ITEM BACKGROUND: The policy provides insurance coverage for sums which the County may become legally obligated to pay as a result of bodily injury, property damage, or personal injury arising out of its operations. The policy also provides for reimbursement percentage of legal fees incurred in the defense of criminal, civil or ethics proceedings. Aguiar, ?;~C--" Employee Services Director DATE: August 13,2009 SUBJ: Insurance Renewal- with FMIT (Florida Municipal Insurance Trust) General and Vehicle Liability This agenda item requests approval to renew with FMIT to provide General and Vehicle Liability coverage at a premium of$204,346 to be paid in four quarterly payments. This policy was bid in 2008 and this is the first renewal of the policy. This policy includes the following coverages: Premises and Operations Liability Public Officials and Employment Practices Liability Vehicle Liability and Physical Damage The total premium has decreased 4% lower than what the County is currently payin2 for the same covera2e. This policy provides coverage for which the County may become legally obligated to pay as a result of bodily injury, property damage, or personal injury arising out of its operations. In addition, the County will be reimbursed a percentage of legal fees incurred by a public officer in defending any criminal, civil, or ethics proceeding which is not otherwise covered by the policy. It is therefore the recommendation that the Board approve the request to renew this policy with an effective date of October 1, 2009 - September 30,2010. As in years past coverage is being proposed through the Florida Municipal Insurance Trust (FMIT) and includes the following coverages: ~ General Liability ~ Automobile Liability ~ Automobile Physical Damage on scheduled Vehicles ~ Public Officials Liability The current policy provides a per occurrence limit of $5 million subject to a $100,000 per claim self insured retention. The term of the current policy is October I, 2008 to October I, 2009. The annual premium of the current policy is $213,380. The League has offered to renew the current policy for the period of October I, 2009 to October 1,20 I 0 with terms and conditions consistent with the current policy for an annual premium of$204,346. This represents a reduction in the premium of$9,034 (4%). It is believed that this represents a favorable renewal and it is recommended that Monroe County renew its Excess Liability insurance with the Florida Municipal Trust as proposed by the Florida League of Cities. ) '" ..
