ITEM BACKGROUND: FDOT is finalizing engineering design plans for project FM 446005-1, which involves repairs to sections of US 1 on the 18-mile stretch from MM 108.4 to MM 112.8. The proposed Maintenance of Traffic (MOT)plan for the project includes temporary nighttime closures of US 1 and diversion of traffic onto Card Sound Road in order for repairs to be completed more expeditiously. During the time that the traffic is diverted the County would need to suspend toll collection on Card Sound Road. The details of how FDOT will reimburse the County for lost revenue are being discussed with staff and will be finalized in a resolution at a future meeting; a draft resolution is attached for information only. FDOT is seeking concurrence with the proposed plan to divert traffic to Card Sound Road at this time in order to be able to advertise for construction bids using a Maintenance of Traffic plan that incorporates the closures. The project will be awarded in 2024 and is scheduled for 450 days. The work that will necessitate diversion to Card Sound Road is later in the project. It is anticipated that diversion of traffic to Card Sound Road will be for approximately 40 days. WHEREAS, The Department is authorized under Section 335.15 (1), Florida Statutes, and Section 3 3 9.28 18, Florida Statutes to enter into this Agreement. WHEREAS, The Florida Department of Transportation (FDOT) is authorized to enter into agreements to facilitate construction and improvement projects; WHEREAS, A construction project is planned for SR 5/US 1/Overseas Highway from Mile Marker (MM) 108.4 to MM 112.8, identified as Financial Project Number 446005-1-52-01; WHEREAS, The construction project entails milling, resurfacing, pavement reconstruction at select locations to address base failure, guardrail upgrades, and signing and pavement marking refurbishment; WHEREAS, The construction activities necessitate a detour of US 1 traffic onto Card Sound Road during nighttime hours (8:00 PM to 6:00 AM) for approximately 40 nights; WHEREAS, The detour plan is utilized to ensure the safety of workers and commuters, expedite the construction process, and minimize disruptions during daytime hours; WHEREAS, Toll suspension is requested during the detour implementation to facilitate smooth traffic flow and equitable access for affected commuters; WHEREAS, The DEPARTMENT has agreed to reimburse the COUNTY for the loss of revenue due to toll suspension; WHEREAS, The revenue loss is determined through the utilization of data collected at the electronic tolling site over a standard nighttime operational period of six weeks (prior to detour implementation); and WHEREAS, The tolling rates employed for the reimbursement calculation will correspond with the toll schedule in effect during the detour. The Detour Agreement between Monroe County and the Florida Department of Transportation for the construction project on SR 5/US 1/Overseas Highway from MM 108.4 to MM 112.8 (FM 446005-1-52-01) is hereby approved. 2. The detour shall be in effect during nighttime hours, from 8:00 PM to 6:00 AM, for approximately 40 nights, as required to facilitate construction activities. SECTION 2: Toll Suspension 1. Toll collection on Card Sound Road shall be temporarily suspended during the designated detour hours to ensure efficient traffic flow. 2. Toll suspension is a crucial component of the detour plan to minimize congestion and provide equitable access to affected commuters. SECTION 3: Toll Reimbursement 1. The DEPARTMENT has agreed to reimburse the COUNTY for the loss of revenue due to toll suspension. 2. The revenue loss is determined through the utilization of data collected at the electronic tolling site over a standard nighttime operational period of six weeks (prior to detour implementation); and 3. The tolling rates employed for the reimbursement calculation will correspond with the toll schedule in effect during the detour. SECTION 4: Implementation and Communication 1. The Florida Department of Transportation shall coordinate with relevant stakeholders, including local law enforcement and emergency services, to ensure safe detour implementation. 2. Monroe County and the Florida Department of Transportation shall collaborate to disseminate accurate information about the detour plan, schedule, and potential impacts to the local community through various communication channels.
