A RESOLUTION OF THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS WAIVING FINES AND
COSTS FOR CODE COMPLIANCE CASE CE22010071
FOR REAL PROPERTY AT 31568 AVENUE D, LOTS 15,
16, 17, BLOCK 22, BIG PINE COVE SUBDIVISION, WITH
PARCEL ID NUMBER 00308540-000000, PURCHASED BY
THE MONROE COUNTY LAND AUTHORITY TO BE USED
FOR AFFORDABLE HOUSING DEVELOPMENT.
WHEREAS, Hurricane Irma impacted the Florida Keys in September 10, 2017
destroying or majorly damaging over 4,000 residential structures in Monroe County
severely augmenting the workforce housing crises, some of which were determined to
be unsafe structurally; and
WHEREAS, the cost of repairing or rebuilding workforce affordable housing damaged or
destroyed by Hurricane Irma is sometimes cost prohibitive to some property owners;
and
WHEREAS, the Monroe County Comprehensive Plan Land Authority has the ability to
purchase some of these properties to redevelop them as affordable workforce housing;
and
WHEREAS, the Monroe County Comprehensive Plan Land Authority will acquire real
property consisting of Lots 15, 167 17, Block 22, of Big Pine Cove, also known as 31568
Avenue D, Big Pine Key, FL 33043, Parcel ID Number 00308540-000000, along with 1
Rate of Growth Ordinance (ROGO) Exemption ("the Property") to be used for affordable
housing development; and
WHEREAS, there is a pending Code Compliance case, CE22010071, against the
Property, and liens recorded at Book 3201, Page 1864 and Book 3209, Page 2492 of
the Official Records of Monroe County; and
WHEREAS, the Board of County Commissioners has the ability to waive any fines,
fees, or costs that may either currently or in the future be due to the County.
NOW, THEREFORE, BE IT RESOLVED BY THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS, THAT:
Section 1. The above recitals are true and correct and incorporated herein.
Section 2. The fines and costs for Code Compliance Case CE22010071 are hereby
waived upon transfer of the Property to the Monroe County Comprehensive Plan Land
Authority.
Section 3. The Monroe County Attorney is authorized to release the liens recorded at
Book 3201, Page 1864 and Book 3209, Page 2492 of the Official Records of Monroe
County.
PASSED AND ADOPTED by the Monroe County Board of County Commissioners at a
regular meeting on this 13th day of December 2021
