ITEM BACKGROUND: A building permit was applied for on 7/28/2004 and a ROGO application
was applied for on 10/7/2004. The applicant applied for administrative relief on 4/13/2009 and is
within the allowable time frame to be eligible for administrative relief under Section 138-27 of the
Monroe County Code.
Staff recommends that administrative relief be awarded in the form of a purchase offer by the
Monroe County Land Authority.

OF COUNTY COMMISSIONERS APPROVING THE
REQUEST FOR ADMINISTRATIVE RELIEF MADE BY
DEAN PARKINSON ON PROPERTY DESCRIBED AS
LOT 10, BLOCK 2, OCEAN PARK VILLAGE, KEY
LARGO, RE # 00445710.000000 IN THE FORM OF A
PURCHASE OFFER FROM THE MONROE COUNTY
LAND AUTHORITY.
WHEREAS, Dean Parkinson submitted an application for administrative relief
under Sec. 138-27 of the Monroe County Land Development Regulations; and
WHEREAS, the Monroe County Board of County Commissioners makes the
following findings of fact and conclusions of law:
1. The application for administrative relief from Dean Parkinson is for Lot
10, Block 2, Ocean Park Village, Key Largo in Monroe County, Florida
having RE# 00445710.000000.
2. The date of the ROGO application is 10/7/2004.
3. The ROGO allocation application has been in the ROGO system for at
least four (4) consecutive years and qualifies for administrative relief
under Policy 101.6.1 of the Monroe County Year 2010 Comprehensive
Plan.
4. Monroe County Code (MCC) Section 138-27 provides a mechanism
whereby an applicant who has not received an allocation award in
ROGO may apply to the Board of County Commissioners for
administrative relief.
5. The Board of County Commissioners (BOCC) has the authority to grant
administrative relief under Section 138-27(f) and may grant the
applicant a building allocation, offer to purchase the property at fair
market value, or provide such other relief as may be necessary and
appropriate.
6. The applicant applied for administrative relief on 4/13/2009, under
Section 138-27 of the MCC and Policy 101.6.1 of the 2010
Comprehensive Plan.
7. Policy 101.6.5 of the 2010 Comprehensive Plan provides criteria to be
used for determining lands that are appropriate for acquisition and the
criteria includes the environmental sensitivity of the vegetative habitat
on the lot and the applicable Tier designation.

8. The subject property has the land use district designation of Improved
Subdivision (IS), is located in the Ocean Park Village Subdivision and is
located in a Tier 1 designated area.
9. Monroe County Code (MCC) Section 138-27(1) states the Board may
offer to purchase property at its fair market value as the preferred action
for property located within Tier 1.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Administrative relief is granted to Dean Parkinson, for Lot 10, Block 2, Ocean Park
Village Subdivision, Key Largo in the form of a purchase offer by the Monroe County
Land Authority.

4 Eligibility for Administrative Relief Options:
5 Section 138-27 of the Monroe County Land Development Regulations and Policy 101.6.1 of the
6 2010 Comprehensive Plan provides a mechanism whereby an applicant who has not received an
7 allocation award in the ROGO system may apply to the Board of County Commissioners for
8 Administrative Relief. The applicant is eligible for Administrative Relief having complied with
9 all requirements of the dwelling unit allocation system and having been considered in at least the
10 first sixteen consecutive quarterly allocation periods, and not having received an allocation
11 award. The application was timely submitted for administrative relief in the form of one (1)
12 ROGO allocation award and the applicant has not expressed a desire to sell the property to the
13 County.

15 Additional Relevant Information:
16 The property is located in Tier 1 with a high hammock community. The parcel is vegetated and
17 bounded by vacant, vegetated properties within the subdivision to the west and east. To the south
18 is a paved roadway. To the north the subject property is contiguous with a tropical hardwood
19 hammock over 50 acres in size. The submitted vegetation survey lists twenty (20) native plant
20 species, one (1) of which is listed as endangered or regionally important. The Monroe County
21 Protected Animal Species Map does not indicate threatened or endangered animals in this area.

