ITEM BACKGROUND: A building permit was applied for on 1/18/2005 and a ROGO application
was applied for on 3/412005. The applicant applied for administrative relief on 5/7/2009 and is within
the allowable time frame to be eligible for administrative relief under Section 138-27 of the Monroe
County Code.
Staff recommends that administrative relief be awarded in the form of a purchase offer by the
Monroe County Land Authority.

A RESOLUTION BY THE MONROE COUNTY BOARD
OF COUNTY COMMISSIONERS APPROVING THE
REQUEST FOR ADMINISTRATIVE RELIEF MADE BY
GEORGE PYRPIRIS ON PROPERTY DESCRIBED AS
LOT 25, BLOCK 3, HARRIS OCEAN PARK ESTATES,
KEY LARGO, RE # 00447850.000000 IN THE FORM OF
A PURCHASE OFFER FROM THE MONROE
COUNTY LAND AUTHORITY.
WHEREAS, George Pyrpiris submitted an application for administrative relief
under Sec. 138-27 of the Monroe County Land Development Regulations; and
WHEREAS, the Monroe County Board of County Commissioners makes the
following findings of fact and conclusions of law:
1. The application for administrative relief from George Pyrpiris is for Lot
25, Block 3, Harris Ocean Park Estates, Key Largo in Monroe County,
Florida having RE# 00447850.000000.
2. The date of the ROGO application is 3/4/2005.
3. The ROGO allocation application has been in the ROGO system for at
least four (4) consecutive years and qualifies for administrative relief
under Policy 101.6.1 of the Monroe County Year 2010 Comprehensive
Plan.
4. Monroe County Code (MCC) Section 138-27 provides a mechanism
whereby an applicant who has not received an allocation award in
ROGO may apply to the Board of County Commissioners for
administrative relief.
5, The Board of County Commissioners (BOCC) has the authority to grant
administrative relief under Section 138-27(f) and may grant the
applicant a building allocation, offer to purchase the property at fair
market value, or provide such other relief as may be necessary and
appropriate.
6. The applicant applied for administrative relief on 5/7/2009, under
Section 138-27 of the MCC and Policy 101.6.1 of the 2010
Comprehensive Plan.
7. Policy 101.6,5 of the 2010 Comprehensive Plan provides criteria to be
used for determining lands that are appropriate for acquisition and the
criteria includes the environmental sensitivity of the vegetative habitat
on the lot and the applicable Tier designation.

8. The subject property has the land use district designation of Improved
Subdivision (IS), is located in the Harris Ocean Park Estates and is
located in a Tier I designated area.
9. Monroe County Code (MCC) Section 138-27(f) states the Board may
offer to purchase property at its fair market value as the preferred action
for property located within Tier I.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Administrative relief is granted to George Pyrpiris, for Lot 25, Block 3, Harris Ocean
Park Estates Subdivision, Key Largo in the form of a purchase offer by the Monroe
County Land Authority.

5 Eligibility for Administrative Relief Options:
6 Section 138-27 of the Monroe County Land Development Regulations and Policy 101.6.1 of the
7 2010 Comprehensive Plan provides a mechanism whereby an applicant who has not received an
8 allocation award in the ROGO system may apply to the Board of County Commissioners for
9 Administrative Relief. The applicant is eligible for Administrative Relief having complied with
10 all requirements of the dwelling unit allocation system and having been considered in at least the
II first sixteen consecutive quarterly allocation periods, and not having received an allocation
12 award. The application was timely submitted for administrative relief in the form of one (1)
13 ROGO allocation award and the applicant has not expressed a desire to sell the property to the
14 County.

16 Additional Relevant Information:
17 The property is located in Tier 1 with a high hammock community. The parcel is vegetated and
18 bounded by vacant, vegetated properties within the subdivision to the south and east. A
19 developed property lies to the north. To the west, the subject property is contiguous with a
20 tropical hardwood hammock over 50 acres in size. The submitted vegetation survey lists thirty-
21 four (34) native plant species, seven (7) of which are listed as endangered or regionally
22 important. The Monroe County Protected Animal Species Map does not indicate threatened or
23 endangered animals in this area.

