m"ITEM BACKGROUND: Portions of No Name Key were included in the Federal Coastal Barrier
Resource System(CBRS)created in 1982,through the Coastal Barrier Improvement Act of 19"(CBIA),
which added several areas of the Florida Keys. One of the previously developed No Name Key areas
included in the C.BRS did not actually meet the refined definition of"undeveloped"as stated in the 1"0
CHIA at the time of inclusion,and had existing residential development of a density greater than what
qualified for inclusion in the CB&S. This will correct the No Name Key CB areas to consist of the
wildland areas for protection and conservation that was intended by the Act.
PREVIOUS RELEVANT BOCC ACTION: The Board has approved previous Re solutions of
Support for removal of areas fro in the CBRS:
#004-1992 regarding Robbie's Safe Harbor Marine property,Stock Island
#426-2004 reaffirming support for Robbie's Safe Harbor Marine property,Stu k Island
#149-7.006 for two individual parcels,32763 Tortuga Lane and 32734 Bimini Lane,No Name Key(both
o1which actually are located within the developed residential area addressed by the Resolution presented

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA
DECLARING SUPPORT OF CONGRESSIONAL LEGISLATION
TO EXCLUDE THE DEVELOPED RESIDENTIAL AREA OF `THE
UNRECORDED PLAT ON THE EAST END OF NO NAME KEY,
OTHERWISE KNOWN AS "ISLAND'S END", LOCATED IN
MONROE COUNTY, FLORIDA FROM THE FEDERAL
COASTAL BARRIER RESOURCES SYSTEM.
WHEREAS, the Florida Keys have been designated by the Legislature of the State of
Florida as an Area of Critical State Concern requiring development and implementation of a
comprehensive plan and land development regulations; and
WHEREAS, the Coastal Barrier Resource Protection Act (CBRA) was enacted by the
Federal Government in 1982 to protect remaining natural coastal ecosystems from
encroachment and development, creating the Coastal Barrier Resources System (CBRS); and
WHEREAS, coastal areas of the Florida Keys were added to the CBRS in the Coastal
Barrier Improvements Act of 1990 (CBRA), which included the undeveloped areas of No Name
Key; and
WHEREAS, the defining criteria of "undeveloped" for inclusion into the CBRS was
refined in the 1990 CBRA to specify the density of development to be less than one
home/structure per five acres of land; and
WHEREAS, at the time of the inclusion of the CBRA, the cast end of No Name Key
consisted of 5.28 acres of buildable land with nine (9) homes permitted and substantially
complete (walled and roofed), approximately one home per 528 acres. Additionally, five (5)
other property owners had previously received building permits and their homes were in various
phases of active construction. Today, there are fourteen (14) homes on 5.28 acres; and
WHEREAS, in comparison, the west end of No Name Key in 1990, Bahia Shores and
Dolphin Harbour subdivisions, consisted of approximately 15.4 buildable acres, and they had
fourteen(14) homes permitted and substantially completed, at one home per 1.10 acres, and were
excluded from the CBRA; and
WHEREAS, the west end of No Name Key, as a previously developed residential area
with development well over the defined criteria of"undeveloped", was correctly excluded from
the CBRS; but the east end of No Name Key, also a previously developed residential area with
similar density of development was seemingly included in error; now,therefore;

I The Board of County Commissioners hereby requests the Florida Delegation use the
necessary legislative process within the U.S. House of Representatives to remove the
developed residential area of the unrecorded plat on the east end of No Name Key,
otherwise originally known as "Island's End", located in Monroe County, Florida from
the Coastal Barrier Resource System.

