ITEM BACKGROUND: The County's Department of Airports has requested that the County Land Steward accept the land management of an approximately 35 acre natural area located within the Florida Keys Marathon International Airport property. The subject area contains hardwood hammock and wetlands with some invasive exotic vegetation that is mostly located along the edges of the vegetated area. The Land Steward is willing to accept the management of the property, management activities planned for the site include invasive exotic plant removal work and rare plant monitoring. In order for the Land Stewardship Program to manage the subject area on the Marathon Airport property as "Monroe County Conservation Lands" the property must be designated as such. The proposed resolution designates the approximately 35 acre natural area of the Marathon Airport property as "Conservation Lands" which will allow the Land Steward to use Fund 160 for management activities on the site. WHEREAS, the Board of County Commissioners of Monroe County (the "BOCC"), Florida, is authorized by Article VIH of the Florida Constitution and Chapter 125,Florida Statutes, to adopt ordinances not inconsistent with general law; and WHEREAS, Resolution 149-2022 reauthorized the Monroe County Environmental Land Management and Restoration Fund (Fund 160 / the Fund) and identified revenue sources and allowed expenditures under the Fund; and WHEREAS, in accordance with Resolution 149-2022, Fund 160 is the funding source for the management of Monroe County Conservation Lands and may only be used for the management of said lands; and WHEREAS,the amount of land being acquired by the BOCC and the Monroe County Comprehensive Plan Land Authority (MCLA) has been increasing, including acquisition of lands by the BOCC through the Code Compliance Process, the Transferrable Development Rights procedure, and grant programs, such as the Voluntary Home Buyout Program; and WHEREAS, in order for the Land Stewardship Program to manage appropriate properties as Conservation Lands utilizing funding from Fund 160, the properties must be designated by the BOCC as "Monroe County Conservation Lands; and WHEREAS, the proposed Ordinance establishes a procedure for adding properties to the inventory of Monroe County Conservation Lands that are managed by the Land Stewardship staff utilizing monies from Fund 160; and WHEREAS,the Board finds it in the best interests of the County to amend Article VH of Chapter 2 of the Code of Ordinances to create Division 4 and add Sections 2-428 through 2-432 2152 to the Code, which establishes a definition of"Monroe County Conservation Lands"; defines the role of the County Land Stewardship Program in the management of said lands; and creates a process to add County-owned properties to the inventory of Monroe County Conservation Lands. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA AS FOLLOWS: SECTION 1. ARTICLE VII OF CHAPTER 2 OF THE CODE OF ORDINANCES SHALL BE AMENDED TO ADD DIVISION 4. - MONROE COUNTY CONSERVATION LANDS, which shall read as follows: Section 2-428. —Title. This article may be referred to as the Monroe County Conservation Lands Ordinance. Section 2-429. —Purpose. This article is adopted for the purpose of establishing a definition of Monroe County_ Conservation Lands, to define the role of the County Land Stewardship Program in the management of said lands, and to create a process to add County-owned properties to the inventory of Monroe County Conservation Lands. Monroe County Conservation Lands and State-owned Conservation Lands that are managed by the County shall be managed by the County's Land Stewardship Program with funding provided by the Monroe County Environmental Land Management and Restoration Fund (Environmental Restoration Fund or Fund 160). Section 2-430. —Protection of Conservation Lands. (1) Definitions. a. "Monroe County Conservation Lands" are defined as properties that are managed _by the County for the purpose of conservation and include: i) Properties that were purchased by the Monroe County Comprehensive Plan Land Authority for conservation purposes; ii) Properties owned by the Board of County Commissioners that have been acquired through the Rate of Growth Ordinance (ROGO) land dedication process for conservation purposes; iii) Properties owned by the Board of County Commissioners that have been dedicated for conservation through the Transferable Development Rights procedure, iv) Properties acquired by the County utilizing grant funding where the terms of the grant require long-term conservation of the property; and 2153 v) Properties owned by the Board of County Commissioners (BOCC)that have been designated as conservation. b. "State-owned Conservation Lands that are managed _by the Countyby the County" are those properties owned by the State of Florida for which the County is the designated land manager through a management lease with the State of Florida. (2) Lands designated Monroe County Conservation Lands shall be preserved in perpetuity and shall not be considered or used for any other purpose. Nothing herein prohibits the Land Steward from removing invasive exotics or performing other restoration work. Section 2-431. —Same. —Inventory of properties considered as Monroe County