WHEREAS, George Pyrpiris submitted an application for administrative relief under Sec. 9.5-122.3 of the Monroe County Land Development Regulations; and WHEREAS, the Monroe County Board of County Commissioners makes the following findings of fact and conclusions of law: 1. The application for administrative relief from George Pyrpiris is for Lots 43, 44, & 45 , Block 3, Harris Ocean Park Estates Subdivision, Key Largo in Monroe County, Florida having RE# 00448040.000000, 00448050.000000, & 00448060.000000. 2. The date of the ROGO application is 7/13/2004. 3. The ROGO allocation application has been in the ROGO system for at least four (4) consecutive years and qualifies for administrative relief under Policy 101.6.1 of the Monroe County Year 2010 Comprehensive Plan. 4. Monroe County Code (MCC) Section 9.5-122.3 provides a mechanism whereby an applicant who has not received an allocation award in ROGO may apply to the Board of County Commissioners for administrative relief. 5. The Board of County Commissioners (BOCC) has the authority to grant administrative relief under Section 9.5-122.3(f) and may grant the applicant a building allocation, offer to purchase the property at fair market value, or provide such other relief as may be necessary and appropriate. 6. The applicant applied for administrative relief on 7/21/2008, under Section 9.5-122.3 of the MCC and Policy 101.6.1 of the 2010 Comprehensive Plan. 7. Policy 101.6.5 of the 2010 Comprehensive Plan provides criteria to be used for determining lands that are appropriate for acquisition and the criteria includes the environmental sensitivity of the vegetative habitat on the lot and the applicable Tier designation. The application was timely submitted for administrative relief in the form of one (1) 17 ROGO allocation award and has not expressed a desire to sell the property to the County. 18 19 Additional Relevant Information: 20 21 The property consists of low quality hardwood hammock. The vegetative speicies diversity is 22 moderate, consisting of 23 native woody species, with endangered (Mahogany) and regionally 23 important (Inkwood) species included. The property was designated Tier 3A (Special Protection 24 Area) due to its connectivity to other Tier 3A properties and a large Tier 1 area of mostly 25 undisturbed hammock to the north. Monroe County and the State of Florida currently own more 26 than 80 parcels within the connected Tier 1 area. 27 28 Relief Options under Administrative Relief: 29 The remedies available for Administrative Reliefpursuant to Section 9.5-122.3 includes: 30 31 a. Offer to purchase the property at its fair market value as its preferred action if the 32 property is located within: a) a designated Tier I area; b) a designated Tier n area 33 (Big Pine Key and No Name Key); c) a designated Tier ill-A area (Special 34 Protection Area); or d) a designated Tier ill area on a non-waterfront lot suitable 35 for affordable housing. 36 b. Grant the applicant an allocation award for all or a number of dwelling units 37 requested in the next succeeding quarterly allocation period or extended pro rata 38 over several succeeding quarterly allocation periods as the preferred action for 39 buildable properties not meeting any of the criteria in (1) above. 40 c. " INTRODUCTION: Pursuant to your directive the above referenced parcel was reviewed as a habitat analysis. All parcels listed as 426 (Tropical Hardwood Hammock) on the existing conditions map require that a habitat analysis be performed and that an evaluation index (HEI) be computed. The subject parcel is of the high hammock variety. SITE AND PROJECT DESCRIPTION: The site in question was inspected on 12-1-2003 as a single lot, then again on 4-16-2004 as 3 lots and resulted in the following: The site is bordered on the south by a paved roadway, Pacific Avenue, the east by a cleared lot with a house, the west by a vacant wooded lot, and on the north lots 43 & 44 have cleared lots with houses and lot 45 has a vacant wooded lot adjacent. The parcel is vegetated with biota indicative of tropical hardwood hammock and the elevation indicates high hammock variety . The HEI was performed and submitted by Susan Sprunt for this lot, with the addition of 3 vine species and no change in points, I agree with her findings. The species diversity is moderate, consisting of23 native woody species. There are 2 TIE/RI plants on the lot, Inkwood and Mahogany, with a density of over six per acre calculated. The hammock could serve as habitat for several TIE animals, however none were seen by Susan or myself, and the site is not mapped habitat. I looked for pguus tree snails, but saw none. There was a large pile of vegetative debris on lot 43, obviously placed there by the neighbor to the rear. There were several exotic species present including