RE: Requesting a Resolution from the Board of County Commissioners to Remove the
East-end of No Name Key from the Coast al Barrier Resources System
Dear Mayor and Fellow Commissioners,
The east-end of No Name Key was placed in the Coastal Barrier Resources System in 1990 in
error and we are requesting that it be removed from this designation. The east-end of No
Name Key had twice the density of home development per acre than Bahia Shores and
Dolphin Harbour which were excluded from the CBRS. We have gathered all of the
evidence from the County's own records of building permits issued and final permit
inspections so the County staff knew or should have known that we were "developed" and
did not belong in the Coastal Barrier Resource System.
The Coastal Barrier Improvement Act of 1990 (CBIA, P.L. 101-591; 104 Stat. 2931) added
areas in the Florida Keys, including the East-end of No Name Key, Florida, in the Coastal
Barrier Resources Act (CBRA) enacted October 18, 1982. (Exhibit 1, F180 map) It was also
this Act that prohibited homes within the CBRS from purchasing FEMA flood insurance if
they received their "Certificate of Occupancy" after October 24, 1991. Since we were put in
the CBRS, four homeowners on the east-end can no longer purchase FEMA flood insurance.
These owners were forced to pay-off their mortgage and now go without flood insurance.
Any potential buyer must be able to pay cash for these homes since all mortgage companies
require flood insurance. I am sure this was an unanticipated and unintended consequence
but one that needs correction.
The change we are requesting will take an act of legislation by the U.S. Congress.
Therefore, we respectfully request the Board of County Commissions to pass a resolution
declaring support for such legislation the same as the Board has done for others who were
removed from the CBRS. The County's Resolution would then go to the State Representative
or Senator so he/she can present this piece of legislation to Congress. We understand that
Congresswoman Ros-Lehtinen has been very helpful and willing to assist in such matters in
the past for Monroe County.
The evidence shows that the east-end of No Name Key was more developed, by the CBRS
definition, than those areas that were excluded from the System such as the Amended Plat of
Bahia Shores and Amended Plat of Dolphin Harbour. However, Dolphin Estates, Galleon Bay
and Unrecorded Plat-East End of Key were all placed within the CBRS.
It is critical to understand the definitions of"undeveloped" in the CBRA. The Act of 1982, (16
USC3502),Title 16, Chapter 55-Coastal barrier Resources, Section 3602 provides:
Section 3502. Definitions
For purpose of this chapter
(1) The term "undeveloped coastal barrier" means
(A)a depositional geologic feature (such as a bay barrier,
tombolo, barrier spit, or barrier island) that
i, subject to wave, tidal, and wind energies, and
ii. protects landward aquatic habitats from direct
wave attack; and
(B) All associated aquatic habitats, including the adjacent
wetlands, marshes, estuaries, inlets, and near shore waters;
But oWy if such feature and associated habitats co Lainfew manmade
structures and these structures, and m@A's activities on such feature
and within such habitats, do not significantly impede geomg1phic-and
ecological processes.
The Coastal Barrier Improvement Act of 1990,which added No Name Key, the
federal government further refined the definition of"undeveloped."The Act in Title
16, Chapter 55, Section 3504 (b) (2) states:

shall consider whether within the area
(A) The density of development is less that I
structure per 5 acres of land above mean high tide;
and
(B) There is existing infrastructure consisting of:
W A road, with a reinforced road bed, to each
lot per or building site in the area;
(ii) A wastewater disposal system sufficient to
serve each lot or building site in the area;

(iii) Electric service for each lot or building site
in the area; and
(iv) A fresh water supply for each lot or building
site in the area.
In paragraph(1) above the term "structure" means a
walled and roofed building, other than a gas or liquid
storage tank, that
(A) Is principally above ground and affixed to a
permanent site, including a manufactured home on a
permanent foundation; and
(B) Covers an area of at least 200 square feet.
Based on the above definitions,No Name Key should never have been
added to the CBRS because it was already"developed" per the definition as
contained in the CBIA.
A review of County Official Records will show that in 1990 the east-end of No
Name Key contained 8.28 acres of buildable land' and had 9 homes
permitted and substantially completed (walled and roofed).9' That is
approximately I home per .828 acre. In addition, five other homeowners
had received building permits and their homes were in various phases of
active construction.*3 Today there are 14 homes on 5.28 acres. Exhibit 2 is an
aerial photograph of site.
On the other hand, in 1990 Bahia Shores and Dolphin Harbour consisted of
approximately 15.4 buildable acreS4 and they had 14 homes permitted and
substantially completed. That was I home per 1.10 acres.
Methodology:Total 8 acres minus the county's 28 foot public utility easement,minus the permitted
canal, minus two roadways=5.3 buildable acres.

I'nr curious about the relation between CBRS and flood insurance.
I was told by my insurance went that if I were to purchase flood insurance it
would cost 40'000 per year because I can't buy through FEMA,
I'm happy to help by sending my e-mail of support to get us removed from CBRS.
My parents built our house in 1988. Why and how did we get in CBRS in 1990?
