ITEM BACKGROUND:
The Planning Commission granted preliminary plat approval for a subdivision on Rockland Key on
January 11, 2006. The BOCC granted a one (1) year extension expiring on April 18, 2008. On January
2, 2008, a request by the applicant was submitted via the Growth Management office for an additional
one (1) year extension. The applicant has made substantial progress toward satisfying conditions for
final plat approval, but needs additional time to obtain necessary permits from State agencies.

RE: APPROVAL OF SECOND EXTENSION OF FINAL PLAT
APPROVAL FOR R0CKLAND INVESTMENT CORPORATION, INC.
Background
The Planning Commission granted preliminary plat approval for a subdivision
on Rockland Key on January 11, 2006. The BOCC granted a one (1) year
extension expiring on April 18, 2008. On January 2, 2008, a request by the
applicant was submitted via the Growth Management office for an additional
one (1) year extension.
The applicant is Rockland Investment Corporation, Inc. The development
project is known as Rockland Key Commerce Center. The preliminary plat was
approved with specific conditions to be satisfied before filing for final plat
approval. The conditions included requirements for obtaining necessary permits
from State agencies and the provision of financial guarantees and maintenance
agreements for infrastructure improvements. Applicant is waiting the approval
of the South Florida Water Management District (SFWMD) Environmental
Resource Permit (ERP) #060925 -15, submitted on September 16, 2006. The
coordination of the Monroe County Engineering Department shall happen after
final plat approval.
Pursuant to Section 9.5 -83 (f) Limitation on Approval of Preliminary Plat, Monroe
County Code, the applicant has one (1) year after preliminary plat approval is
granted to file for final plat approval, and unless an extension is granted by the
Board of County Commissioners, the approval of the preliminary plat is
automatically rendered null and void. Therefore, the applicant is requesting an
additional one (1) year extension to file for final plat approval.

On January 9, 2006, the Planning Commission granted Preliminary Plat approval for the
Rockland Key Commerce Center. This is a subdivision of property that is zoned and historically
has been used for Industrial purposes. The required regulator' permitting for this site is
extensive. We requested and were granted an extension for Final Plat approval last year.
Attachment 1 summarizes of the status of the regulatory permits that are required for this project.
It has always been the intention of our client to complete the infrastructure prior to approval of
the Final Plat. Significant progress has been made to accomplish that goal. The water main ha..s
been extended, the underground electric and communication lines are in place, the public sever
and reuse water main lines have been installed and the preliminary site preparation for the road
system has been completed. A FDOT NOI (Notice of Intent to issue a permit) has been received
for the US 1 access and drainage modifications that are required.
Our engineers have been �ti'orking with South Florida Water Management District for the overall
project drainage pen since September 200 The Environmental Resource Permit (ERP) has
not been issued and it will require, according to the latest correspondence, at least another 90 to
120 days for processing. The additional revic " requires site inspections by SFWMD personnel_
Furthermore, the construction required for the drainage systetn will require at least six months
for completion. As a result, Ave are requesting an extension for one year in order to ensure the
ERP has been issued and the %work commenced.
Upon receipt of the ERP, we will submit a complete application for Final Plat approval. Thus,
We respectfully request that the Board Of County Commissioners grant us an extension to Sec;.
