AGENDA ITEM WORDING: A Public Hearing to consider an Ordinance amending Monroe County
Parks and Beaches Summer Camp Ordinance No. 007-2023, changing all summer camp references to
School Break Camp Program. Also, expanding days of camp offerings to include all designated Monroe
County School District breaks and allowing daily fees to be charged as well as weekly fees.
ITEM BACKGROUND:
A main goal of the Parks & Beaches department is to provide high quality recreation programs at low
cost throughout the Keys community. Staff created a summer camp program in early 2023. Staff has
identified a need to expand programs for children and youth in the community beyond summer breaks
and to include other Monroe County School District breaks.
The ordinance currently limits the department offering camps during the summer school break. Staff
proposes an ordinance change reflecting the expansion to Monroe County School District designated
breaks other than summer vacation time. Staff is also proposing allowing daily fees to be charged along
with the weekly fees.
PREVIOUS RELEVANT BOCC ACTION:
6/21/23: MC BOCC held a public hearing and approved the ordinance amending Chapter 18, Parks and
Recreation, of the Monroe County Code, to allow a broader age group to attend the summer camp
program.
5/17/23: MC BOCC held a public hearing and approved the ordinance amending Chapter 18, Parks and
Recreation, of the Monroe County Code, to create a Monroe County Summer Camp program; and allow
fees to be charged for summer camp recreational services.
4/19/23: MC BOCC granted approval to advertise a Public Hearing to consider adoption of an
Ordinance regarding Monroe County Parks and Beaches Summer Camp Program.

Summary of Proposed Ordinance and Statement of Public Purpose to be Served:
The proposed ordinance amends MCC Sec. 18-7 in order to expand Monroe County's current
summer program to include all Monroe County School District breaks. The School Break
programs would be available to youth residing within Monroe County. Currently, the
ordinance allows for A Summer Camp which operates during the months of June,July, and
August. The cost is $100.00 per child per week with the cost of each additional sibling being
$50.00 per child.
The proposed ordinance amendment would allow for Monroe County Parks and Beaches to
expand from only offering summer camps to allow school break programming during school
breaks as designated by Monroe County School District. This will allow Monroe County Parks
and Beaches to provide more recreational opportunities to youth within the county.
Additionally, based on the needs of the community the proposed ordinance amendment
would allow for the County to collect a single day drop-in fee for all eligible participants who
do not wish to attend for the entire week. The day drop-in fee would be$20.00 per child and
each additional sibling shall be$10.00 per day.

AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA,
AMENDING SECTION 18-7 OF THE MONROE COUNTY
CODE TO CREATE A MONROE COUNTY PARKS AND
BEACHES SCHOOL BREAK CAMP PROGRAM;AND ALLOW
FEES TO BE CHARGED FOR SCHOOL BREAK CAMP
RECREATIONAL SERVICES; AND PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF ALL
ORDINANCES INCONSISTENT HEREWITH; PROVIDING
FOR INCORPORATION INTO THE MONROE COUNTY
CODE OF ORDINANCES; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, under F.S. 125.01(1)(f), the Board of County Commissioners (BOCC) for
Monroe County is granted the authority, among others, to provide parks, playgrounds and
recreation areas; and
WHEREAS, the BOCC finds that public parks and recreation areas provide sites where
the families and citizens of Monroe County can benefit from and engage in healthy recreational
activities; and
WHEREAS, BOCC finds that the creation of programming at the County's parks and
recreation are in the best interests of the citizens of Monroe County; and
WHEREAS, under F.S. 125.74(1)(g), the County Administrator has the authority to
supervise the care and custody of all County property; and
WHEREAS,the County recognizes the importance of providing safe and fun school break
activities for children and youth; and
WHEREAS,the County has identified a need for school break camp programing that offers
a variety of educational and recreational activities for children and youth in the community; and
WHEREAS,the County desires to expand its camp programming from only summer camp
to allow school break programming during school breaks as designated by the Monroe County
School District; and
WHEREAS, based on the needs of the community, the County desires to clarify that a
single day drop-in fee is allowed for those eligible participants who do not wish to attend the school
break programming for an entire week; and

WHEREAS,the County is committed to promoting healthy lifestyles and fostering positive
relationships among children and youth in the community.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT THE MONROE
COUNTY CODE OF ORDINANCES IS HEREBY AMENDED AS FOLLOWS:

