ITEM BACKGROUND: On September 1, 2023, the U.S. Government Naval Facilities Engineering Systems Command Southeast ("U.S. Navy") submitted a Right-of-Way Abandonment Application requesting the abandonment of a portion of Boca Chica Road ("Rd.") at the end of the Naval Air Station Key West ("NASKW") southeast runway. See depiction of proposed abandonment area attached, indicated in red. This request is made due to NASKW security issues and to maintain the right-of-way to U.S. Navy standards for protection to the runway. The following issues require discussion and direction: • The area requested for abandonment is used by the public for enjoyment and beach access. • The BOCC has begun repairs to the subject section of roadway of damages received by Hurricane Ian and Hurricane Irma. The repairs are funded through a FEMA Grant Agreement, which will be reimbursed upon completion. If the roadway is abandoned and the scope of work not completed, the BOCC (Monroe County)will not be eligible for reimbursement of the funds already spent. • NASKW has a continuous security issue with trespassers, obtaining title to the roadway will allow NASKW to adequately protect vulnerable areas. • The southeast runway is susceptible to storm surge. Acquiring the roadway will allow NASKW to construct shoreline hardening structures to meet standards for protection of the runway. • NASKW cannot make improvements to the roadway until they obtain ownership. It should be noted that NASKW intends to continue to allow public use of the roadway and access to the beach.