Conservation Lands The BOCC shall ratify, by resolution, an inventory of Monroe County Conservation Lands. The inventory shall be maintained by the County Land Steward and the Clerk. Properties included in the inventory shall be under the management of the Land Stewardship Program utilizing funding from the Environmental Restoration Fund (Fund 160) in accordance with Resolution 14-2022, or subsequent amendments to said Resolution. Section 2-432. —Same. —Additions to Inventory of Monroe County Conservation Lands (1) For land managementpurposes, the following properties shall be immediately considered Monroe County Conservation Lands upon acquisition by the County a) Properties that were purchased by the Monroe County Comprehensive Plan Land Authority for conservation purposes; and b) Properties owned by the Board of County Commissioners that have been acquired through the Rate of Growth Ordinance (ROGO) land dedication process for conservation purposes; and c) Properties owned by the Board of County Commissioners that have been dedicated for conservation through the Transferable Development Rights procedure, and d) Properties acquired by the County utilizing grant funding where the terms of the grant require long-term conservation of the property. (2) Other BOCC-owned properties not included in (1) above, may be added to the inventory of Monroe County Conservation Lands at any time by resolution of the Board. (3) The inventory of Monroe County Conservation Lands shall be updated annually by ratification by the BOCC in order to reflect the status of newly acquired properties previously designated throughout the year. 2154 SECTION 2. SEVERABILITY. Should any portion of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of this Ordinance as a whole, or any part thereof, other than the part declared to be invalid. If this ordinance or any provision thereof shall be held to be inapplicable to any person, property or circumstances, such holding shall not affect its applicability to any other person, property or circumstances. SECTION 3. CONFLICT WITH OTHER ORDINANCES. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. SECTION 4. INCLUSION IN THE CODE OF ORDINANCES. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinance of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered as needed to conform to the uniform numbering system of the code. SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect upon the filing with the Department of State as provided in Section 125.66(2), Florida Statutes. WHEREAS, on May 17, 2023, the Board of County Commissioners (BOCC) adopted Ordinance No. 008-2023, otherwise referred to as the "Land Stewardship Ordinance"; and WHERES, Ordinance No. 008-2023 has been codified at Sections 2-428 et seq. of the Monroe County Code of Ordinances; and WHEREAS, the Land Stewardship Ordinance established a definition of"Monroe County Conservation Lands" and a process to add County-owned properties to the inventory of Monroe County Conservation Lands; and WHEREAS, in accordance with the Land Stewardship Ordinance, Monroe County Conservation Lands include properties owned by the BOCC that have been acquired through the Rate of Growth Ordinance (ROGO) land dedication process for conservation purposes, properties owned by the BOCC that have been dedicated for conservation through the Transferable Development Rights procedure, properties acquired using grant funding where the terms of the grant require long-term conservation of the property, and other properties owned by the BOCC that have been designated as conservation; and WHEREAS, in accordance with Resolution 149-2022, the Monroe County Environmental Land Management and Restoration Fund (Fund 160 / the Fund) is the funding source for the management of Monroe County Conservation Lands and may only be used for the management of said lands; and WHEREAS, the Land Stewardship Ordinance states that the BOCC shall ratify, by resolution, an inventory of Monroe County Conservation Lands; and WHEREAS, the BOCC ratified the initial list of Monroe County Conservation Lands at their July 19, 2023 meeting through Resolution 251-2023; WHEREAS, the Florida Keys Marathon International Airport property includes parcels having the real estate numbers RE 00101160-000000 and 00104500-000000 ("Marathon Airport Property") which, in total, contain approximately 35 acres of natural area consisting of hardwood hammock and wetlands; WHEREAS, the County's Department of Airports has requested that the County Land Steward accept the land management of the natural areas on the Marathon Airport Property, as shown in Exhibit A; WHEREAS, in order for the Land Stewardship Program to manage the natural areas on the Marathon Airport Property as Conservation Lands, utilizing funding from Fund 160, the property must be designated as "Monroe County Conservation Lands"; and 2160 WHEREAS,the Land Steward supports the addition of the natural areas on the Marathon Airport Property, as shown in Exhibit A, to the inventory of Monroe County Conservation Lands; and WHEREAS, the proposed addition of said natural area on Marathon Airport Property meets the definition of the term "Monroe County Conservation Lands" as set forth in Section 2-430(1)a. of the Monroe County Code.