23 The subject property is one of the 147 properties the Board of County Commissioners directed
24 staff to review for a Tier Amendment to the adopted Tier Overlay Map in 2006. These changes
25 could not be made because further amendments to the tier maps were not allowed at that time.
26 When the DCA Secretary signed the Final Order resolving the Tier Ordinances Appeal, the basis
27 for prior proposed Tier Map changes was nullified. Until these parcels are re-mapped and re-
28 evaluated, staff is reviewing this applicant's Administrative Relief Application based on the
29 current tier designation.

31 Relief Options under Administrative Relief:
32 The remedies available to the Board of County Commissioners for Administrative Relief
33 pursuant to Section 138-27 include:

35 a. Offer to purchase the property at its fair market value as its preferred action if the
36 property is located within: a) a designated Tier I area; b) a designated Tier II area
37 (Big Pine Key and No Name Key); c) a designated Tier III-A area (Special
38 Protection Area); or d) a designated Tier III area on a non-waterfront lot suitable
39 for affordable housing.
40 b. Grant the applicant an allocation award for all or a number of dwelling units
41 requested in the next succeeding quarterly allocation period or extended pro rata
42 over several succeeding quarterly allocation periods as the preferred action for
43 buildable properties not meeting any of the criteria in (1) above.
44 c. Suggest or provide such other relief as may be necessary and appropriate.

1 In the event purchase is recommended and the owner refuses the purchase offer, the
2 applicant may remain in the ROGO System and continue earning perseverance points
3 according to Monroe County Code Section 138-28.

5 IV. RECOMMENDA TION

7 It is recommended that the Board of County Commissioners find that the applicant has met the
8 criteria and qualifies for Administrative Relief. It is further recommended that a Resolution be
9 adopted that establishes this relief by an offer to purchase by the Monroe County Land
10 Authority.

Dear Mr. Parkinson:
The amended Monroe County Land Development Regulations (LDRs) became effective
on January 4, 1996. Amended LOR Section 9.5-336 requires that as part of an
application for approval of development on lands consisting of hardwood hammock or
slash pinelands, the applicant prepare and submit a Habitat Evaluation Index (HEI) or
stipulate that the habitat is high quality. The purpose of an HEI is to determine the quality
of the habitat and the amount of allowable clearing area. The area outside of the clearing
area is defined as "open space" and is to remain undisturbed. The amended LDRs
require the property owner to record a conservation easement of their open space area.
Specifically, Section 9.5-336 was amended to read:
"Once a development permit has been issued and site preparations commenced,
the habitat quality rating either resulting from the habitat analysis or from the
applicant's stipulation of high quality shall remain in perpetuity and all future
development of the parcel shall conform to the applicable pineland or hammock so
analyzed or stipulated. This shall be assured by attachment of a deed restriction
to run with the land, stating the amount of required open space."
This will be accomplished by the "Grant of Conservation Easement Agreement" (GOCEA)
which must be legally recorded prior to the issuance of a Certificate of Occupancy (CO)
when construction is completed. The GOCEA will appear in the chain of title of the
property once it is recorded. By recording a GOCEA, any subsequent owner of the
property will be informed that specific portions of the land are solely for conservation
purposes. A copy of the GOCEA is enclosed and the material should be self explanatory.
However, if you need assistance contact my office. Certain sections of the GOCEA have
been filled in for you and these sections should not be changed.

Remember, the GOCEA is not due until you are ready for your CO. You will want to wait
until near the end of construction to complete the GOCEA to assure that it accurately
reflects the physical conditions on the property upon completion. For example, you may
change your site plan in some way during the construction process and this could alter
the area of your conservation easement.
Before you request a CO, completely fill out the GOCEA, have it notarized, and submit it
to the biologist in your area. Please leave the date on page 1 blank, it will be filled in
when the Mayor signs it, and please use a blue pen for your signatures. For Item #3,
Location of the Easement, a survey (reduced to 8 ~" by 11" and sealed) must be
attached as Exhibit "A" and a legal description with metes and bounds delineating that
portion of the property subject to the easement is required. You will also need to submit
a check made out to Monroe County Clerk of Courts for the recording fee and a self-
addressed, stamped legal size envelope. The recording fee is $10.00 for the first 8~" by
11" page, plus $8.50 for each additional 8~" by 11" page. The GOCEA will then be
forwarded to the mayor for his signature and to the Clerk of the Court for recording. A
certified copy will be sent to you.

