F12 BOARD OF COUNTY COMMISSIONERS COUNTY of MONROE i Mayor Holly Merrill Raschein,District 5 The Florida Keys Mayor Pro Tern James K.Scholl,District 3 Craig Cates,District 1 Michelle Lincoln,District 2 ' David Rice,District 4 Board of County Commissioners Meeting December 13, 2023 Agenda Item Number: F12 2023-1813 BULK ITEM: Yes DEPARTMENT: County Land Acquisition And Land Management TIME APPROXIMATE: STAFF CONTACT: Beth Bergh NA AGENDA ITEM WORDING: Approval of a Resolution amending Resolution 268-2006 to allow land donated by Habitat for Humanity to be used for conservation purposes only instead of the original proposed uses and to add said land to the inventory of Monroe County Conservation Lands to be managed by the County's Land Steward. ITEM BACKGROUND: In 2006, Habitat for Humanity of Key West and Lower Florida Keys, Inc. deeded a property located on Big Pine Key to the Board of County Commissioners for specific public uses. The proposed potential uses included a post-disaster staging area, storm response site, and a park. However, due to the environmental sensitivity and protected habitat of the site, County staff has determined that the best use of the property is conservation. At the request of County staff, the Board of Directors of Habitat for Humanity of Key West and Lower Florida Keys, Inc. held a meeting on October 17, 2023, where they unanimously consented to eliminate the requirement that the County use the land for the originally intended purposes and instead use the land as conservation. Additionally, the proposed resolution will add the subject property to the inventory of"Monroe County Conservation Lands" which will allow the Land Steward to manage the property utilizing funding from the County's Environmental Land Management and Restoration Fund (Fund 160). PREVIOUS RELEVANT BOCC ACTION: July 2023 - BOCC approved Resolution 251-2023 which ratified the initial inventory of"Monroe County Conservation Lands" May 2023 - BOCC approved Ordinance 008-2023 (aka "Land Stewardship Ordinance")which defined "Monroe County Conservation Lands" and established a process to add County lands to the inventory of said lands July 2006 - BOCC approved Resolution 268-2006 which accepted the land from Habitat for Humanity and identified potential uses of the site 2163 INSURANCE REQUIRED: No CONTRACT/AGREEMENT CHANGES: NA STAFF RECOMMENDATION: Approval DOCUMENTATION: 00313140 Habitat for Humanity BPIF parcel.pdf Draft Reso for HFH parcel- I I-13-2023.docx Habitat for Humanity Resolution Conservation Land Signed 10-23.pdf FINANCIAL IMPACT: NA 2164 EXHIBIT A Prepared by and Return to: Doc# 1595797 08/02/2006 4:01PM Filed & inRecords Susan Grimsley MONROE COUNTYd cial DANNY I L.
