WHEREAS, Ruth R. & David Hindelang submitted an application for administrative relief under Sec. 9.5-122.3 of the Monroe County Land Development Regulations; and WHEREAS, the Monroe County Board of County Commissioners makes the following findings of fact and conclusions of law: 1. The application for administrative relief from Ruth R. & David Hindelang is for Lot 18, Block 8, Ocean Park Village Subdivision, Key Largo in Monroe County, Florida having RE# 00446750.000000. 2. The date of the ROGO application is 7/13/2004. 3. The ROGO allocation application has been in the ROGO system for at least four (4) consecutive years and qualifies for administrative relief under Policy 101.6.1 of the Monroe County Year 2010 Comprehensive Plan. 4. Monroe County Code (MCC) Section 9.5-122.3 provides a mechanism whereby an applicant who has not received an allocation award in ROGO may apply to the Board of County Commissioners for administrative relief. 5. The Board of County Commissioners (BOCC) has the authority to grant administrative relief under Section 9.5-122.3(f) and may grant the applicant a building allocation, offer to purchase the property at fair market value, or provide such other relief as may be necessary and appropriate. 6. The applicant applied for administrative relief on 7/18/2008, under Section 9.5-122.3 of the MCC and Policy 101.6.1 of the 2010 Comprehensive Plan. 7. Policy 10 1.6.5 of the 2010 Comprehensive Plan provides criteria to be used for determining lands that are appropriate for acquisition and the criteria includes the environmental sensitivity of the vegetative habitat on the lot and the applicable Tier designation. LEGAL ELIGIBILITY AND OPTIONS 2 3 Eligibility for Administrative Relief Options: 4 Section 9.5-122.3 of the Monroe County Land Development Regulations and Policy 101.6.1 of 5 the 2010 Comprehensive Plan provides a mechanism whereby an applicant who has not received 6 an allocation award in the ROGO system may apply to the Board of County Commissioners for 7 Administrative Relief. The applicant is eligible for Administrative Relief having complied with 8 all requirements of the dwelling unit allocation system and having been considered in at least the 9 first sixteen consecutive quarterly allocation periods~ and not having received an allocation 10 award. The application was timely submitted for administrative relief in the form of one (1) 11 ROGO allocation award and has not expressed a desire to sell the property to the County. 12 13 Additional Relevant Information: 14 15 The property consists of low quality hardwood hammock. Vegetative species diversity is 16 moderate at 16 native woody species, with threatened (barb-wire cactus) and regionally important 17 (black ironwood) species occurring on site. The County Protected Animal Species Map shows 18 the property as known habitat to one species and potential habitat to five species of animals, 19 Monroe County currently owns the six parcels immediately south of the subject parcel, as well as 20 more than 150 other parcels within the contiguous hammock area. 21 22 Relief Options under Administrative Relief: 23 The remedies available for Administrative Relief pursuant to Section 9.5-122.3 includes: 24 25 a. Offer to purchase the property at its fair market value as its preferred action if the 26 property is located within: a) a designated Tier I area; b) a designated Tier IT area 27 (Big Pine Key and No Name Key); c) a designated Tier ill-A area (Special 28 Protection Area); or d) a designated Tier ill area on a non-waterfront lot suitable 29 for affordable housing. 30 b. Grant the applicant an allocation award for all or a number of dwelling units 31 requested in the next succeeding quarterly allocation period or extended pro rata 32 over several succeeding quarterly allocation periods as the preferred action for 33 buildable properties not meeting any of the criteria in (1) above. 34 c. Suggest or provide such other relief as may be necessary and appropriate. 35 36 In the event purchase is recommended and the owner refuses the purchase offer, the 37 applicant may remain in the ROGO System and continue earning perseverance points 38 according to the vesting provision of Tier Ordinance 009-2007. 39 40 IV. "' ; J MEMORANDUM Date: 6 July 2004 To: Ralph Gouldy, Acting Director Environmental Resources From: Niko Reisinger, Biologist, Environmental Resonrces ~'L0 Re: Lot 18 Block 8 Ocean Park Village, Key Largo, for a single tanllly home for Mr.