ITEM BACKGROUND: A Request for Qualifications was issued on May 2, 2008. Two responses to
the RFQ were opened on June 24, 2008, at the Purchasing Office. Staff reviewed the responses
according to the Developer Evaluation Criteria and determined one respondent to be qualified and the
other to be non-responsive. Please see attached Staff Report.
PREVIOUS RELEVANT BOCC ACTION: The County requires that land purchased by the County
for affordable housing development be granted only to developers who have submitted and been
determined to be qualified to provide that service. Last year, the County issued a similar RFQ seeking
to pre-qualify housing developers interested in the possibility of developing affordable and workforce
housing on county-owned land. At that time, 7 developers were qualified and placed on the County's
list of "Approved Housing Providers." Middle Keys Habitat for Humanity wishes to develop a parcel
of land in Marathon that has been purchased by the Monroe County Land Authority, and therefore must
be authorized as qualified.

I. Background - 2006 RFQ
In 2006, Monroe County's Housing and Community Development Division issued an Request for
Qualifications, seeking to pre-qualify interested housing developers to potentially develop housing
on land that is owned or purchased in the future by the Monroe County Board of County
Commissioners or the Monroe County Land Authority (pursuant to authority set forth in the
following sections of Florida Statutes 125.0101, 125.01055, 125.35, 125.379, 163.3220 and
380.032.) At that time, seven developers were pre-qualified: HFH-Lower Keys, HFH-Upper Keys,
Middle Keys Community Land Trust, Gorman and Company, Biscayne Housing Group, Old Town
Key West Development, and Lamadrid Construction
II. Current 2008 RFQ
The Division of Housing and Community Development issued a Request for Qualifications HCD
RFQ No. 2008-02H. The request opened on May 2, 2008 and closed on July 24, 2008. The
purpose of the RFQ was to provide an opportunity for interested housing developers to be added to
the County's existing list of "pre-qualified" developers to develop workforce housing on parcels
owned or purchased by the BOCC or the Land Authority.
We received two responses; one from Habitat for Humanity of the Middle Keys, a not-for-profit
developer based in Marathon, Florida and the other from Carmel Capital LLC, a for-profit
developer based in Windermere, Florida.
Respondents were asked to submit information related to their qualifications, experience, finances,
references, and track record for developing and constructing affordable and/or workforce housing.
Staff reviewed and evaluated each respondent's statement of qualifications. The submission from
Carmel Capital LLC was determined to be non-responsive (the information is incomplete, not
responsive to the request, and, in some cases, illegible) and therefore could not be properly
evaluated.
III. Recommended Action
Staff recommends that BOCC APPROVE Habitat For Humanity of the Middle Keys to be included
on the County's list of "Approved Housing Development Service Providers."

