ITEM BACKGROUND:
The Planning Commission granted preliminary plat approval for the Rockland Key Commerce Center
on Rockland Key on January 11, 2006. On November 17, 2009, a request by the applicant was
submitted to the Planning Department for an additional two (2) year extension. The applicant has
made substantial progress toward satisfying conditions for fmal plat approval, but needs additional
time to obtain necessary permits from State agencies.

APPROVAL FOR ROCKLAND INVESTMENT CORPORATION, INC.

I BACKGROUND
The Planning Commission granted preliminary plat approval for the Rockland Key Commerce Center
on Rockland Key on January 11,2006. The BOCC granted two (2) - one (1) year extensions expiring
on April 18, 2008 and October 15, 2009, respectively. On November 17, 2009, a request by the
applicant was submitted to the Planning Department for an extension, which was verbally
communicated as being for two years.
The applicant is Rockland Investment Corporation, Inc. The development project is known as
Rockland Key Commerce Center. The preliminary plat was approved with specific conditions to be
satisfied before filing for fmal plat approval. The conditions included requirements for obtaining
necessary permits from State agencies and the provisions of fmancial guarantees and maintenance
agreements for infrastructure improvements. Applicant responded to a third Request for Additional
Information from the South Florida Water Management District for its permit. Since then, mitigation
has changed and additional survey work is required. The applicant is making every effort to fulfill
these conditions.
Pursuant to Section 110-98 (t), Limitation on Approval of Preliminary Plat, Monroe County Code, the
applicant may request an extension from the BOCC to request approval of the final plat. Unless an
extension is granted by the Board of County Commissioners, the approval of the preliminary plat is
automatically rendered null and void. Therefore, the applicant is requesting an extension to apply for
final plat approval.

Dear Townsley,
On January 9, 2006, the Planning Commission granted Preliminary Plat approval for the
Rockland Key Commerce Center. This is a subdivision of property that is zoned and historically
has been used for Industrial purposes. Since the original Preliminary Plat approval, we have
requested and received three extensions due to 'the extensive regulatory permitting requirements
for a project of this size.
Although much of the required infrastructure is in place, the South Florida Water Management
District permit is still pending. In March we responded to the third RA[ (Requests for Additional
lnformation) from SFWMD. As a result of this process the requirements for mitigation changed.
However, another RAI was issued that required additional survey work and we expect to have
our reply submitted in early December. Until that permit is issued, the project cannot proceed
with the civil engineering work required to construct the storm water drainage system.
Furthermore. the changes to the mitigation plan have resulted in a shift of the driveway entrance
15' to the west. As a result, the FDOT permit is in the process of being modified. \Ve have
submitted all required plans to FOOT and are awaiting the US I connection permit.
As to be expected, gi ven the economic situation facing not only the Keys economy but our
nation as well, development schedules for new projects have been extended_ The Florida
legislature recognized this situation with the pflssage of SB 360. We respectfully request that the
Board Of County Commissioners grant us an extension to Sec. 9.5-84 of the Monroe County
Code.

and reuse water main lines ha\ e been installed and the preltminary site preparallon for the mad
system has been completed. A FDOT NOI (Notice of I ntent to issue a pcmli l) has been receJ\ed
