AGENDA ITEM WORDING: Receipt of monthly report on change orders reviewed by the County
Administrator's Office, and a list of change order requests submitted by contractors, and rejected by
Engineering/Facilities Development.
ITEM BACKGROUND: There were three change orders considered and approved by the County
Administrator for the period beginning April 1, 2008 and ending April 30, 2008, for a total cost of
$14,550.00. There were two change order requests submitted by contractors that were rejected by
Engineering/Facilities Development, for a total of $160,010.31.
PREVIOUS RELEVANT BOCC ACTION: On September 9, 1998, Ordinance No. 026-1998 was
adopted in order to provide that the County Administrator may approve separate, non -cumulative change
orders for construction projects and professional service contracts in amounts not to exceed $25,000.00 or
5% of the original contract price, whichever is greater. The BOCC requested a monthly report of all change
orders considered by the County Administrator.

.s previously advised, we are formally requesting an extension to our substantial completion date. As you
re aware from our previous schedule of Nov. 30, 2007, we were supposed to have obtained all of our
IEP rough inspections including the plumbing water lines, on Dec. 21, 2007. The plumbing work change
roposal was approved on Dec. 14, 2007. Materials were ordered and arrived the week of the Christmas
olidays. Work could not be scheduled to commence until Jan. 2, 2008. Once started, the work was
erformed in an expeditious manner, and the last inspection occurred on Jan. 23, 2008.
)o to the fact that we could not obtain the inspection for the water lines, drywall and subsequent finish
ades such as tile, painting, bathroom fixtures installation, etc. were also delayed.
i order to minimize the time delay, we re -scheduled the work by performing partial drywall installations in
ie areas not affected by the water lines requiring inspections. Please note that this was done in the spirit
f cooperation, at an increased expense to us, since this in fact is not a normal sequential manner to do
its work, and was not the originally anticipated manner of installation.
'lease note that the delay incurred by this condition is a total of 33 calendar days. The new substantial
ampletion date will be April 21, 2008. Also note that we are not requesting any monetary compensation,
ven though it is our right to do so.

Attached is a proposed change order for The Medical Examiner's Facility. (Change
Order #8 for the Fonticiella Construction Corp. is for a no cost time extension of
33 days changing the date of completion from 3/19/08 to 4/21/08. The time
extension is needed due to inspection delays and efforts to reduce costs through
value engineering.)
According to the ordinance adopted by the Board of County Commissioners,
proposed change orders are to be presented to members of the Board of County
Commissioners prior to approval, assuming they are within the Administrator's
prescribed limits. Change orders not within the Administrators authority are
placed on the BOCC agenda.
The Acting County Administrator intends to approve this change order on Tuesday,
April 8, 2008.

Dear Kevin,
In order to proceed on resolving these issues, we will need some direction from the County.
Regarding issues 1 and 2, I would recommend installing the additional exit signs and emergency
Iighting to satisfy life safety code requirements. The plans were submitted, reviewed and approved in
2003 under FBC 2001 and NFPA 2002 edition, but we now are under the new updated FBC 2004 and
NFPA 2006 edition.
Regarding issue 3, we have a code conflict between door encroachment into the means of egress and
ADA requirements. Right now the doors swing out into the hallway but there
allowed under Section 1005.2 for R occupancy within the dwelling units -of which there ar t exception
dorm unit and the 6 dorm unit (see attached). If we reverse the door swings and they swing into the
bathrooms, they encroach into the clear space in front of the sinks and are non ADA compliant. It turns
out however, that Overholt never submitted or the building department never processed the ADA
revisions, and that it appears that the building department still has the old plans on file and will accept
non ADA compliant bathrooms in this location. We can reverse the door swings - Overholt has said this
can be done fairly easily - so that the fire marshal's concerns are addressed and resolve the conflict in
favor of life safety.
Another conflicting issue and this applies to this situation and most of the interior doors, is that Chief
Martin in 2003 directed that all interior doors swing toward the route from the dorm
bays to not impede travel during an alarm, s to the apparatus

After meeting with fire marshal, Wally Romero, onsite he was able to clarify his intent as to fire dampers. his meaning was to include
fire dampers in ducts penetrating rated partitions that operated off relay that shut down air handlers when triggered by alarm.
Dampers are necesary due to the fact that duct wallboard has no sufficient rating. Flame spread through ductwork into adjoining
plenum spaces is possible without dampers in place as we discussed earlier.
Overholt will provide cost changes ASAP.

Attached is a proposed change order for the Tavernier Fire Station. (Change
Order #17 for Overholt Construction Corporation is for remaining change order
claims for which approval is recommended. Changes represent items of unforeseen
conditions, items required for final inspection but not anticipated during
construction, and slight design changes necessitated by the actual conditions in the
fire station. See attached.)
According to the ordinance adopted by the Board of County Commissioners,
proposed change orders are to be presented to members of the Board of County
Commissioners prior to approval, assuming they are within the Administrator's
prescribed limits. Change orders not within the Administrator's authority are
placed on the BOCC agenda