I. INVITATION
Monroe County Board of County Commissioners ("BOCC") invites developers (individuals, entities,
joint ventures or teams, for profit or not for profit) with qualifications and experience to respond to this
Request For Qualifications ("RFQY' or "RFQ 2008-02" for Housing Development Services. The
successful respondent(s) (the "Developer") will be listed as qualified to work with the BOCC to
develop and construct affordable and/or workforce housing which will be made available for sale
and/or rental with restricted rental rates to residents of Monroe County whose gross incomes are less
than 160% of the county's median income. In some cases, on some land parcels, gross incomes of
residents will not exceed 120% AMI.
It is anticipated that the County may qualify one or more developers, based upon their respective
experience and capabilities, to provide different types of rental or home-ownership housing services
(e.g. "single lot" development and/or ''multi-family community development.") An evaluation team of
county employees and/or third-party governmental or private consultants will rank: the responses and
make recommendations to the BOCC.
The County reserves the right not to qualify any Developer for any services, to qualify or decide not to
qualify one or more Developers for celtain types of future housing development services, to disqualify
a Developer at any later date for any lawful reason, and to readvertise for these and similar services in
order to add to, change, and expand or contract its housing activities, in its complete discretion.
Once the BOCC approves a Developer for inclusion on the County's list of "Approved Housing
Development Services Providers" maintained by the Division of Housing and Community
Development or other designated office, the County may in its full lawful discretion elect at any time
or at no time to contact or engage any approved Developer to submit appropriate development
proposals for County properties. All final contracts and/or dispositions of County property shall be
approved by the BOCC.
The County declares its intent to negotiate, enter into agreements, leases and other ventures within the
fullest extent of its lawful latitude and flexibility to do so, as it deems necessary in order to address
critical housing needs throughout the Florida Keys, pursuant, but not limited to, authority set forth in
Sections 125.0101, 125.01055, 125.35, 125.379, 163.3220, et seq., and 380.032, Florida Statutes.
Moreover, Developers should be familiar with Chapters 9.3 Land Acquisition Program and 9.5 Land
Development Regulations, including but not limited to Sections 9.5-4 and 9.5-266, of the Monroe
County Code; among others, Monroe County Ordinance No. 005-2006 ("Pmchase and Development
Program''); and, generally with, among other instruments, the nature and substance of those recorded at
Book 2145 Page 1282 (warranty deed with restrictions), Book 2146 Page 1264 (warranty deed with
restrictions), Book 2242 Page 753 (warranty deed to County related to 99-year lease back), and Book
2242 Page 754 (County example form of 99-year lease), of the Public Records of Monroe County,
Florida.
In formulating this RFQ the County has used care in its descriptions of services it contemplates
needing. However, the County shall not be liable to any person or party for any errors, omissions or
inaccuracies that may be contained in this RFQ or that may be in any other way connected with its
issuance, it's processing and any follow-up activities related to it. Each Developer responding to this
RFQ or subsequently acting with respect its response does so upon reliance on its own due diligence
and understanding and acceptance of the fact that errors, omissions and inaccuracies can and
sometimes do occur. The County may (but need not), in its sole discretion, waive objection to or

otherwise overlook technical or what the County deems to be deemed minor response defects~ and it
may request further documentation or infonnation from one or more respondents as long as the
material fairness of the process is not affected.
All submissions must remain valid for a period of 90 days from the date of opening.
II. QUALIFICATIONS
Each Developer responding to this RFQ 2008-02H must have within its team direct successful
experience in in the develoDment. construction and operation of affordable/workforce/emplovee
housing and at least two or more of the following:
a. Experience in maximizing the use of housing resources~ including real estate acquisition
and financing mechanisms;
b. Experience in site preparation and infrastructure development;
c. Experience in obtaining low income housing tax credits;
d. Experience in obtaining other sources of financing;
e. Experience in housing developments that incorporate tax credit financing or other
federal~ state or public or private affordable housing financing;
e. Experience in residential rental property management including maintenance and
security functions;
g. Experience with regulatory compliance issues related to development in the Florida
Keys (environmental, AlCUZ, etc.); and/or
h. Expertise in Section 3 and Women Business Enterprise (WBE) and Minority Business
Enterprise (MBE) compliance.

Attached to this Request for Qualifications is a "Statement of Qualifications." All questions must be
completed in fulL Respondents must also complete the required "Response Form", "Drug Free
Workplace ", "Non Collusion ", "Lobbying and Conflict of Interest" and "Information Disclosure
Authorization" forms. In addition, all respondents are required to read and adhere to the attached
"Public Entity Crime" form.
Your response package will include The Statement of Qualifications, any supporting documents~ and
Required Forms. Submit 5 sets of your response package~ with two (2) sets containing original
signatures, in a sealed envelope. Clearly mark on the outside of the sealed envelope:

Responders are responsible for ascertaining that they have received any RFQ 2008-02H Addenda
issued. However, the County shall not be obligated to answer any or all questions submitted, doing so
being a courtesy and effort to make more effective this RFQ, and only to the extent time and staffing
permit. However, the County will attempt to post answers to questions during the RFQ 2008-02H
response period. The County shall not be responsible for Internet, server, ISP, connectivity or other
website/computer-related problems with answers.

