Hall x 3174 AGENDA ITEM WORDING: Approval of the Settlement Agreement with Brian and Jocelyn Tiedemann, Code Enforcement Case CE06090166 in the amount of$2,500,OO, ITEM BACKGROUND: The property in question was originally owned by Francisco Moc, Code Enforcement case filed a case against Ivlr. Moc in September 2006 for building a room addition and a front overhang without a pelmit. An order fmding Me Moc in violation was entered in July 2007. Prior to that order, Aurora Loan Services (the lender) filed a foreclosure action. Any lien by the County would have been wiped out in the foreclosure. Aurora Loan Services purchased the property through foreclosure and then sold the prope11y to BIian and Jocelyn Tiedemann on November 7, 2007. The Tiedemanns worked promptly to con-ect the prior violations. Fines accumulated after the Tiedemanns bought the property at the rate of$150 per day for 68 days for a total of$10,200. The proposed settlement equals 25% of that amount. AND JOCELYN A. TIEDEMANN, Respondent(s). CASE NO.: CE06090166 I SETTLEMENT AGREEMENT The Board of County Commissioners of Monroe County ("County") and Brian M. and Jocelyn A. Tiedemann ("Respondents") hereby agree to settle the code enforcement lien imposed in the above-referenced case by the Special Master against property owned by the Respondents for a total of $2,500,00. The property in question has a legal description of Lots 36 and 37, Block 9, Amended Plat of Key Largo Park, according to the Plat therefore, as recorded in P.B, 3, Page 62, Public Records of Monroe County Florida (RE: 00525420-000000). The Respondents shall remit cash, money order or check in the amount of $2,500.00 (two thousand five hundred dollars) made payable to the Monroe County Board of County Commissioners, The County will hold the check uncashed until approval of the settlement terms by the Monroe County Board of County Commissioners, at which time the County will cash the check or deposit the funds, Respondents understand that settlement is dependent upon the agreement of and is not final until execution of the Monroe County Board of County Commissioners. Within 30 days of clearance of the check, the County shall provide to Respondents a release and satisfaction of said lien, which the Respondent shall record in the Official Records of Monroe County, By entering into this agreement, any and all claims arising out of the above-captioned code enforcement case shall be satisfied and concluded. Each party shall bear its own costs and attorney's fees other than as specified in this agreement. IT IS SO AGREED AS OFTHE LAST DATE SET FORTH BELOW.
