AGENDA ITEM WORDING: Discussion of ROGO allocation permitting policy to provide some
flexibility to property owners due to current nationai banking Industry issues in obtaining
construction loans.
ITEM BACKGROUND: CurreDt DermittiD2 Dolicv summary: Wben a ROGO allocation is granted,
tbe applicant is given 60 days from tbe date of Dotiflcation to bave tbe permit issued, tben tbe permit is
valid for 180 days or until tbe first Inspection, wbicb reDews tbe permit for anotber 180 days or until tbe
next inspection. The permit can remain active indefinitely as long as work continues and required
inspections are completed wltbin subsequent 180 day time frames until tbe structure receives a
Certificate of Occupancy (CO). A one-time 180 day extension is allowed if required to complete
inspections for CO, etc. Tbe construction process can be continued in tbis manner for several years to
completion.
Property owners currently receiving ROGO allocations are being faced with an unforeseen
problem due to tbe state of tbe national economy, and several applicants bave reported being unable to
secure construction loaDS to begin tbe construction process. Tbe national banking industry is not
currently Inclined to make loans for bome construction or purcbase in the current economic situatloD.
Tbe current permitting policy would require going back tbrough tbe lengtby ROGO process to earn a
new allocation if tbe permit was forfeited for any reason.

Little has changed in demand since 1992. We currently have over 600 applicants waiting on an allocation. Many of these
applicants would gladly accept an allocation forfeited by an applicant who is unable to proceed \lVhile I empathize with this
applicant's cirrllmstanc€', I rannot rec.ommend we alter the deadline::; due to the dissatisfaction it would calise in the
applic.ant pool. Unfortunately there is not an eas)' answer to this problem. Please let me know if you have additional

Subject: My building permit
Dear Mr. Di Gennaro,
I've owned a lot in the Keys for 30 years and about six years ago applied for a building
permit. Of course ROGO was in effect so I've had to comply with that which has taken as
you know quite a bit of time. Six years. At any rate I just received notice that my permit is
ready for pickup. Only problem is I've got to begin construction within 180 days and
considering the present state of the economy, I can't afford it. It doesn't seem fair that the
same county who has taken so long in issuing me my permit would be so uncompromising
in tolling the period in which 1 have to begin construction. Loans just aren't available. To
wait six years before issuing the permit until we're in the worst economic meltdown in our
country's history, then mandate that construction start within 180 days despite the
unavailability ofloans, doesn't seem fair. Isn't there something you and the other
commissioners can do about this? Times are hard. I'd appreciate your help.
