ITEM BACKGROUND: The existing language in Article 6, Section 6.1 and Section 6.2 did not provide an equitable method to apply classification seniority to promoted positions. Tile existing language recognizes seniority based upon the initial date of employment. The existing language would be a disincentive for promotion because it would place newly promoted individuals more senior in classification over others who have held the position for a longer period of time. PREVIOUS RELEVANT BOCC ACTION: On December 21, 2005 the Board approved contracts with Professional Firefighters of Monroe County, LSFF, Local 3909 for Unit One and Unit Two. On March 15, 2006 the Board approved the inclusion of paragraph 8.4.1 concerning paramedic certification and compensation in the Agreement between Professional Firefighters of Monroe County, IAFF, Local 3909 for Unit 2, and substituting page 25 in the Agreement. On November 15, 2006, the Board approved Addendum 1 to the Collectively Bargained Agreement Unit One to add Exhibit C, Firefighter/Paramedic Repayment Agreement per paragraph 16.4.3 of said Agreement. CONTRACT/AGREEMENT CHANGES: Article 6, Section. 6.1 and Section 6.2 relating to Seniority Application and Determination were amended in order to provide an equitable method to apply classification seniority to promoted positions. STAFF RECOMMENDATIONS: Amendment No. 1 to the IAFF Agreements was ratified by the membership of the bargaining union on July 15, 2008, and staff recommends approval. Z To the Collective Bargaining Agreement Between. The Board of County Commissioners of Monroe County And The Professional Firefighters of Monroe County, IAFF, Local 3909 Whereas the parties agree that the collective bargaining agreement establishing the wages, hours, and terms and conditions of employment for the employees represented by Local 3909 must be amended, the parties hereby agree to amend Article 6, Section. 6.1 and Section 6.2, of the collective bargaining agreements as Follows: I. Article 6, Section 6.1, shall be deleted in its entirety and the Following language shall be substituted in lieu thereof: 6.1. Seniority Application. Department Seniority and classification seniority, as applicable, shall be used to determine station assignments, as appropriate and consistent with the County's management rights. Departmental seniority shall also be used to resolve all other issues concerning seniority, as appropriate and consistent with the County's management rights. 2. Article 6, Section 6.2, shall be deleted in its entirety and the following language shall be substituted in Iieu thereof: 6.2 Seniority Determination. Classification seniority for employees within the ranks of Lieutenant, Captain, and Battalion Chief shall be based upon the individual's last date of promotion to the position. In the event of the sane date of promotion to the position, the employee with the higher departmental seniority shall be more senior. Departmental seniority shall be determined by the individual employee's last date of permanent hire or transfer to Monroe County Fire Rescue. If two or more employees have the same date of hire, the more senior employee shall be the employee with the highest attained classification. If two or more employees have the same classification, the one who first submitted his or her application for employment would be more senior. In the event one of the employees is a transfer from another department within the county, the transferred employee shall be the more senior employee. In the event two or more transferred employees have the same date of transfer, the date of initial employment with the County, in any department, shall determine departmental seniority. If these procedures fail to determine the more senior employee, the employees shall draw lots to deters -nine order of seniority. This Amendment No. I amends both the Unit One and Unit Two collective bargaining agreements and must be ratified by both bargaining units before being effectuated. Upon ratification by both bargaining units and the County, this Amendment No. I shall be retroactively applied to Janntaxy 1, 2008. 4. Upon ratification, and retroactive to January 1, 2008, the &e6eAty list for departmental s miority attached hereto as Addendum A and classification seniority„ attached hereto as Addendum B shall be the master seniority lists for Monroe County Fire Rescue. As additional employees are hired, or as current employees sever employment, or Promotions are made the master seniority lists shall be axnended to reflect the same and modified to reflect changes in the order of seniority among employees. EXCEPT AS AMENDED HEREIN, THE COLLECTIVE BARGAINING AGREEMENTS FOR BOTH UNIT ONE AND UNIT TWO SHALL REMAIN UNCHANGED AND IN FULL FORCE AND EFFECT.