25 The subject property is one of the 147 properties the Board of County Commissioners directed
26 staff to review for a Tier Amendment to the adopted Tier Overlay Map in 2006. These changes
27 could not be made because further amendments to the tier maps were not allowed at that time.
28 When the DCA Secretary signed the Final Order resolving the Tier Ordinances Appeal, the basis
29 for prior proposed Tier Map changes was nullified. Until these parcels are re-mapped and re-
30 evaluated, staff is reviewing this applicant's Administrative Relief Application based on the
31 current tier designation.

33 Relief Options under Administrative Relief:
34 The remedies available to the Board of County Commissioners for Administrative Relief
35 pursuant to Section 138-27 include:

37 a. Offer to purchase the property at its fair market value as its preferred action if the
38 property is located within: a) a designated Tier I area; b) a designated Tier II area
39 (Big Pine Key and No Name Key); c) a designated Tier III-A area (Special
40 Protection Area); or d) a designated Tier III area on a non-waterfront lot suitable
41 for affordable housing,
42 b. Grant the applicant an allocation award for all or a number of dwelling units
43 requested in the next succeeding quarterly allocation period or extended pro rata
44 over several succeeding quarterly allocation periods as the preferred action for
45 buildable properties not meeting any of the criteria in (1) above.

3 In the event purchase is recommended and the owner refuses the purchase offer, the
4 applicant may remain in the ROGO System and continue earning perseverance points
5 according to Monroe County Code Section 138-28.

7 IV. RECOMMENDATION

9 It is recommended that the Board of County Commissioners find that the applicant has met the
10 criteria and qualifies for Administrative Relief. It is further recommended that a Resolution be
11 adopted that establishes this relief by an offer to purchase by the Monroe County Land
12 Authority.

Dear Sir,
Please, find enclosed the list of the plant species found on the subject property.
This is a two page plant list.
The subject property is a High Hammock Community. It is located on Pacific
Avenue. It is bordered by two non developed hammocks on the East and West sides
and by a developed property on the North side. The hammock on the East side has
been partially cleared and is being invaded by Pathos plants. Some clearance
occurred on the subject property and some areas have been used by the
neighborhood as yard waste disposal.
Three species, listed Regionally Important by Monroe County were found:
Inkwood (Exothea p.n/cu/ata), Black Iron wood (KrugJodendron ferreum) and
Torchwood (Amyrls e/emlfera).
I Tht'88 species listed Endangered by the State of Florida were also found :
Florida Box wood (SchafferJ. frutescens), Mahogany (Sw/eten/a m.h.gonl) and
. Prine.wood (Exostem. carlb,eum) .
The important native species have been taped in the field with a pink plastic
tape with their name and n umber written on it. Please find enclosed their list and a
map giving their approximate location in the hammock.
Two species listed as pest invasive plants category I by the Florida Pest Plant

Council were found: Oyester plants (Tradescantis spathscea) and Burma reed grass
(Neyrsudia reynaudiana). Their estimated coverage in the hammock has been
estimated at 1250 square feet or 240/0. Four pest invasive plant species listed
category II are also present and their coverage is estimated at 400 square feet. They
have not been taped on the field. I'll be glad to do any additional taping as required.
Please, consult with the Monroe County Biologist for special requirements.

Dear Mr. Pyrpiris:
The amended Monroe County Land Development Regulations (LDRs) became effective
on January 4, 1996. Amended LOR Section 9.5-336 requires that as part of an
application for approval of development on lands consisting of hardwood hammock or
slash pinelands, the applicant prepare and submit a Habitat Evaluation Index (HEI) or
stipulate that the habitat is high quality. The purpose of an HEI is to determine the quality
of the habitat and the amount of allowable clearing area. The area outside of the clearing
area is defined as "open spacen and is to remain undisturbed. The amended LDRs
require the property owner to record a conservation easement of their open space area.
Specifically, Section 9.5-336 was amended to read:
"Once a development permit has been issued and site preparations commenced,
the habitat quality rating either resulting from the habitat analysis or from the
applicant's stipulation of high quality shall remain in perpetuity and all future
development of the parcel shall conform to the applicable pineland or hammock so
analyzed or stipulated, This shall be assured by attachment of a deed restriction
to run with the land, stating the amount of required open space."
This will be accomplished by the "Grant of Conservation Easement Agreement" (GOCEA)
which must be legally recorded prior to the issuance of a Certificate of Occupancy (CO)
when construction is completed. The GOCEA will appear in the chain of title of the
property once it is recorded. By recording a GOCEA, any subsequent owner of the
property will be informed that specific portions of the land are solely for conservation
purposes. A copy of the GOCEA is enclosed and the material should be self explanatory.
However, if you need assistance contact my office. Certain sections of the GOCEA have
been filled in for you and these sections should not be changed.