& Mrs. Hindelang, Application no. 04302533 ----------------------------------------------------------------- INTRODUCTION: Pursuant to your directive the above referenced parcel was reviewed as a habitat analysis, All parcels listed as 426 (Tropical Hardwood Hammock) on the existing conditions map require that a habitat analysis be performed and that an evaluation index (HEI) ~e computed. The subject parcel is of the low hammock variety. SITE AND PROJECT DESCRIPTION: The site in question was inspected with Alex Score assistinglbeing trained on June 30, 2004 and resulted in the following: The site is bordered on the north and south by vacant wooded land, the east by a paved roadway (Canal Street) and the west by a cleared yard lot. The parcel is vegetated with biota indicative of tropical hardwood hammock and the elevation indicates low hammock variety. The HEI was performed and submitted by Susan Sprunt for this lot, with the addition of 1 woody species, Darling Plum, and 2 herbs, Chaff flower and Milkpea Vine, I agree with her findings. The species diversity is moderate, consisting of 16woody species. There are 2 TIE/RI plants on the lot, Barbed Wire Cactus, and Black Ironwood, with a density of over six per acre calculated. The hammock could serve as habitat for several TIE animals, however none were seen by Susan, Alex or myself, and the site is not mapped habitat. I looked for Liguus tree snails, but saw none. There were several exotic species present including the invasive exotic pests Schinus, Leadtree and LatherleafVine. Less than 5% of the site was invaded. The size of the parcel is small, only 5000 square feet. The entire parcel appears relatively uniform in sensitivity. RECOMMENDATION: The hammock was rated as low in quality. The open space ratio is .40, which will allow 3000 square feet to be cleared, including the construction impact area of five feet width measured from the dripline or furthest extension of the house. A site preparation permit should be issued and the clearing and construction barriers field checked prior to validating the construction permit. All Schinus, Leadtree and LatherleafVine should be removed from the site, and the non-native African Orchid and Asparagus Fern must be removed from hammock preserve areas on the lot. A transplant plan must be submitted for TIE and Rare plants, as well as any trees 4" or greater that will be removed for construction. The cactus must actually be moved, since replacement plants are not available in nurseries. The conservation easement deed restriction on 2000 square feet must be recorded before the C. O. is issued. This deed restriction will prevent future owners from damaging the required open space areas, where native vegetation is to remain in its natural state forever. TIME EXPENDITURE: Not applicable, approximately 1.0 hours on site. 0<--\ ~ - :>...\~~ BABITA T ANALYSIS H.E.L Analysis For: 25 June 2004 Mr. & Mrs. Hindelang 200 Canal Street Tavernier, Florida 33070 Legal Description: Lot 18, Block 8 Ocean Park Village Subdivision Location: Canal Street Mile Marker 92.5/0cean-side Harry Harris Park /Key Largo Key, Florida Dear Mr. & Mrs. Hindelang: Enclosed is the completed habitat analysis, (H.E.!.), as required the Monroe County Comprehensive Plan. I have enclosed a photocopy from Volume m, Section 9.5-336 stating the purpose intended by Monroe County for conducting a habitat analysis. If you have any questions regarding this material, please contract myself or the County Biologist,:Ms. Nlko Reisinger (305) 852-7100. The majority of the existing hardwood hammock was below :five feet in elevation and therefore a Low Hammock analysis was conducted. The results of the analysis indicated that this site should be considered Low Ouality; Low Hammock. However, the Monroe County Biologist will review this analysis and may. incorporate hislher own opinion of the property into this report, thereby possibly affecting the final result. I have included a photocopy of Section 9.5-343 which indicates that the open space ratio for a low quality, high hanunock is .40. This allows for 60% of the hammock area to be cleared. However, if any threatened and/or endangered plant/animal species are found in the area to be cleared, they must be relocated to another site on the property. The exact area to be cleared (the limits of clearing) must be delineated in the field PRIOR to clearing. An inventory of all trees within this area to be cleared must be completed. Consult with the County Biologist for information on this requirement prior to clearing. Several plant and animal species relevant to this site