WHEREAS, Cristina Keegan submitted an application for administrative relief under Sec. 9.5-122.3 of the Monroe County Land Development Regulations; and WHEREAS, the Monroe County Board of County Commissioners makes the following findings of fact and conclusions of law: 1. The application for administrative relief from Cristina Keegan is for Lots 5 & 6 (to be aggregated), Block 8, Anglers Park Subdivision, Key Largo in Monroe County, Florida having RE# 00552390.000000 & 00552400.000000. 2. The date of the RaGa application is 1/13/2004. 3. The RaGa allocation application has been in the RaGa system for at least four (4) consecutive years and qualifies for administrative relief under Policy 101.6.1 of the Monroe County Year 2010 Comprehensive Plan. 4. Monroe County Code (MCC) Section 9.5-122.3 provides a mechanism whereby an applicant who has not received an allocation award in RaGa may apply to the Board of County Commissioners for administrative relief. 5. The Board of County Commissioners (BacC) has the authority to grant administrative relief under Section 9.5-122.3(f) and may grant the applicant a building allocation, offer to purchase the property at fair market value, or provide such other relief as may be necessary and appropriate. 6. The applicant applied for administrative relief on 3/6/2008, under Section 9.5- 122.3 of the MCC and Policy 101.6.1 of the 2010 Comprehensive Plan. 7. Policy 101.6.5 of the 2010 Comprehensive Plan provides criteria to be used for determining lands that are appropriate for acquisition and the criteria includes the environmental sensitivity of the vegetative habitat on the lot and the applicable Tier designation. 8. The subject property has the land use district designation of Improved Subdivision (IS), is located in the Anglers Park Subdivision and is located in a Tier 3-A designated area. 9. Monroe County Code (MCC) Section 9.5-122.3(f) states the Board may offer to purchase property at its fair market value as the preferred action for property located within Tier 3-A. LEGAL ELIGIBILITY AND OPTIONS Eligibility for Administrative Relief Options: Section 9.5-122.3 of the Monroe County Land Development Regulations and Policy 101.6.1 of the 2010 Comprehensive Plan provides a mechanism whereby an applicant who has not received an allocation award in the ROGO system may apply to the Board of County Commissioners for Administrative Relief. The applicant is eligible for Administrative Relief having complied with all requirements of the dwelling unit allocation system and having been considered in at least the fIrst sixteen consecutive quarterly allocation periods, and not having received an allocation award. The applicant has timely requested administrative relief in the form of one (1) ROGO allocation award and has not expressed a desire to sell the property to the County. Relief Options under Administrative Relief: The remedies available for Administrative Relief pursuant to Section 9.5-122.3 includes: a. Offer to purchase the property at its fair market value as its preferred action if the property is located within: a) a designated Tier I area; b) a designated Tier II area (Big Pine Key and No Name Key); c) a designated Tier ill-A area (Special Protection Area); or d) a designated Tier ill area on a non-waterfront lot suitable for affordable housing. b. Grant the applicant an allocation award for all or a number of dwelling units requested in the next succeeding quarterly allocation period or extended pro rata over several succeeding quarterly allocation periods as the preferred action for buildable properties not meeting any of the criteria'in (1) above. c. Additonal Relevant Information: The property is described in the vegetation survey submitted with the application as "evenly wooded with 24 woody plant species." Among the plants present are two species listed as threatened and regionally important (mahogany and mastic, respectively), as well as 70 native trees with trunk diameters ranging from four inches to nineteen inches. The property is also inhabited by the State protected Florida tree snail (Liguus faciatus). In the event purchase is recommended and the owner refuses the purchase offer, the applicant may remain in the ROGO System and continue earning perseverance points according to the vesting provision of Tier Ordinance 009-2007. IV. RECOMMENDATION It is recommended that the Board of County Commissioners fInd that the applicant has met the criteria and qualifIes for Administrative Relief. All endangered, threatened, regionally important plant species and large trees with a trunk diameter of 4" or greater, located within the area to be cleared, must be either transplanted to another location on the site, or replaced if transplantation is not feasible because of the tree size. 2. The replacement requirements will be two trees for every tree removed, or three trees if they are planted on alternative site. There are 35 trees that fall in this category. Both gumbo-limbos, the smallest mahogany and one mastic sapling can be transplanted. 3. Transplanting must be prepared as per Monroe County Code as well as a site plan illustrating the location of the plants to be transplanted or replaced. 4. If the replacement plants ate not available in nurseries the substitute species have to be approved by the County Biologist prior their planting. 