11 A RESOLUTION BY THE MONROE COUNTY BOARD OF
12 COUNTY COMMISSIONERS APPROVING AN
13 INVENTORY OF MONROE COUNTY COMPREHENSIVE
14 PLAN LAND AUTHORITY -OWNED REAL PROPERTY IN
15 ADDITION TO THE MONROE COUNTY -OWNED REAL
16 PROPERTY IDENTIFIED IN 2021 IN RESOLUTION 161-
17 2021, WHICH MAY BE APPROPRIATE FOR AFFORDABLE
18 HOUSING, IN ACCORDANCE WITH FLORIDA STATUTE
19 § 125.379.

22 WHEREAS, Florida Statute § 125.379 required every county in Florida to prepare an
23 inventory list of all real property within its jurisdiction to which the county holds fee simple title
24 that is appropriate for use as affordable housing, beginning July 1, 2007, and every 3 years
25 thereafter; and
26
27 WHEREAS, the Monroe County Board of County Commissioners ("BOCC", "Monroe
28 County", or the "County"), adopted Resolution No. 299-2007, approving an inventory of county-
29 owned real property which may be appropriate for affordable housing on August 15, 2007; and
30
31 WHEREAS, the BOCC adopted Resolution No. 404-2015, approving an inventory of
32 county -owned real property which may be appropriate for affordable housing on December 9,
33 2015; and
34
35 WHEREAS, the BOCC adopted Resolution No. 161-2021, approving an inventory of
36 county -owned real property which may be appropriate for affordable housing on April 21, 2021;
37 and
38 WHEREAS, the Florida Legislature changed Florida Statute § 125.379 effective July 1,
39 2023 and required any dependent special district within the County's boundaries to prepare an
40 inventory list of all real property within county jurisdiction appropriate for use as affordable
41 housing; and
42
43 WHEREAS, the properties identified as appropriate for use as affordable housing on the
44 inventory list adopted by the county may be used for affordable housing through a long-term land
45 lease requiring the development and maintenance of affordable housing, offered for sale and the
46 proceeds used to purchase land for the development of affordable housing or to increase the local

47 government fund earmarked for affordable housing, or may be sold with a restriction that requires
48 the development of the property as permanent affordable housing, or may be donated to nonprofit
49 housing organization for the construction of permanent affordable housing. Alternatively, the
50 county or special district may otherwise make the property available for use for the production and
51 preservation of permanent affordable housing; and

53 WHEREAS, for the purposes of this statutory requirement, the term "affordable" as
54 defined in Florida Statute § 420.0004(3), shall mean that monthly rents or monthly mortgage
55 payments including taxes, insurance, and utilities do not exceed 30 percent of that amount which
56 represents the percentage of the median adjusted gross annual income for the households as
57 referenced in Florida Statute § 420.0004(9) ("Extremely -low-income persons"), Florida Statute §
58 420.0004(11) ("Low-income persons"), Florida Statute § 420.0004(12) ("Moderate -income
59 persons"), or Florida Statute § 420.0004(17) ("Very -low income persons"); and
60
61 WHEREAS, the governing body of the county must review the inventory list at a public
62 hearing and adopt a resolution that includes an inventory list of such property following the public
63 hearing; and
64
65 WHEREAS, in accordance with Florida Statute § 125.379, the Monroe County Board of
66 County Commissioners shall hold a public hearing on September 20, 2023, to review and revise
67 the subject inventory;

69 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
70 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

72 Section 1. Recitals and Legislative Intent. The foregoing recitals and statements of
73 legislative intent are true and correct and are hereby incorporated as if fully stated
74 herein.

76 Section 2. The Board of County Commissioners adopted the inventory of real property within
77 its jurisdiction to which the county holds fee simple title that is appropriate for use
78 as affordable housing in Resolution 167-2021, the list of which is attached hereto
79 as Exhibit A, on April 21, 2021.

81 Section 3. The Board of County Commissioners adopted the inventory of real property within
82 its jurisdiction to which the Monroe County Comprehensive Plan Land Authority
83 holds fee simple title that is appropriate for use as affordable housing, attached as
84 Exhibit B on September 20, 2023.

86 Section 4. Both lists attached hereto are required to be posted on the County website.
