A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, AMENDING RESOLUTION 268-
2006 TO ALLOW LAND DONATED BY HABITAT FOR HUMANITY
OF KEY WEST AND LOWER FLORIDA KEYS, INC. TO BE USED
FOR CONSERVATION PURPOSES ONLY INSTEAD OF THE
ORIGINAL PROPOSED USES AND TO ADD SAID LAND TO THE
INVENTORY OF MONROE COUNTY CONSERVATION LANDS IN
ACCORDANCE WITH MONROE COUNTY ORDINANCE NO. 008-
2023 AS CODIFIED AT SECTION 2-430(l) OF THE MONROE
COUNTY CODE OF ORDINANCES.
WHEREAS, in July 2006, Habitat for Humanity of Key West and Lower Florida Keys, Inc, a
Florida Not-for-Profit Corporation, deeded a property to the Board of County Commissioners (BOCC)
for public purposes, the property is specifically described as Tract A, Tropical Bay, First Addition, Big
Pine Key, Florida, Plat Book 4, Page 122, of the Public Records of Monroe County, Florida, and having
Property Appraiser's Parcel ID 00313140-000000; and
WHEREAS, the BOCC accepted said property by Resolution 268-2006 which identified the
potential public purposes of the site as storm recovery and staging area or County park; and
WHEREAS, County staff has since determined that the proposed uses as a storm recovery site
and staging area or County park are not appropriate uses of the parcel due to the environmental sensitivity
of the site; and
WHEREAS, the Board of Directors of Habitat for Humanity of Key West and Lower Florida
Keys, Inc. held a meeting on October 17, 2023, where they unanimously consented to eliminate the
requirement that the County use the land for the originally intended purposes and instead use the land as
conservation; and
WHEREAS, on May 17, 2023, the BOCC adopted Ordinance No. 008-2023, otherwise
referred to as the "Land Stewardship Ordinance" which has been codified at Sections 2-428 et seq.
of the Monroe County Code of Ordinances; and
WHEREAS, the Land Stewardship Ordinance established a definition of"Monroe County
Conservation Lands" and a process to add County-owned properties to the inventory of Monroe
County Conservation Lands; and
WHEREAS, in accordance with the Land Stewardship Ordinance, Monroe County
Conservation Lands include properties owned by the BOCC that have been acquired through the
Rate of Growth Ordinance (ROGO) land dedication process for conservation purposes, properties
owned by the BOCC that have been dedicated for conservation through the Transferable
Development Rights procedure, properties acquired using grant funding where the terms of the
grant require long-term conservation of the property, and other properties owned by the BOCC that
have been designated as conservation; and
WHEREAS,in accordance with Resolution 149-2022, the Monroe County Environmental Land
Management and Restoration Fund (Fund 160 /the Fund) is the funding source for the management of
Monroe County Conservation Lands and may only be used for the management of said lands; and
WHEREAS, the Land Stewardship Ordinance states that the BOCC shall ratify, by resolution,
