OFFER FROM THE MONROE COUNTY LAND
AUTHORITY.
WHEREAS, James & Karen Hoefert submitted an application for administrative
relief under Sec. 9.5-122.3 of the Monroe County Land Development Regulations; and
WHEREAS. the Monroe County Board of County Commissioners makes the
following findings of fact and conclusions of law:

1. The application for administrative relief from James & Karen Hoefert is
for Lot 26. Block 3. Ocean Park Village Subdivision. Key Largo in
Monroe County. Florida having RE# 00446040.000000.
2. The date of the ROGO application is 6/16/2004.
3. The ROGO allocation application has been in the ROGO system for at
least four (4) consecutive years and qualifies for administrative relief
under Policy 101.6.1 of the Monroe County Year 2010 Comprehensive
Plan.
4. Monroe County Code (MCC) Section 9.5-122.3 provides a mechanism
whereby an applicant who has not received an allocation award in
ROGO may apply to the Board of County Commissioners for
administrative relief.
5. The Board of County Commissioners (BOCC) has the authority to grant
administrative relief under Section 9.5-122.3(f) and may grant the
applicant a building allocation. offer to purchase the property at fair
market value. or provide such other relief as may be necessary and
appropriate.
6. The applicant applied for administrative relief on 6/19/2007. under
Section 9.5-122.3 of the MCC and Policy 101.6.1 of the 2010
Comprehensive Plan.
7. Policy 101.6.5 of the 2010 Comprehensive Plan provides criteria to be
used for determining lands that are appropriate for acquisition and the
criteria includes the environmental sensitivity of the vegetative habitat
on the lot and the applicable Tier designation.

8. The subject property has the land use district designation of Improved
Subdivision (IS), is located in the Ocean Park Village Subdivision and is
located in a Tier 3-A designated area.
9. Monroe County Code (MCC) Section 9.5-122.3(t) states the Board may
offer to purchase property at its fair market value as the preferred action
for property located within Tier 3-A.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Administrative relief is granted to James & Karen Hoefert, for Lot 26, Block 3, Ocean
Park Village Subdivision, Key Largo in the form of a purchase offer by the Monroe
County Land Authority.

4 Eligibility for Administrative Relief Options:
5 Section 9.5-122.3 of the Monroe County Land Development Regulations and Policy 101.6.1 of
6 the 2010 Comprehensive Plan provides a mechanism whereby an applicant who has not received
7 an allocation award in the ROGO system may apply to the Board of County Commissioners for
8 Administrative Relief. The applicant is eligible for Administrative Relief having complied with
9 all requirements of the dwelling unit allocation system and having been considered in at least the
10 first sixteen consecutive quarterly allocation periods, and not having received an allocation
11 award. The application was timely submitted for administrative relief in the form of one (1)
12 ROGO allocation award and has not expressed a desire to sell the property to the County.

14 Relief Options under Administrative Relief:
15 The remedies available for Administrative Reliefpursuant to Section 9.5-122.3 includes:
16
17 a. Offer to purchase the property at its fair market value as its preferred action if the
18 property is located within: a) a designated Tier I area; b) a designated Tier IT area
19 (Big Pine Key and No Name Key); c) a designated Tier ill-A area (Special
20 Protection Area); or d) a designated Tier ill area on a non-waterfront lot suitable
21 for affordable housing.
22 b. Grant the applicant an allocation award for all or a number of dwelling units
23 requested in the next succeeding quarterly allocation period or extended pro rata
24 over several succeeding quarterly allocation periods as the preferred action for
25 buildable properties not meeting any of the criteria in (1) above.
26 c. Suggest or provide such other relief as may be necessary and appropriate.

28 Additional Relevant Information:
29 The vegetation survey submitted with the application describes the parcel as having been cleared
30 in the past with a revegetation with both native and exotic species. Although the number oflarge
31 trees (> 4 inch DBH) is limited, (approx. fifteen), the species list includes a total of twenty-four
32 (24) different native species of trees and shrubs, nineteen (19) of which are catergorized as fruit
33 producing, thus supporting wildlife. The property is bordered on the north and east by vacant,
34 wooded parcels, and has been designated as Tier 3A, Special Protection Area. LDR Section 9.5-
35 122.3, Comprehensive Plan Policy 101.6.5, and BOCC Ordinance 009-2007 all recommend
36 purchase of parcels designated within Tier 3A, Special Protection Area.

38 In the event purchase is recommended and the owner refuses the purchase offer, the
39 applicant may remain in the ROGO System and continue earning perseverance points
~? according to the vesting provision of Tier Ordinance 009-2007.
42 IV. RECOMMENDATION

44 It is recommended that the Board of County Commissioners find that the applicant has met the
45 criteria and qualifies for Administrative Relief. It is further recommended that a Resolution be
46 prepared that establishes this relief by offering purchase by the Monroe County Land
47 Authority.