Dear Mr. Parkinson:
The following requirements will be necessary in order to save or replace protected plant species on the
property:
1. All endangered, threatened, regionally important plant species and large trees with a trunk
diameter of 4" or greater, located within the area to be cleared, must be either transplanted to
~ another location on the site, or replaced if transplantation is not feasible because of the tree size.
2. The replacement requirements will be two trees for every tree removed, or three trees if they are
~ planted on alternative site. There are 23 trees that fall in this category.
All 7 geiger tree saplings and 6 gumbo-limbo trees can be transplanted.
3. Transplanting must be prepared as per Monroe County Code.
4. If the replacement plants are not available in nurseries the substitute species have to be approved
by the County Biologist prior their planting.
5. An altemative planting site for the trees to be transplanted or replaced will be assigned by the
County Biologist ifthere is not enough space available on your property.
Enclosed are four copies of the plan. Three of them have to be submitted to the County Biologist for a
reVIew.

TRANSPLANTING PLAN FOR GEIGER TREE SAPLINGS
1. Excavated holes for the plants will be slightly larger and deeper than is their root ball. The same or
better quality soil will be used to cover the roots. Soil must be free of large rocks.

2. Area around the transplanted plants will be saturated with water immediately after planting and
. will be kept moist for approximately 4 weeks. After the 4-week period they will be watered twice a
week for additional 6 weeks, or as needed until established.
TRANSPLANTING PLAN FOR GUMBO-LIMBO TREES
Gumbo-limbo trees can be successfully transplanted in any size with or without roots, with their crown
trimmed or even totally cut off. If the trunk is too heavy, one of the limbs can be used instead.

INTRODUCTION: Pursuant to your directive the above referenced parcel was reviewed
as a habitat analysis. All parcels listed as 426 (Tropical Hardwood Hammock) on the
existing conditions map require that a habitat analysis be performed and that an evaluation
index (HEI) be computed. The subject parcel is of the high hammock variety.
SITE AND PROJECT DESCRIPTION: The site in question was inspected with Alex
Score on 6-3-2004 and resulted in the following: The site is on Dove Lake Drive, and is
adjacent to a continguos area of hammock area of about 9.5 acres. The property adjoins a
hammock along three property lines and a paved roadway on the fourth. The parcel is
- vegetated with biota indicative of tropical hardwood hammock and the elevation indicates
high hammock variety. A portion of the lot has been cleared, and escaped exotics are there.
The HEI was performed and submitted by Marella Memec for this lot, with a change in
points by one, I agree with her findings. The additional point is because Marcella did not
include Orange Geiger tree as a native TIE/RI plant, as listed in our handbook. The species
diversity is moderate, consisting of20 native woody species. There is only 1 TIE/RI plant
on the lot, the 11 Orange Geigers. The hammock could serve as habitat for several TIE
animals, however none were seen by Marella or myself, and the site is not mapped habitat.
I looked for Liguus tree snails, but saw none. There were several exotic species present
including the invasive exotic oyster plant and bowstring hemp/Sansevieria was found.
Clkass 1 invasives however were less than 5% of the site. Approximately 1/3 of the site
was cleared where the majority of the pest plants were found. The size of the parcel is
small, only 6000 square feet. The entire parcel appears relatively uniform in sensitivity.
RECOMMENDATION: The hammock was rated as moderate in quality. The open space
ratio is 0.60, which will allow 2400 square feet to be cleared, including the construction
impact area of five feet width measured from the dripline or furthest extension of the
house. A site preparation permit should be issued and the clearing and construction
barriers field checked prior to validating the construction permit. All bowstring
hemp/Sanseveria and oyster plants should be removed from the site. A transplant plan
must be submitted for T/E/RI, as well as any trees 4" or greater that will be removed for
construction. The conservation easement deed restriction must be recorded before the C. O.
is issued. This deed restriction will prevent future owners from damaging the required

