared in the past, according to the information
you provided. According to the vegetation survey you submitted, 70 percent of the lot is free or
woody vegetation. TIle subdivision is well-developed with only scattered woody vegetation.

Dear property owner:
The fbllowing requirements will be necessary in order to save or replace protected plant species on the
property:
1. All endangered, threatened, regionally important plant species and large trees with a tnmk
diameter of 4" or greater, located within the area to be cleared. must be either transplanted to
another location on the site, or replaced iftraDsplantation is DOt feasible because of the tree size.
2. The replacement requirements will be two trees for every tree removed, or three trees if they are
planted on alternative site. There are 2 trees that fBlI in this categmy.
All 4 gumbo-limbo tree and 2 mahogany saplings can be transplanted.
3. Transplanting must be prepared as per Monroe County Code.
4. If the replacement plants are not available in nurseries the substitute species have to be approved
by the County Biologist prior their planting.
5. An alternative planting site for the trees to be transplanted or replaced will be assigned by the
County Biologist if there is not enough space available on your property.
Enclosed are four copies of the plan. Three of them have to be submitted to the County Biologist for a
review.

TRANSPLANTING PLAN FOR MAHOGANY SAPLINGS
1. Excavated boles for the plants will be slightly larger and deeper than is their root ball. The same or
better quality soil will be used to cover the roots. Soil must be free of large rocks.

develop strong roots.

The subject iDIaDd property adjoins a vacam partially wooded lot aloug its easIm1 border
liDo and developed properties aJoaa its opposite and back sides. The property was cleared a long
time ago with a possible CDtemptiOll of large aum~limbo trees. Three of them create now two
tree islaDds with youupr trees, tree sapIiDas and viBes arouad them. About 70% of the lot is free
of woody vegetation.
Out of 14 native woody plant species foUowing 1 species is on the list of the prot.eored

The next door neighbor claims that the area is a home of dle protected Florida tree snail
(Liguus &st-jm's) - species of special ccmcern. I did not find tbCl"C any sips of its presence.
Nevertheless, the owner should examine all removed trees, especially Jamaica dogwoods and
poisonwoods and relocate any tree mails found.
As for the nxprired street tree the owner can use transp1aDted mahogany saplings or
transplanted gum~limbos 1bat would have to be removed from the future builctias site.