need to be discussed. I would like to discuss the plant species first, then the animal species. Page 2 All plant species that are listed with "special status" with the State of Florida or Monroe County have been tagged in the field with pink tape and labeled. There was one species found listed as threatened by the State ofFlorida: barb-wire cactus (Acanthocereus tetragonus), and one species listed as regionally important by Monroe County, Florida: black ironwood (Krugiodendron ferrerum). I would like to briefly discuss each of these species. Three "pockets" of barb-wire cactus were found throughout the property (see Vegetation Site Plan). This species will relocate with good success if the transplantation plan is done with care. Attached to this report is a transplantation plan for this species. Please use this plan as a guideline when relocating the cactus. If you have any questions, please contact the County Biologist (305) 852-7100 for assistance. One black ironwood plant was found near the southern property line (see Vegetation Site Plan). The plant was approximately six feet in overall height and appeared to be in healthy condition. Due to the close proximity to the boundary line, it is likely this plant will be free of removal or damage during building construction. However, if it should become necessary to remove this plant, consult with the County Biologist for possible relocation requirements. In addition to plant species found on your property, there are several animal species that must be addressed. According to the Monroe County Endangered Species Range Maps, there are three endangered animal species that may be within the vicinity of this particular site. The species are as follows: 1. White-crowned Pigeon: Columba leucocephala 2. Eastern Indigo Snake: DJY111archon ~ couperi 3. Miami Black-headed Snake: Tantilla ooIitica I will discuss each species briefly and explain observations made during the analysis. There were several mature poisonwood trees found on the property. The fruit of the poisonwood tree is a major food source for the white-crowed pigeon. During the analysis no pigeons were seen on the site. However, it is likely that this property would serve as a food source for this species. Page 3 The eastern indigo snake is non-poisonous and has a gentle nature. I have enclosed a description of this particular snake at the end of this analysis. Please take time to read this section. Upon inspection of the site, I found no direct evidence of this snake. As for the Miami black-headed snake, inronnation on this species is limited both in the literature and in the field and no direct evidence was found of this species. Identification/Location All cactus to be relocated shoUld be identified and tagged in the field. If there is any question of identification, the C9unty Biologist or consultant involved should be contacted to verify. II.Preparation of Cactus for Relocation Barb-wire cactus grows in such a way that sections can be cut from the cactus and planted. Depending on the size of the plant invol-..ed, the cactus shoUld be cut ., with a sharp clippers into sections no smaller than 3' in lenghth. If roots are present on any part of the section there is a much better chance for survival of the cut cactus. Once cut, the sections should remain open to the air for at least 1 week to 10 days. This allows the cut ends to "callus over" or seal up. This sealing helps the cactus fight infections, pests, and dehydration. III.Transplantinq Once the sections have sealed they can be transplanted, ~ Sections that have roots present should be placed into the topsoil so the roots are totally covered. The sections that contain no roots should be placed into the soil with one of the "sealed" or cut ends first. The depth , the sections are planted into the existing soil depends on the site in question. Ideally 1"-3" is preferred. . , 2 - If no soil is available heavy leaf mold or possible mulch should be used to cover all roots and one of the sealed ends on the cut sections. Iv.Watering Upon transplanting the cactus should be watered heavily to ensure "soaking" of the surrounding area. Wait two weeks after the inital watering and then water once a day for 3 months. If it is during the rainy season, this schedule may fluctuate. Barb-wire cactus is relatively easy to transplant with good success. One of the most important elements is the sealing of the ends of the cut cactuS. I f the above steps are followed there should be a 70-80% survival . rate of the transplanted cactus. , . ......= -.
