ITEM BACKGROUND: The Petitioner is seeking to abandon a platted but un-built alleyway which adjoins Barracuda Boulevard and runs between his properties located on Barracuda Boulevard and Pompano Drive. Barracuda Boulevard is a double- wide street (approximately 80 feet) with a landscaped median separating either side of Barracuda Boulevard. This Petition has been reviewed and written recommendations of no objection received from Monroe County Planning, Engineering, Fire Marshall, Code Enforcement and the Monroe County Sheriff's Office. Letters of no objection have been obtained from all utilities. Any conditions of approval required by staff and/or the utilities have been satisfied by Petitioner. Letters of no objection have been obtained from all affected property owners with the exception of Eugene and Diane Smith, the owners of property located on the opposite side of Barracuda Boulevard (RE# 552370, 552380, 552530 and 552540), stating "As the owners of property that abuts another alley we do not want to agree to this abandonment only to find ourselves in a fight to keep our alleyway a few months from now. We feel that the alley is a valuable enhancement to the property as it all(Jl1Js access to the rear of the lots." Please note that the alleyway which abuts the Smith's property has different characteristics than the subject alleyway proposed for abandonment. The Smiths' property abuts to a different alleyway that is shared by two (2) other property owners and provides through access from Barracuda to Bonita, a public road; unlike the subject alleyway proposed for abandonment in which the owner owns all parcels adjacent to the alleyway and the alleyway only provides access between Barracuda Boulevard and properties owned by the Petitioner. While the Smiths' have objected to the Petitioner's proposed abandonment of the alley, the proposed abandonment of the alley would not impact access to the Smith's property nor the flow of traffic on Barracuda Boulevard. MCC 16-1 (b) states ". . . no right-of-way can be abandoned unless there is an agreement to do so by all property owners of both sides of the right-ol-way." Based on the survey and legal description provided by the Petitioner, the alleyway proposed for abandonment runs up to the right-of-way, as with the Petitioner's properties, and does not include the right-of-way on Barracuda Boulev,ard. The Smiths' property also abuts an alleyway that is shared by two (2) other property owners running from Barracuda to Bonita. While the Smiths' have objected to the Petitioner's proposed abandomnent of the alley, it does not appear the proposed abandonment of the alley would impact access to the Smith's property nor the flow of traffic on Barracuda Boulevard, MCC 16-1(b) states "...no right-of- ~ can be abandoned unless there is an agreement to do so by all property owners of both sides of the right-of-way." Based on the survey and legal description provided by the Petitioner, it appears the alleyway proposed for abandomnent runs up to the right-of-way, as with the Petitioner's properties, and does not include the right-of-way on Barracuda BoUlevard.