One June 3, 2004 my wife and I purchased Lot 26, Block 3 in Harris Park In Tavernier for
our daughter who upon graduating college decided to move back to the Keys where she
was born and grew up.
Before purchasing the lot I checked with the then Biologist Niko Reisinger to make sure
the lot was not a hammock lot, due to the restrictions on hammock lots! Niko then gave
me the determination that the lot was disturbed and would receive plus one point in the
ROGO system for being disturbed. I then ordered a vegetation survey (see attached page
#5) from Marcella Nemec at which time she verified that the lot was areatlv disturbed.
UpoJ1 turning It into the building department the also then Biologist Alex Score also
deemed It disturbed and scored It plus one for being disturbed.
Upon entering ROGO I also dedicated a ROGO lot for two (2) extra points so I would be
able to get the permit faster. I then waited three years in ROGO and would have a permit
by know if it wasn't for the Tier System and my lot being improperly scored in the tier
system..
If my lot was properly scored in the Tier System I would also have a permit by now since
the lot ,only got 20 points for being a Tier 3A where the lot should be a Tier 3.
Upon finding out that my lot was Improperly scored I contacted SylVia Murphy In which
she told me to contact Ralph Gouldy the head county biologist at which time he also
agreed with me that the lot should be in a Tier 3 not a Tier 3A, he recommended to me
that a tier change could take a very long time and that I would probably have the permit
though Administrative Relief by then.
I then entered into Administrative Relief and waited upon receiving the letter regarding
the hearing, I contacted SylVia Murphy and she informed me that my lot was up for
purchase and not an allocation!
I am therefore contacti commissioners that I am not up for a purchase
offer. I am requesting n allocation residence just as I started with four years ago
so my daughter and her now usband can build a home.
If you look at Page 2 in the enclosed package I have highlighted all the lots around mine
that have existing residences on them.

You can also see the close proximity my lot has to both First Street and Beach Street as
they are. the main trough fares into Harris Park and would not be favorable for an
environmentally sensitive area.
Also included on Page 3 is a letter from the Fish and Wildlife showing that it was a
disturbed not, I have also included on Page S a copy of my Vegetation Survey showing a
greatly disturbed hammock and on Page 8 showing the plus 1 point for a disturbed lot
from Monroe County.
On Page 10 I have outlined in yellow all hammock lots that are a Tier3!!!!!!
Outlined in pink are the Tier 3A lots where my lot should NOT be since my lot has a plus
one biological point and is a disturbed lot!!!!!!!!!!!

on your project which involves construction of a single-family residence. The project is located
at 463 Beach Road, Lot 26, Block 3, Ocean Park Village Subdivision, Key Largo, Monroe
County, Florida. The Real Estate lot number is 00446040-000000.
Site Description
Lot 26 is a 100-foot by 60-foot lot in a developed subdivision. The property is bounded by
developed lots on each side and Beach Road. A Service representative visited the site on

significance within the construction zone should be transplanted elsewhere on the property.
Exotic pest species should be removed.
Effect Analvsis
The square footage of the planned residence was not immediately apparent from the site plan
submitted with the request. However, it appears from your plan that practically all of the lot will
be cleared for construction,
The Service's Geographical Information Systems database shows suitable habitat for the
endangered Schaus swallowtail butterfly (Heraclides aristodemus ponceanus) and the threatened
Stock Island tree snail (Orthalicus reses reses) nearby, but not on the proposed construction site.
Given the level of onsite disturbance and adjacent development, the Service does not believe the
property is suitable habitat for Stock Island tree snails or the Schaus swallowtail butterfly.

its northern and eastern border lines and developed property on the western side.
_ _,., ", __, ' time ago with an exemption of several large common
native trees, mostly gumbo-limbos and wild tamarinds. A natural reforestation of the cleared
areas has not been successful. Exotic plants replaced the native vegetation in large areas. The
street-front part of the property was invaded mostly by Brazilian PllPpers. lead trees, yellow
elders and non-woody exotic plants. More than half of the property's back part was taken over by
large latherleaf vines. They climb up the trees and create a labyrinth of their branches in
understory areas.
A stripe of land along the western border line is free of woody vegetation. It was
probably cleared when the neighbor's fence was put up there. A low wall of rocks and some plant
refuses are behind the cleared stripe.
Besides large native trees with a trunk diameter of 4" or greater just the following one
small tree species is also included in protected plants:
inkwood (Exothea paniculata) - I short sapling
It was tagged with a pink ribbon and its location is shown in the sketch.
As for the required street tree the owner can nominate one of the several trees growing
along the street property line.
