Murphy, District 5 February 20, 2008 This item requests approval for the County to agree to the settlement between the Workers Compensation Excess Carrier, National Union, and the Claimant, a former Sheriff's Department employee, in the amount of $225,000. This 1991 workers compensation claim is covered by an Excess Carrier Policy which is a "Reimbursement" type policy. The insurer will reimburse the County for sums we pay that is in excess of the self insured retention. This claim has surpassed the self insured retention amount, therefore, the policy will reimburse the fill amount of the settlement of $225,000 to the County. The settlement takes into consideration exposure for past and future indemnity and medical benefits, attorney's fees, costs, applicable liens and expense of litigation. In complying with the provisions of the excess insurance policy, the named insured (Monroe County) shall be obligated to accept any reasonable offer or settlement made by the Excess Carrier (National Union). It is believed that this is a fair and equitable settlement therefore it is my recommendation that the BOCC approve the settlement in the amount of $225,000.