VIll. GENERAL INFORMATION
The County reserves the right to terminate or limit its initial or prior approvals for a selected or
approved Developer for, among others, following reasons:
~ Bankruptcy declaration by the Developer or any entity holding ownership interest in the
project;
o Failure to receive prior written approval from the County to alter the Ownership structure or
Project Team structure of the selected Developer;
o Misrepresentation of any material fact in the selected Developer's statement.
o Changes in circumstances of the County, the Developer, and/or the real estate market;
o Changes in law and/or regulations;
o Changes in County policies for needs as determined the County in its complete, lawful
discretion;
o Placement of the Developer on the convicted vendor list; and/or
o Any other assessment of a developer's qualifications made by the County that leads the
County to deem the Developer as no longer qualified to provide services generally or for a
specific parcel/proj ect.

DRUG-FREE WORKPLACE FORM

DEVELOPER QUALIFICATIONS
Carmel Capital LLC is a builder/developer of residential housing. We
have the capacity to site-build with any material (poured concrete
wall, concrete block or wood-frame), and have developed a sub-
specialization and expertise in applying modular and factory-built
construction techniques to the residential development and
construction process.
Carmel Capital LLC was most recently named one of three
bUilder/developers by the Lake County Board of Commissioners to
provide replacement housing as part of the disaster relief initiative to
replace up to 40 homes recently destroyed by tornadoes, a project
where we are exclusively utilizing modular housing.
We are also actively involved in the construction and delivery of site-
built and modular housing to communities throughout Florida as part
of SHIP (State Housing Initiative Partnership), CDBG (Community
Development Block Grant), and HOME funding programs.
PROJECT TEAM
Jon Anthony DeLuzio, AICP is the President of Carmel Capital LLC. He
possesses over 15 years of private-equity single- and multi-family
development experience in both the Northeast and Florida. Mr.
DeLuzio's range of experience has included residential and mixed-use
development activities in the states of Florida, Massachusetts, Rhode
Island, Connecticut and New York.
Recent projects include the Village at Silver Hill, a 46-unit Planned Unit
Development in southeastern Massachusetts, which sold-out in 2005.
Currently, Mr. DeLuzio is working with the Department of Community
Development of Lake County, FL, rebuilding up to 40 single-family infiU
homes destroyed during the tornadoes of 2007.
Mr. DeLuzio received a Master's Degree in Real Estate Development
and a Master's degree in Urban Planning, both from Columbia
University. He is also a member of the American Institute of Certified
Planners of the American Planning Association, and is a licensed
general contractor in the State of Florida (CRC 1326966).
John Ferrara is Vice President of Project Management for Carmel
Capital LLC. He was formerly the President of Grace Development LLC,
which recently completed a 21-unit single-family subdivision in
Gainesville, Georgia. Prior to that, Mr. Ferrara was a Senior Project
Manager with St. Joe Company, managing the design and construction
process for their award-winning $100 million + ~~Watercolor" mixed-
use development on Florida's northern Gulf Coast.
Mr. Ferrara received his Master's Degree in Real Estate Development
from Columbia University, and holds a Bachelor of Science in
Landscape Architecture from Syracuse University.

Habitat for Humanity of the Middle Keys Community Land Trust
(HFHMKCL T) is the entity owning the land where Habitat for Humanity of
the Middle Keys (HFHMK) builds affordable workforce housing for low to
moderate income families. As 501 c3 non profit corporations, our volunteers
make up the board of directors, who then appoint the President, VP,
Secretary, Treasurer and Information Officer. Effective February of 2007, a
part-time Executive Director was hired.
Our members are from different walks of life, each bringing different
backgrounds and expertise. Additionally, we are supported by and
contribute to Habitat for Humanity International. This provides additional
expertise and resources at an international level, which in turn, provide
unique funding and resource opportunities. As an example, we receive
major appliances at no cost as a result of Habitat's relationship with major
companies, such as Whirlpool.