5.. An alternative planting site for the trees to be transplanted or replaced will be assigned by the County Biologist if there is not enough space available on your property. Enclosed are four copies of the plan. Three of them have to be submitted to the County Biologist for a review. After the 4-week period they will be watered twice a week for additional 6 weeks, or as needed until established. Area around transplanted plants will be saturated with water immediately after planting and will be kept moist for approximately 4 weeks to speed up the root development. All trees, especially wild tamarinds that will be removed from the building site must be carefully examined and any live protected snails have to be professionally relocated to another tree on the property. PROTOCOL ",.03 ~ On-site Relocation or Florida Tree'SnaUs (Liguus (asciatus) The Florida tree snail (Liguusfasciatus) is listed in Chapter 39-27.005(46), Florida Administrati~ Code, as a Species of Special Concern. Chapter 39-27.002(4}~) provides as follows: "(4) Species of special concern - No person shall take, possess, transport or sell any specieS of special concern or pans thereof or their nests or eggs except as authorized by commission regulations or by permit from the executive director or by statute or regulation of any other state agency, permits being issued upon reasonable conclusion that the permitted activity win not be detrimental to the survival potential of the species." Florida tree snails are found on a wide variety of tropical hardwood hammock trees throughout the Florida Keys. The clearing of any tropical hardwood hammock trees supporting tree snails is likely to result in the incidental taking of Florida tree snails pursuant to the above-referenced regulation. This protocol outlines a set of methods for the on-site relocation of Florida tree snails. IffoUowed, these methods should prevent the incidental take of Florida tree snails, obviating the need for persons clearing land to obtain an incidental take permit from the Florida Game and Fresh Water Fish Commission. Persons failing to follow these procedures when clearing vegetation supporting Florida tree snails may be subject to mest. This protocol applies only to the clearing of vegetation on single-family lots, and it applies only to situations where the amount of hammock vegetation remaining on site after clearing is sufficient to support Florida tree snails. The procedures are as fonows: 1. Prior to the clearing of vegetation known to support or suspected of supporting Florida tree snails, the limits of proposed clearing and the area of tropical hardwood hammock to remain on site after clearing shaJJ be clearly defined. 2. Prior to land clearing, paper cups shaH be stapled onto the trunks of trees in the area of tropical hardwood hammock to remain after clearing. 3. All vegetation in the area to be cleared shall be cut by hand, not large land-clearing equipment, to avoid killing Florida tree snails incidental to land clearing. . 4. The trunks, branches, and leaves of all downed trees shall be inspected for the presence of Florida tree snails. 5. When Florida tree snails are found, the branch or leaf on which snails are found shan be snipped off; and the branch or leaf With attached snail shall be placed in one of the paper cups stapled on the tnmks of trees in the remaining area of tropical hardwood hammock. Florida tree snails should not be plucked from branches or leaves as this often leads to death of the snail. Rather, the section of branch or leafwith attached snail should be placed in the cup. The property was cleared a long time ago with an exemption of several large trees. The cleared areas reforested with many trees of different sizes. The canopy is dominated by large wild tamarinds. Two of them have a trunk: diameter of almost 3ft. The property is evenly wooded with 24 woody plant species. Following 2 species are on the list of threatened and regionally important plants: mahogany (5wietenia mahagoni) - 4 mature trees and I sapling with a trunk diameter of 1 W' mastic (Sideroxylon foetidissimum) - 2 thin saplings There also grow 70 protected large common trees with a trunk diameter of 4" or greater. All of the above 77 protected plants were tagged with a pink ribbon with a two-letter tree symbol and a trunk diameter. Locations of mahogany and mastic trees are shown in the sketch. A lone large Jamaica dogwood stands at the street pavement. It is far from the future building site and will not be affected by the house construction. I did not include it in the survey. Exotic plants are just a few. Brazilian peppers are represented by two small shrubs. The property is a home of the protected Florida tree snail CLiguus fasciatus) - species of special concern. I fOlDld there two empty shells and one live snail on a wild tamarind. Since there are so many large wild tamarinds and the whole area is known for these snails, there can be more of them hidden high in the trees. Also an empty shell of the rare banded tree snail (Orthalicus floridensis) indicates its presence on the property. Both of these snail species have to be safely relocated if necessary. As for the required street tree the owner can nominate the mature mahogany growing at the street property line or choose one of the common trees located just east of the mahogany.