Remember, the GOCEA is not due until you are ready for your CO. You will want to wait
until near the end of construction to complete the GOCEA to assure that it accurately
reflects the physical conditions on the property upon completion. For example, you may
change your site plan in some way during the construction process and this could alter
the area of your conservation easement.
Before you request a CO, completely fill out the GOCEA, have it notarized, and submit it
to the biologist in your area. Please leave the date on page 1 blank, it will be filled in
when the Mayor signs it, and please use a blue pen for your signatures. For Item #3,
Location of the Easement, a survey (reduced to 8 %" by 11" and sealed) must be
attached as Exhibit "A" and a legal description with metes and bounds delineating that
portion of the property subject to the easement is required. You will also need to submit
a check made out to Monroe County Clerk of Courts for the recording fee and a self-
addressed, stamped legal size envelope. The recording fee is $10.00 for the first 8%" by
11" page, plus $8.50 for each additional 8%" by 11" page. The GOCEA will then be
forwarded to the mayor for his signature and to the Clerk of the Court for recording. A
certified copy will be sent to you.

Thank you for your response to our letter dated November 5,2004, and your email dated
Dccember 12,2004. The proposed project, a new single-family residence, is located on Pacific
A venue, Lot 25, Block 3, Harris Ocean Park Estates Subdivision, Key Largo, Monroe County,
Florida. The Real Estate number is 00447850-000000.
Site Description
The vegetated, undeveloped lot is bounded by vacant, vegetated propcrties within the subdivision
to the south and east. A developed property lies to the north. To the south (separated by a
sccondary road) and west is a contiguous tropical hardwood hammock which is over 50 acres in
size. A vegetation survey, you submitted with the application, documented 34 native tropical
hardwood hammock species on the property, which included two State-listed endangered
species.
Background
The site has vegetation and other features which the Fish and Wildlife Service (Service) has

swallowtail butterfly (Heraclides aristodemus pOil cean us) and the federally threatened Stock
Island tree snail (Orlhalicus reses), as well as the State-threatened white-crowned pigcon
(Columba leucocephala) and Florida tree snail (Liguusfasciatus). Additionally, the lot is
contiguous with potcntial or known habitat. Continuity with potential or known habitat is an
important factor in evaluating the suitability and importance of habitat for a species.
As a rcsult of the above findings, the Service requested a survey of the property to verify thc
presence or abscnce of the Schaus swallowtail butterfly and the Stock Island tree snail. The
survey you submitted, received by us on November 23,2004, was inconclusive for the Schaus
swallowtail butterfly or Stock Island tree snail because it was not conducted following a protocol
acceptable to the Service and could not confirm the presence or absence of these specics,

In your December 12, 2004, email you stated your client proposes the following:
(1) Clearing of 43% or 44% of the property for residence, driveway, and septic system;
(2) A Conservation Easement on the remaining portion of the properties; and
(3) Transplantation and/or replacement of displaced native plant species.
Upon further review, the Service believes the proposed measures may mitigate any potential ---
negative impacts, such as incidental take, to federally listed species. The Service recommends 8
additional wild lime (Zanthozylumfagara), torch wood (Amyris elemifera), and wild coffee
(Psychotria 1Iervosa) be planted on the remaining undisturbed area. We also encourage a larger
undisturbed area.
Determination t
The Service believes the project, to include the mitigation measures you have proposed, will not CYJ

increase adverse risk to any federally listed threatened or endangered species or their critical
habitat.
Please note Service review of this project in no way implies compliance with other Federal,
State, county, or municipal regulations. It is the applicant's responsibility to ensure the project
meets all applicable regulations. If modifications are made to the project, if additional
infonnation involving potential effects to listed species becomes available, if a new species is .
listed, or if designated critical habitat may be adversely affected by the project, reinitiation of
technical assistance may be necessary.