the invasive exotic pest Schinus, as well as Pothos, African Orchid, Purple Oysterplant, Coconut Palm (seedling), Citrus and Umbrella Tree. Lot 45 was heavily infested with Schinus, representing about 7% of the total site in pests. The size of the parcel is moderate 16,000 square feet. Except for the large area of Schinus on lot 45, the entire parcel appears relatively uniform in sensitivity. RECOMMENDATION: The hammock was rated as low in quality. The open space ratio is .40 which will allow 9,600 square feet to be cleared, including the construction impact area of five feet width measured from the dripline or furthest extension of the house. A site preparation permit should be issued and the clearing and construction barriers field checked prior to validating the construction permit. All Schinus should be removed from the site, and the other non-natives removed from the hammock preserves on the lots. A transplant plan must be submitted for TIE and Rare plants, as well as any trees 4" or greater that will be removed for construction. The conservation easement deed restriction must be recorded on 6400 square feet before the C. O. is issued. lIDs deed restriction will prevent future owners from damaging the required open space areas, where native vegetation is to remain in its natural state forever. Dear Mr. Pyrpiris: Enclosed is the completed habitat analysis, (H.E.I.), as required the Monroe County Comprehensive Plan. I have enclosed a photocopy from Volume m, Section 9.5-336 stating the purpose intended by Monroe County for conducting a habitat analysis. If you have any questions regarding this material, please contract myself or the County Biologist, Ms. Ntko Reisinger (305) 852- 7100. The majority of the existing hardwood hammock was above five feet in elevation (see boundary survey) and therefore a High Hammock analysis was conducted. The results of the analysis indicated that this site should be considered Low Ouality~ Hi2'h Hammock. However, the Monroe County Biologist will review this analysis and may incorporate his/her own opinion of the property into this report, thereby possibly affecting the 1inaI result. I have included a photocopy of Section 9.5-343 which indicates that the open space ratio for a moderate quality, high hammock is .40. This allows for 60% of the hammock area to be cleared. However, if any threatened and/or endangered plant/animal species are found in the area to be cleared, they must be relocated to another site on the property or replaced. The exact area to be cleared (the limits of clearing) must be delineated in the field PRIOR to clearing. An inventory of all trees within this area to be cleared must be completed. Consult with the County Biologist forinfonnation on this requirement prior to clearing. All plant species that are listed with "special status" with the State of Florida or Monroe County have been tagged in the field with pink tape and labeled. Several plant and animal species relevant to this site need to be discussed. I would like to discuss the plant species first, then the animal species. . Page 2 . There was one species found listed as endangered by the State of Florida: mahogany (Swietenia mahagom), and one species found listed as regionally important by Monroe County, Florida: inkwood (Exothea paniculata). I would like to briefly discuss each of these species. One mahogany tree was found near the northwestern comer of the site (see Vegetation Site Plan). Due to the large size of this particular tree, it would likely not survive relocation. Consult the County Biologist if removal should become necessary. Five inkwood plants were found on Lots 43 & 44 (see Vegetation Site Plan). Due to the location of these plants the will likely need to be removed and/or relocated due to building construction. Consult with the County Biologist for replacement requirements. In addition to plant species found on your property, there are several animal species that must be ac:idressed. According to the Monroe County Endangered Species Range Maps, there are three endangered animal species that may be within the vicinity of this particular site. The species are as follows: 1. White-crowned Pigeon: Columba leucocephala 2. Eastern Indigo Snake: DI)'lI1archon corais couperi 3. Miami Black-headed Snake: Tantilla oolitica I will discuss each species briefly and explain observations made during the analysis. There were several mature poisonwood trees found on the property. The fruit of the poisonwood tree is a major food source for the white-crowed pigeon. During the analysis no pigeons were seen on the site. However, it is likely that this property would serve as a food source for this species. The eastern indigo snake is non-poisonous and has a gentle nature. I have enclosed a description of this particular snake at the