This action is requested in response to public input, willingness by Keys Energy Services to negotiate a short-term lease with the County to maintain the facility for basic animal services in Big Pine Key, and legal limitations concerning amending current contacts. ITEM BACKGROUND: Since the BOCC action noted below was taken, there has been significant public concern demonstrated relative to the closure of the Big Pine Key animal shelter. Additionally, the issue of removing funds from contracts currently in force without a commensurate reduction in scope of work is potentially problematic according to the County Attorney because the contractors do not want to sign the addendums to reduce funds, which they have no contractual obligation to agree to do. As a result, preliminary discussions were initiated with Keys Energy Services (KES) regarding the potential for continuing a lease for the Industrial Road property and with Stand Up for Animals (SUFA), the contractor responsible for the Big Pine Key area. KES is willing to enter into a short-term lease agreement with the County, and SUFA is interested in continuing services from 9-1 IA, Wednesday -Saturday, in the Big Pine facility at the current contract rate. If this agenda item is approved to rescind the action of 1/25/08, a renewal addendum for SUFA will be presented for approval next month to the BOCC at the current contract rate with no reduction and with no CPI increase. No CPI increases will be requested for approval by the BOCC by any of the three animal control contractors in FY08 or FY09. PREVIOUS RELEVANT BOCC ACTION: On 1/25/08, the following BOCC motion was approved: "Motion was made by Commissioner Spehar and seconded by Commissioner DiGennaro that the Humane Animal Care Coalition, Stand Up for Animals, and the Florida Keys Society of Prevention of Cruelty to Animals, Inc. decrease each of their budgets the amount of $17,000 for 2 years and authorized the preparation of an addendum to decrease for same." CONTRACT/AGREEMENT CHANGES: Pending approval of this agenda item; SUFA contract renewal addendum and KES lease for property. STAFF RECOMMENDATIONS: APPROVAL. It is requested that the CSD Director be directed to negotiate with SUFA a renewal contract addendum that will be presented to the BOCC in June. The addendum will include the continuation of basic animal services in Big Pine Key at the Industrial Road property. SUFA is thus far agreeable to provide services from 9-1 IA at the property, Wednesday- Saturday. It is further requested that the CSD Director be directed to negotiate with KES to extend its lease with the County for the Industrial Road property for a period of not less than 2 years to be used for basic animal control services and that a lease be placed on an upcoming agenda for BOCC approval.