Key Staff include:
Bruce Ferraro, President. Bruce brings over ten years experience in building
and developing affordable, workforce housing in the Keys. He fronts the
organization as our Public Relations representative, addressing key
contributors, different organizations, potential future volunteers and the
media. Bruce has been a volunteer with Habitat for 21 years in Georgia and
Florida, having been involved in the building of over 100 homes. He also
chairs the Annual Gala, our largest fundraiser.
Jeff Smith, V.P. With his fmancial background in the banking industry, Jeff
is in charge of the budget for building new homes. He is also the one who
solicits locally for funds via the Florida Tax Program.
Chris Todd, Information Officer. Chris has an extensive background in
marketing and advertising. She handles all of our PSA's and keeps us in
front of the media for all events. She is in charge of the Country & Western
fundraiser.
Mike Kiraly, Secretary. As a long time mortgage manager in the banking
industry, he handles financial and risk management for our candidates. He
also chairs the Mother's Day Dolphin Tournament fundraiser.
Lupe Marzoa, Treasurer. Lupe brings years of banking and accounting to
the table. She handles the day-to-day bookkeeping and Chairs the
Fundraising Committee.
LiIi Huergo, Executive Director. As a corporate staff manager, LiIi
compliments the organization in all other areas.

volunteers are professionals with many years experience in the corporate
world.
They are used to adhering to budget restraints and completing all projects on
or before they are due.

Bruce Ferraro, President, had a 30 year career in sales and management
with AT&T. He was responsible for managing budgets and projects for up
to thirty (30) subordinates at any given time.
Jeff Smith, VP and Lupe Marzoa Treasurer, have been bank officers in
charge of a branch, managing budgets and subordinates.
LiIi Huergo, ED retired from AT&T after 28 years of staff and project
management. She was also responsible for setting and adhering to budget
restraints.
Our last project, 4 houses on 64 St, Marathon were completed within 4% of
proposed budget.

underlying fee simple title to the developed property remained with a local government
or a public or quasipublic entity?
Habitat for Humanity of the Middle Keys Community Land Trust has
completed one (1) single family home utilizing a land lease. Four (4) more
homes are completed with title closing scheduled for June 27, 2008.
We will begin construction of two (2) more houses in the fourth quarter of
2008. The ground leaselland trust model will be utilized.

a. Describe financing techniques for raising capital that your organization has employed.
Habitat for Humanity of the middle Keys utilizes private and public funding
sources to acquire, develop and manage workforce housing. Financial
assistance has been provided by The Monroe County Land Authority,
Florida's Community Contribution Tax Credit Program, private and
corporate donations, fund raisers and our own mortgage portfolio.
b. Describe your approach to managing the financial risk associated with affordable and
workforce housing development.
As a Land Trust, developer, contractor and mortgage holder, Habitat for
Humanity of the Middle Keys ensures true affordability.
In order to be selected, applicants are evaluated based on their ability and
sweat equity program. This ensures the selection of highly motivated
applicants.
c. What is the nature and extent of your current equity interest(s), or that of any person or
entity involved in this suhmission, in each of the projects described in 2 above?
As a 501 c3 non profit, all equity is held by the corporation.

1. Publish a statement notifying employees that the unlawful manufacture, distribution,
dispensing, possession, or use of a controlled substance is prohibited in the workplace
and specifying the actions that will be taken against employees for violations of such
prohibition.
2. Inform employees about the dangers of drug abuse in the workplace, the business's
policy of maintaining a drug-free workplace, any available drug counseling,
rehabilitation, and employee assistance programs, and the penalties that may be imposed
upon employees for drug abuse violations.
3. Give each employee engaged in providing the commodities or contractual services that
are under bid a copy of the statement specified in subsection (1).
4. In the statement specified in subsection (I), notify the employees that, as a condition of
working on the commodities or contractual services that are under bid, the employee will
abide by the terms of the statement and will notify the employer of any conviction of, or
plea of guilty or nolo contendere to, any violation of Chapter 893 (Florida Statutes) or of
any controlled substance law of the United States or any state, for a violation occurring in
the workplace no later than five (5) days after such conviction.
5. Impose a sanction on, or require the satisfactory participation in a drug abuse
assistance or rehabilitation program if such is available in the employee's community, or
any employee who is so convicted.
6. Make a good faith effort to continue to maintain a drug-free workplace through
implementation of this section.
