AGENDA ITEM WORDING:
Approval of the Second Amendment to the Interlocal Agreement between the Monroe County Board of
County Commissioners and the Monroe County Office of Sheriff (MCSO) for Consolidation and
Management of Emergency Communications, for the purpose of extending the term of the Agreement
through February 21, 2032; also,providing for the disbursement of annual recurring revenues to MCSO
by the Office of Clerk and Comptroller on a monthly basis within 30 days of receipt thereof and
providing for the distribution of grant funds awarded by the State of Florida pursuant to Subsection
365.172(6), Florida Statutes directly to MCSO by the Office of Clerk and Comptroller at the earliest
possible opportunity after receipt with notification thereof to the County Administrator and County
Attorney.
ITEM BACKGROUND:
The Interlocal Agreement between the Monroe County Board of County Commissioners and the Office
of Monroe County Sheriff for the Consolidation and Management of Emergency Communication
Services has operated since its execution by the parties on February 21, 2007. On March 21, 2012, the
parties executed the First Amendment to the Interlocal Agreement between the Monroe County Board
of County Commissioners and the Monroe County Office of Sheriff(MCSO) for Consolidation and
Management of Emergency Communications to extend the term thereof for an additional ten years.
During the duration of the Interlocal Agreement and the First Amendment thereto, the Agreement has
worked well. This Second Amendment of the Interlocal Agreement will extend the term of the
Interlocal Agreement for an additional ten years and modify the method by which recurring state
revenues and grant funds are disbursed to the Office of Monroe County Sheriff.
PREVIOUS RELEVANT BOCC ACTION:
2-21-2007: BOCC approved the Interlocal Agreement between the Monroe County Board of County
Commissioners and the Office of Monroe County Sheriff for the Consolidation and Management of
Emergency Communication Services.

3-21-2012: BOCC approved First Amendment to the Interlocal Agreement between the Monroe
County Board of County Commissioners and the Office of Monroe County Sheriff for the
Consolidation and Management of Emergency Communication Services extending the term for an
additional ten years.
CONTRACT/AGREEMENT CHANGES:
Extends term of agreement by ten(10)years; also modifies method by which recurring state revenues
and grant funds are disbursed to MCSO.

AMENDMENT 2
TO INTERLOCAL AGREEMENT BETWEEN MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS AND MONROE COUNTY SHERIFF'S OFFICE FOR
CONSOLIDATION AND MANAGEMENT OF EMERGENCY COMMUNICATIONS
This SECOND AMENDMENT is entered into on the day of
2023, to the Interlocal Agreement by and between Monroe County Board of County
Commissioners (COUNTY) and Monroe County Sheriff's Office (MCSO) for Consolidation and
Management of Emergency Communications ("ILA") dated February 21, 2007; and
WHEREAS, the COUNTY and MCSO recognize that emergency communications are
essential to the public safety and welfare of the people of Monroe County; and
WHEREAS, the COUNTY states that the ILA serves the public purpose of providing
better coordination of 911 services for law enforcement, residents and all uses; and
WHEREAS,the goal of COUNTY and MCSO is to continue to maintain and enhance 911
and emergency communications service throughout the County; and
WHEREAS, MCSO currently maintains and operates Monroe County's communications
systems and equipment under the ILA; and
WHEREAS, the COUNTY and its residents and visitors have been well served by the
ILA; and
WHEREAS, the COUNTY wishes to amend the ILA to extend it for a longer period of
time and to clarify certain provisions.
NOW THEREFORE, in consideration of mutual promises, covenants, conditions and
agreements stated herein, and for other good and valuable consideration, the sufficiency of which
is hereby acknowledged, the parties hereby further agree as follows:
1. Paragraph 1 [TERM] of the ILA is amended to read as follows:
TERM
The ILA shall continue in effect and shall be extended for an additional term of Ten
(10)years retroactive to February 21, 2022, and ending February 21, 2032.
2. Subparagraph 3(A) [FUNDING] of the ILA shall be amended to read as follows:
COUNTY retains exclusive authority to impose rates, to determine the rates, to
collect and to disburse 911 funds received under Section 365.171, Florida Statutes.
The "911" fees pursuant to Section 365.171, Florida Statutes, Section 365.172,
Florida Statutes and Section 365.173, Florida Statutes shall be administered by the
MCSO as set forth in statute and in accordance with this Agreement.

Subsequent transfers of the annual recurring revenues shall be undertaken on a
monthly basis following the receipt by the Monroe County Office of Clerk and
Comptroller(Clerk)of an invoice from MCSO.MCSO will provide a report listing
the expenditures made by MCSO to the County on a quarterly basis.
3. Paragraph 3 [FUNDING] of the ILA, shall be amended to add the following section:
E. Grant money awarded by the State of Florida, pursuant to Section
365.172(6), Florida Statutes shall be distributed by the Clerk of the Court directly
to MCSO at the earliest possible opportunity after receipt of the funds. Written
notification of such distribution shall be given to the County Administrator and
County Attorney. Such notification may be made by email, courier or regular mail,
whichever would cause the least delay in disbursement. MCSO shall use the
funding exclusively for items as listed under the specific terms of the grant and
shall hold the COUNTY harmless for any unauthorized use of funding.
The remaining terms of the ILA not inconsistent herewith, shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this Amendment. This
Amendment will take effect upon passage by the Monroe County Board of County Commissioners
and execution by both parties.
