ITEM BACKGROUND: An Antonov AN-24RV aircraft has been stored in the historic bunker lot located adjacent to Government Road at the western end of the Key West International Airport property,purchased by North American Aviation Inc. on September 17, 2003. Since its purchase by North American Aviation Inc.,to the best of staffs knowledge and belief,the aircraft has sat idle,has had no maintenance,has had no repairs made to it,nor is it currently in the process of actively being repaired. The aircraft also does not have a current certificate of air worthiness issued by the Federal Aviation Administration. The aircraft, for all intents and purposes, has been left derelict and/or abandoned at Key West International Airport(KWIA). Staff has conducted a diligent search and located the last known address for North American Aviation Inc., as well as the contact information for the registered agent for North American Aviation Inc. With regards to derelict and/or abandoned aircraft left on a public-use airport,Florida Statute sections 705.183 and 705.182 set forth the procedures for disposal of such aircraft. Staff has followed the procedures set forth in the Florida Statutes in order to perfect its claim of lien and has completed the proper steps in the proper order and has complied with the waiting periods and time constraints set forth in said Florida Statute sections 705.183 and 705.182 in order to proceed with the disposal of the aircraft.Under section 705.182 the aircraft can be disposed of in several ways. The county could choose to retain the aircraft for use by the airport or for use by the state or the unit of local government owning or operating the airport; trade the aircraft to another unit of local government or a state agency; donate the aircraft to a charitable organization; sell the aircraft(at public auction); or dispose of the aircraft through salvage services. In this case, initially, staff attempted to auction the aircraft.Notice of the auction was posted on the 1 aircraft, advertised in the Key West Citizen as well as posted on the EYW.COM website. The auction was held on September 27, 2023 and there were no bids received. Having received no bids, staff is now requesting approval to seek out, contact and contract for salvage services in order to dispose of the aircraft in accordance with Florida Statutes. Staff is also requesting that the Executive Director of Airports be delegated authority to negotiate and execute all required salvage agreement documents as approved by the County Attorney's office.