The subject inland high elevation moderate quality' hammock property of about .1 of an
acre is a part of the contiguous hammock area of about 9.5 acres. The property adjoins a
hammock along three property lines that is a part of more than 50 acres of combined undisturbed
natural habitats.
The lot was probably mostly cleared several decades ago. A path from Dove Lake Drive
toward Atlantic A venue is still free of woody vegetation, especially at the street-front area that
has served as a dumping ground. Junk pieces are scattered along the street-front and along the
eastern side hammock edges. Exotic plants sprouted in that areas from plant refuses discarded
there. The northern end of the path is blocked by a huge pile of a plant material.
The cleared area covers about 1/3 of the property. There grow majority of native non-
woody plants. An old truck at the street was probably also disposed of there. The attached sketch
was prepared only to show the cleared area.
Surprisingly, not a single protected plant sprouted on the property so far and the
hammock area is comprised of just 19 woody plant species.

The tree canopy is dominated by many wild tamarinds. They greatly prevail over the
other trees. The next and less abundant are gumbo-limbos. fallowed by much thinner blolly trees.
Wildlife species seen or heard on the property or in the surrounding area were limited to
just a few common mammal, insect, bird and lizard species.

Thank you for your request for technical assistance with the Fish and Wildlife Service (Service)
on the project which is the construction of a new single-family residence. The project is located
at 182 Dove Lake Road, Lot 10, Block 2, Ocean Park Village Subdivision, Key Largo, Monroe
County, Florida. The Real Estate number is 00445710-000000.
Site Description
A Service representative visited the site on June 4, 2004. The parcel is in a series of similarly
vegetated lots on the north side of Dove Lake Road, contiguous with a large tropical hardwood
hammock. According to the May 4, 2004, habitat analysis you submitted, the lot is about
0.1 acre and is adjoined on three sides by an undisturbed tropical hardwood hammock
approximately 50 acres in size. Notable native vegetation on the lot is yellow root (Morinda
royoc), wild lime (Zanthoxylumfagara), poisonwood (Metopium toxiferum), wild tamarind
(Lysiloma latisiliquum), and gumbo limbo (Bursera simaruba). The lot was classified as
moderate quality hardwood hammock. About one-third of the lot was estimated to have been
cleared several decades ago.
Effect Analysis
The Service's Geographic Information System (GIS) database shows the property as potential
habitat for the endangered Schaus swallowtail butterfly (Heraclides aristodemus ponceanus), the
threatened Stock Island tree snail (Orthalicus reses reses), the State-listed white-crown pigeon
(Columba leucocephala), and Liguus species tree snails.
The presence and density of tropical hardwood hammock species onsite, the canopy cover, and
the presence of wild lime and yellow root, suggest that the project site is of marginal quality as
foraging and breeding habitat for the Schaus swallowtail butterfly. The Schaus swallowtail
butterfly is a federally listed endangered species.

strong bark (Bourreria sp). Several of these species were found and may be present in a density
that creat'es a microclimate (shade, humidity, temperature) favorable for tree snails. The
hammock floor also may have the attributes necessary for snail reproduction.
The project site is also shown in the Service's GIS database as potential habitat for the threatened
white-crowned pigeon. The presence of the principal food source, poisonwood, and other food
trees suggest the site may provide habitat for this State-listed species.
Determination
Based on the information provided, we believe that your project, as described, is not likely to
significantly increase adverse risk to any federally listed threatened or endangered species or
critical habitat.

State, county, or municipal regulations. It is the applicant's responsibility to ensure that the
project meets all applicable regulations. If modifications are made to the project, if additional
information involving potential effects to listed species becomes available, if a new species is

technical assistance may be necessary.