end of this analysis. Please take time to read this section. Upon inspection of the site, I found no direct evidence of this snake. As for the Miami black-headed snake, information on this species is limited both in the literature and in the field and no direct evidence was found of this species. A site visit was conducted on 26 June 2004 on the above referenced property. The area to be cleared was flagged in the field with wooden stakes and continuous white cotton string with orange flagging tape on the string and each wooden stake. An inventory of all trees over four inches in diameter at breast height (< 4" dbh) and/or all plants listed with special status was conducted within property boundary limits. Please refer to Attachment 1 for the inventory list of all of this area. Based on the Inventory list of trees within the area to be cleared, (see Attachment 1), there was one species found that generally will relocate with good success: gumbo limbo (Bursera simaroha). We are of the opinion that the remaining trees to be removed would likely not survive relocation and therefore should be replaced. Replacement Requirements The Monroe County Code requires replacement of all species removed from the site four inches or greater in diameter at breast height (4" dbh) or listed with special status. The ratio for replacement is as follows: * Two replacement plants for every one taken out if replacing the plant material ON-SITE. * Three replacement plants for every one taken out if replacing the plant material OFF-SITE. Transplantation Method There were four (4) gumbo limbo (Bursera simaruha) trees found in the area to be cleared that could be relocated with good success. The following description should be used as a guide when transplanting the tree. J 02 Mohawk Street, Tavernier, Florida 33070 ~ Telephone: 305.852.1920 sorunts@aol.com electronic mail Page 2 Tree Preparation The trees should be labeled and marked in the field for identification and carefully avoided when removing the surrounding vegetation, or when possible, remove these trees prior to clearing. When access to the tree is possible with large equipment, i.e. front-end loader, the tree should be removed from the area of construction. Tree Removal The tree canopy (top) should be pruned with a chain-saw approximately 1/3 of the overall growth. The tree should then be "rigged" with rope using the front-end loader to allow the main trunk to be "Jifted" or suspended in air once the base has been cut. Depending on the size of the tree, the trunk should be wrapped with a cloth before the rope is applied to avoid the rope "scarring or tearing" the tree trunk. The base of the trunk should then cut as close to the ground surface as possible. The tree is then ,lifted out of the area of construction and laid down (carefully) out of the way of all vehicles and/or potential damage. The base of the trunk should then be "scored" to a depth of one inch to promote root growth and regeneration. Schedule Week One The tree should be allowed to "heal" for at least three days (depending on the weather) until the base has "sealed" with sap. The site in which the tree is to be replanted should be prepared by auger and/or digging a hole approximately twice the diameter of the trunk and twice the depth of planting. See Attachment 2 for location of planting. The planting soil to be used should be of high quality (not lime-rock fill) and'be mixed with fertilizer (6-6-6) to the specified ratio described by the fertilizer company. The hole for the transplanting should then be filled 1/3 with the pre-prepared planting soil as described above. Plant the tree and backfill the remaining hole with soil. Stake and guy the tree as necessary. Immediately water the area until the soil is saturated (water on surface for extended period of time). Cover the entire area planted with at least three inches of mulch. Pull all mulch two-three inches (2- 3 ") away from the trunk creating a "ring" around the main trunk. . Page 3 WateringIMaintenance The tree( s) should be watered until the point of saturation once a day for three weeks (depending on the weather). Then every three days for an additional four weeks. Finally once a week for an additional four weeks. This will vary depending on the weather and site conditions. The likelihood of the gumbo limbo trees surviving transplantation is very good if the relocation is done with care. There have been many examples of gumbo limbo trees relocating with one hundred percent (100%) success! However, if the trees should not survive, the County Biologist will insist the species is replanted onto the site utilizing nursery grown stock. As for the barb-wire cactus, the attached Transplantation Plan should be sufficient in assisting you in moving the cactus to another location on the property.
