American Rescue Plan Act Funding (ARPA)will be utilized for these upgrades in the anticipated amount of$319,627.33. ITEM BACKGROUND: Siemens Industry, Inc. (Siemens), as a sole source provider, provides for the testing, certification, and maintenance of the fire alarm system, building automation system, and smoke control system of the Corrections' facilities and other County owned buildings under a contract approved by the Board on April 20, 2022. Siemens provides its services on the new Desigo systems which were installed under a May 2020 Siemens' Agreement. The Sole Source Agreement has an initial term of three (3) years which commenced on October 1, 2021, and terminates on September 30, 2024, with three (3) optional one-year renewals. The contract amount for the first year for the testing, certification, and maintenance services was $239,000.00, plus repairs. The Agreement provides for an annual price adjustment which shall be the annual CPI-U of the previous year as of December 31 or a 5.5% increase, whichever is lower. On October 19, 2022, the BOCC approved a First Amendment for an increase of 5.5%, which was less than the CPI-U of 7% on December 31, 2022. The contract amount for the second year of services shall be $252,145.00, plus repairs, with this price increase as of October 1, 2022. The First Amendment also updated one Federal contract provision by including an Energy Efficiency clause. On September 20, 2023, the BOCC approved a Second Amendment increasing the contract amount by 5.5%. Certain Monroe County facilities need the automation system Controls upgraded to eliminate numerous ongoing issues that have been occurring since certain systems are not compatible in their current configuration with the new Siemens system. In this agenda item, Staff is requesting approval of a Proposed Project to allow Siemens, as the Sole Source provider for Building Automation, to make some 1000 additional equipment upgrades. Siemens has provided a Controls Upgrade Proposal for equipment at the Monroe County Detention Center in Key West as shown in the attached Proposal. It is anticipated that the upgrades for the Project Proposal will be an expenditure in the amount of$319,627.33. The current Agreement does not have a provision allowing for such an expenditure without BOCC approval. Funding has become available for these upgrades from the American Rescue Plan Act Funds (ARPA- 06068). PREVIOUS RELEVANT BOCC ACTION: September 20, 2023 BOCC approved a Third Amendment to Agreement with Siemens increasing contract payment amounts by a CPI-U increase of 5.5%. March 22, 2023 BOCC approved a Second Amendment, to perform under its current contract to provide Control Upgrades on certain equipment at Jackson Square and Key West Library and to update contract provisions to comply with Federal, State or County contract provisions as well as the ARPA Funding Agreement. American Rescue Plan Act Funding (ARPA)will be utilized for these upgrades. October 19, 2022 BOCC approved a First Amendment to Agreement for an increase of five and five-tenths percent (5.5%), which is less than the aforementioned CPI-U of 7%. The contract amount for the second year for the testing, certification, and maintenance services shall be $252,145.00, plus repairs, with this price increase retroactive to October 1, 2022. April 20, 2022 BOCC approved a negotiated Agreement with Siemens Industry, Inc. as a Sole Source provider for testing, certification, and maintenance of Fire Alarm, Smoke Control, and Building Automation Systems on Monroe County facilities. April 21, 2021 BOCC approved a month-to-month renewal agreement with Siemens Industry, Inc. pending negotiations to take place with Siemens until a satisfactory Sole Source agreement was achieved and then for it to be approved by the BOCC. March 17, 2021 BOCC approved a request for a waiver of the Monroe County Purchasing Policy provisions to designate Siemens Industry, Inc. as a Sole Source Provider so that the expiring Contract with Siemens Industry, Inc. could be negotiated and renewed as a sole source contract. May 20, 2020 BOCC approved the replacement of the existing, no longer supported Environmental Building Management Systems (EBMS) with a Desigo Enterprise BMS for the amount of $237,583.06 allowing the County to monitor additional sites remotely and locally in a unified system. This replaces obsolete systems in critical facilities. Upon acceptance of this proposal, Siemens will assign a dedicated project manager who will be your main point of contact for the duration on this project. A project schedule was not available at the time of the bid and so this scope is based on an assumed project duration time of approximately 220 days. • Siemens will provide shop drawings that indicate the devices listed in plans specified. • Siemens will provide parts and technical labor as detailed below for the fire alarm system at this facility. • Siemens will update the Firmware/hardware on the CPU to the latest Desigo Modular • Siemens will replace the loop controller cards to latest XDLC loop controllers • Siemens will replace initiating field devices • Siemens will set the addresses of initiating devices prior to installation. • Siemens will provide labor to certify the functionality of the devices after job is completed. • Siemens will provide tech labor for AHJ final acceptance test (Not to exceed 10 days = 80 hours) Page 4 of 13 1006 SIEMENS Exceptions and/or Clarifications: • Siemens is not responsible for the design of this project.
