This First Amendment adds surveying and geotechnical services to the scope of work. This project is funded by the One-Cent Infrastructure Sales Tax (Fund 304). ITEM BACKGROUND: The Monroe County Detention Center on Stock Island currently houses two generators that are nearing the end of their useable life. The cost to remove the existing generators is cost prohibitive as a result of the specialty equipment required. The cost to build a new structure is marginally more expensive than the cost to simply replace the generators and provides the county with approximately 6,000 sf of newly constructed space. The new structure will allow for affordable maintenance and replacement of generators in the future. The design of the new building addition is nearly complete and this First Amendment adds surveying and geotechnical services to the scope of work as required by the City of Key West Building Department in order for the County to receive it's building permit. FOR MCDC GENERATOR BUILDING ADDITION In accordance with the Consultant Agreement for Professional Architectural and Engineering Services, made and entered into on December 19, 2018 between MONROE COUNTY, ("County") and WILLIAM HORN ARCHITECT P.A., ("Consultant"), where professional services are allowed if construction costs do not exceed $4,000,000.00, or for study activity if the fee for professional services for each individual study under the contract does not exceed $500,000.00 ("Agreement"), as provided in Subsection 287.055(2)(g), Florida Statutes, as amended by Section 2, Chapter 2020-127, Laws of Florida, pursuant to which Attachment A, Subsection 1.01 of the Agreement is hereby modified,the parties enter into this First Amendment to the Task Order. All terms and conditions of the Agreement apply to this First Amendment, unless this First Amendment amends, adds, or modifies a provision or an Article of the Agreement of which will be specifically referenced in this First Amendment and the amendment, addition, or modification shall be precisely described. This First Amendment is effective on the 18th day of October 2023. WHEREAS, the Parties executed a Task Order on December 8, 2021, for design services for construction of a new generator building at the Monroe County Detention Center on Stock Island; and WHEREAS, surveying and geotechnical services are required in order to receive a permit from the City of Key West for construction. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the parties agree as follows: 1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Agreement, the Consultant will utilize subconsultants to perform surveying and geotechnical services. Services shall include: • Surveying Services — Spot level elevations shall be taken to define the grade changes in detail in the area of the proposed generator building. Signed and sealed survey shall be provided. • Geotechnical Services — Two (2) Standard Penetration Test (SPT) borings to a depth of 30 feet shall be taken in the area of the proposed generator building. Engineering Report including description of findings, general site preparation recommendations, foundation design recommendations, graphic logs of the test borings, and test boring location plan shall be provided. In accordance with Article VII paragraph 7.1.1 of the Agreement,the County shall pay the Consultant a not-to-exceed total of Nine-Thousand Six-Hundred Eighty-Five and 00/100 dollars($9,685.00)paid on a percent complete basis for the following phases: a. Surveying Services - $5,185.00 lump sum upon receipt of signed and sealed survey and approval by the Director of Project Management b. Geotechnical Services - $4,500.00 lump sum upon receipt of engineering report and approval by the Director of Project Management The total contract cost including the original Task Order and this First Amendment is a not-to- exceed amount of Three Hundred Forty-One Thousand Two-Hundred Fifty-Five and 00/100 ($341,255.00). All other Terms and Conditions of the Agreement and Task Order remain unchanged and in full forces and effect. Both the first and second raised levels will be approximately 28 ft x 35 ft (3,000 sf) each of enclosed air-conditioned space to house the two(2)generators and also provide an electrical/mechanical room.
