9 A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY
10 COMMISSIONERS RESCINDING RESOLUTION NO. 200-2022; AND
Ll APPROVING THE RESERVATION OF TWO (2) MODERATE INCOME
12 AFFORDABLE ROGO ALLOCATIONS FOR AFFORDABLE HOUSING
13 DWELLING UNITS ON LITTLE TORCH KEY FOR HABITAT FOR
14 HUMANITY OF KEY WEST AND LOWER KEYS ON PROPERTY
15 DESCRIBED AS LOTS 8 AND 9, BLOCK 1, AMENDED PLAT LADIES
16 ACRES, LITTLE TORCH KEY, HAVING PROPERTY IDENTIFICATION
17 NUMBER 00222830-000000 UNTIL OCTOBER 18,2028.

19 WHEREAS,the State of Florida and all local governments in the Florida Keys(each subject to Area
20 of Critical State Concern mandates relating to housing affordability)recognize the need for affordable housing
21 throughout the state and particularly in the Florida Keys where developable land for housing is extremely
22 limited and expensive; and
23
24 WHEREAS, the challenge of providing affordable housing opportunities in the Florida Keys is one
25 requiring sensible and responsive use of residential unit allocations, including implementation of long-term
26 preservation mechanisms; and
27
28 WHEREAS,due consideration should be given to relevant factors such as the capacity for allocation
29 recipients to promptly transform allocation awards/reservations into finished and occupied
30 affordable/workforce housing units; and
31
32 WHEREAS,the developers have legitimate needs for some assurance that allocations are in fact and
33 will remain available and/or justified for a reasonable time so that follow-through on initial commitments will
34 in fact be justified; and
35
36 WHEREAS, the reservation of affordable housing allocations for the anticipated project, does not
37 exempt the project from applicable requirements for the Monroe County Land Development Regulations,
38 Building Code and other regulatory requirements; and
39
40 WHEREAS, on July 20 2022, the Monroe County BOCC adopted Resolution 200-2022, approving
41 the reservation of two(2)moderate income affordable ROGO allocations for affordable housing dwelling units
42 on Little Torch Key for Monroe County to develop affordable housing dwelling units on property described as
43 Lots 8 and 9, Block 1, Amended Plat Ladies Acres, Little Torch Key,having Property Identification Number
44 00222830-000000 until July 20, 2027; and
45
46 WHEREAS,the Monroe County Comprehensive Plan Land Authority(MCLA)now plans to convey
47 the property to Monroe County BOCC, with the intent that the County will lease the property to Habitat for
48 Humanity of Key West and Lower Keys for construction of two affordable housing units; and

1 WHEREAS, the property currently has one (1) market rate ROGO Exemption, which is to be
2 transferred at a later date to a different property, or moved to the Administrative Relief pool for market rate
3 allocations;and
4
5 WHEREAS, Habitat shall obtain all required approvals from the Monroe County Planning &
6 Environmental Resources Department for the project; and
7
8 WHEREAS, Habitat shall obtain permits for the affordable housing dwelling units by October 18,
9 2028; if the permit(s)is not issued,the allocations will revert to the County;

11 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
12 COMMISSIONERS OF MONROE COUNTY,FLORIDA:

14 Section 1: Monroe County BOCC Resolution 200-2022 is hereby rescinded.

16 Section 2: The Monroe County Planning Department shall reserve two (2) affordable ROGO
17 allocations, consisting of two (2) moderate income category allocations, for Habitat For Humanity of Key
18 West and Lower Keys,for Lots 8&9, Block 1,Amended Plat Ladies Acre,Little Torch Key,having Property
19 Identification Number 00222830-000000 until October 18,2028.

21 Section 3: The developer must obtain the building permits for the two(2)affordable housing on
22 or before October 18,2028.

24 Section 4: The developer shall comply with all Monroe County requirements, all applicable
25 Building Code requirements,and any other oversight agencies.
26
27 Section 5: The Planning and Building Department Staff is hereby authorized to process
28 expeditiously permit related applications for the above referenced project when received.

30 Section 6: This resolution shall not become effective until execution and recording of a ground
31 lease to Habitat for Humanity of Key West and Lower Keys for construction of affordable housing.

33 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida at a
34 regular meeting held on the 18th day of October 2023.