SECTION 1: The above recitals are true and correct and are incorporated herein by this
reference.
SECTION 2: ARTICLE L IN GENERAL shall be amended as follows by creating an
additional separate section titled "Monroe County Stimmef School Break Camp Program" to
include the following language as Sec. 18-7:
Sec. 18-7. —Monroe County Stimme School Break Camp Program
(a) Definitions. The following words, terms, and phrases, when used in this Section,
shall have the meanings ascribed to them in this subsection, except where the context
clearly indicates a different meaning:
" School Break Camp" referred refers to the Monroe County Stimme
School Break Camp Program hosted by the County that offers a variety of education
and recreational activities for children and youth during designated Monroe County_
School District breaks. slim e-m e*t ,.
"Participant" refers to any eligible child or youth enrolled in Sumfner- School Break
Camp and, where applicable,parent or guardian of the child or youth.
"Staff' refers to the individuals who are employed by the county to operate and
supervise the Stimme School Break Camp program.
(b) Establishment off School Break Camp. The County Administrator or his
Designee shall establish and operate a Stimme School Break Camp program for
children and youth in the community.

(1) The Stimme School Break Camp shall be open to children and youth between
the ages of six (6) and seventeen (17) who reside within the unincorporated
areas of Monroe County.
(2) The Stimme School Break Camp may operate during school breaks ffs

(3) The Stimme School Break Camp may be operated at more than one location.
The location of the Stimme School Break camp location(s) shall be at the
discretion of the County Administrator or his Designee.
(4) The Stimme School Break Camp Program shall be designed to provide
participants with a variety of educational and recreational activities, including
but not limited to sports, arts and crafts, nature exploration, team building
exercises, and cultural experiences.
(c) Enrollment.
(1) Enrollment in the Stimme School Break Camp program shall be open to all
eligible participants on a first-come, first-served basis.
(2) The County shall reserve the right to limit the number of participants in the
Stimme School Break camp program.
(3) Enrollment shall be conducted through a registration system, and
participants shall be required to submit a completed registration form and
waiver to participate in the Stimme School Break Camp.
(4) The County may provide scholarship opportunities for eligible low-income
families who may not otherwise be able to afford the cost of Stimme School
Break Camp at the discretion of County Administrator or his Designee.
(d) Fees and Expenses.
(1) The County shall establish fees for participation in the StIffiffle School Break
Camp program, which shall be reasonable and shall cover the cost of materials,
supplies, and staffing.
(2) Weekly camp fee will be $100.00 per child.
i. Each additional sibling shall be $50.00 per child per week.
ii. Daily Camp fees will be $20.00 per child.
iii. Each additional sibling shall be $10.00 per da .

(3) Stimme School Break Camp weekly fees are offered at a fifty percent reduced
rate for children who qualify for reduced school meals within the Monroe
County School District.
(4) Stimme School Break Camp weekly fees are offered at a fifty percent reduced
rate for children of Monroe County BOCC employees.
(5) The County shall establish a budget for the Stimmer- School Break Camp
program, which shall include the cost of materials, supplies, staffing and any
other expenses necessary for the operation of the program.
(e) Staffing.
(1) The County shall hire and train qualified staff to operate the StIffiffle School
Break Camp program.
(2) Staff shall be responsible for planning and implementing the educational and
recreational activities, ensuring the safety and well-being of participants, and
communicating with parents and guardians.
(3) All Staff shall undergo a Level 2 background check as defined in 435.04,Florida
Statutes,prior to the start of employment with the Stimme School Break Camp
program.
(f) Health and Safety.
(1) The County shall establish policies and procedures to ensure the health and
safety of participants in the Stimme School Break Camp program.
(2) Participants shall be required to submit a completed medical form prior to the
start of the Stimme School Break Camp program.
(3) The County shall establish protocols for emergency situations, including but not
limited to first aid, severe weather, and evacuation.
(g) Liability and Insurance.
(1) Participants and their parents or guardians shall be required to sign a waiver of
liability prior to the start of the Stimme School Break Camp program.
(2) Additional permissions from parents or guardians shall be required to transport
participants from primary site to secondary sites.

SECTION 3: SEVERABILITY. If any portion of this ordinance is for any reason held
invalid or declared to be unconstitutional, inoperative or void, such holding shall not affect the
remaining portions of this ordinance. If this ordinance or any provision thereof shall be held to be
inapplicable to any person,property or circumstances,such holding shall not affect its applicability
to any other person,property or circumstances.
SECTION 4: CONFLICT WITH OTHER ORDINANCES. All ordinances or parts of
ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict.
SECTION 5: INCLUSION IN CODE OF ORDINANCES. The provisions of this
ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe,
Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform
to the uniform numbering system of the Code.
SECTION 6: TRANSMITTALAND EFFECTIVE DATE.This Ordinance shall be filed
with the Department of State and shall be effective as provided in F.S. 125.66(2).
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting of said Board held on the day of 2023.
