ITEM BACKGROUND: The bid proposal from Ten-8 Fire Equipment (Attachment B) is for the
type of Engine that meets the needs of Monroe County. The price is $374,864.00. Ten-8 Fire
Equipment, Inc. is the sole source provider (Attachment C) of Pierce Manufacturing, Inc. equipment
and apparatus in the state of Florida. The Monroe County Purchasing Department per the Purchasing
Policy have attempted to contact other South Florida vendors in order to determine if the goods/service
sought are available at a lower price than the existing contract and have received no response.

PREVIOUS RELEVANT BOCC ACTION: During the Fiscal Year 200:? budget process, the
Board approved a capital plan account in fund 304 (Attachment E) for ongoing replacement of Fire
Apparatus and Ambulances as needed. During the budget process each Fiscal Year thereafter, the
Board appropriated funds for the continuation of vehicle capital replacement program fund. In April
2006 the Board approved the amended Fund 304 Capital Projects Budget (Attachment F), which
included FirelEMS vehicle replacement funding.

ITEM BACKGROUND: During the Fiscal Year 2002 budget process, the Board approved a
capital plan account in fund 304 for ongoing replacement of Fire Apparatus and Ambulances as
needed. We obtained a proposal submitted by Pierce Manufacturing, Inc. to Lake County, Florida
that included pumper apparatus specifications that meet the needs of Monroe County. We would
like to "piggy-back" the Lake County, Florida bid 99-150, and purchase (1) one Pierce Custom
Enforcer Pumper, for a purchase price of $374,864.00. Funds are available in the capital plan
account for this purchase. Ten-8Pire Equipment, Inc. is the sole source provider of Pierce
Manufacturing, Inc. equipment and apparatus in the state of Florida. The MOilloe County
Purchasing Department per the Purchasing Policy have attempted to contact other South Florida
vendors in order to determine if the goods/service sought are available at a lower price than the
existing contract and have received no response.

CONTRACTIAGREEMENTCHANGES: N/A
STAFF RECOMMENDATIONS: Engines (pumpers) are the primary firefighting vehicle whose
function is to deliver water at sufficient pressures and quantities to combat fires. Most of their
space is dedicated to a 1250 gallon-per-minute pump, up to 1000 gallons of water in a tank, and
1200 foot plus of hose of various dimensions and lengths. Actual experience has shown that the
service life expectancy for pumpers in this operating environment is fifteen years, therefore each
front-line engine should be replaced every 15 years.
The apparatus replacement program includes a review of departmental needs, an evaluation of the
equipment replacement schedule, Fire Rescue Apparatus and Equipment Committee
recommendations, current fleet type, repair history, maintenance requirements and restrictions,
operating costs, and standardization. After a detailed review of these factors listed herein, it is the
recommendation of staff that this agenda item is approved as written.

Lake County Contract No. 99-150 which permits Lake County) FL along with other
Government Agencies to purchase various specified and unspecified apparatus
per the pricing structure bid on June 24, 1999. This contract is renewable for up to
five (5) years. See attached pages I of9 for conditions attached. The formula is 4%
over dealer cost on the base vehicle and 10% on vehicle options and equipment per
page 1 of the Lake County Bid Sheet. This contract applies to the complete line of
Pierce apparatus. We are willing to extend the same terms and condition per Lake
County Bid 99-150.
All handling, transportation, and delivery costs would be included in the base
vehicle cost from Pierce Manufacturing I.nc:

We could also provide prices paid on similar units by other municipalities as
additional price justification. This contract allows each municipality to specify the
options and equipment as required to meet their individual applications and
operating standards. The following are some of the municipalities that have accessed

of funds with thirty (30) days written notice for the convenience of the County. This
contract also provides for four additional twelve (12) month renewals at the County's
sole option at the terms noted in the Bid.

, . SCQfE: The fOllowing terms and conditions including the attached Special Terms and Conditions shall prevail unless otherwise
iTiCiCIiTIed by lake County within this bid document. Lake County reserves the right to reject any bid which takes exception to
these terms and conditions.
2. ~~FINITIONS AS USED HEREIN:
a. The term "bid request" means a solicitation of a formal sealed bid.
b. The term "bid" means the price offered by the bidder.
c. The term "bidder" means the offerer or vendor.
d. The term "contractor" means a bidder that is awarded a County contract as a result of this bij:l request.
e. The term "County" means Lake County, Florida.
f. The term "Board of County Commissioners" or "BCC" means the governing body of lake County, Florida.
3. COMPLETING BID: Bids must be submitted ~ on the forms provided in this bid document. Copies of the forms provided are
not acceptable and shall not receive consideratIon. All information must be legible and either written in ink or typewritten. Any
and all corrections and/or erasures must be initialed and dated by the bidder. Each bid sheet must be signed by an authorized
bidder and all required information must be provided.

6. ACCURACY OF BID: Each bid is publicly opened and is made part of the public record of the County. Therefore, it is necessary
that any and all information presented is accurate and will be that by which the bidder will complete the contract. If there is

7. CONDITIONAL BIDS: Conditional bids are subject to rejection in whole, or in part, at the sole discretion of the County.
8. ~DDENDA: All changes in connection with this bid will be issued by Procurement Services in the form of a written addendum.

bid. Telegraphic, verbal or facsimile bids shall not be considered.
10. BID OPENING: At the time and date specified, Procurement Services will publicly open and read aloud all duly submitted bids.
All bidders and the general public are encouraged to attend the bid opening. Such reading shall not be construed as meaning
the apparent low bidder has met all requirements and/or specifications set forth in the bid documents.
". LATE BIDS AND MODIFICATION OR WITHDRAWALS: Bids received after the deadline designated in this bid document shall
not be considered and shall be returned unopened at the option of Procurement Services.
Bids may be withdrawn or modified prior to the bid opening. All such transactions must be submitted in writing and received
by Procurement Services prior to the bid opening. Procurement Services reserves the right to require proper identification of any
party that submits such a transaction.
12. BJDS BINDING: All bids submitted shall be binding upon the bidder if accepted by the County within sixty (60) calendar days
a ter the bid opening unless the bidder, in concurrence with Procurement Services, agrees to an extension of time.
'3. NEW GOODS: Unless otherwise specified. all goods offered by a bidder shalf be new, unused, of recent manufacture, first class
in every respect. and suitable for their intended purpose. All goods shall be assembled, fully serviced and ready for operation
when delivered.
14. EQUIVALENTS: When brand or trade names are used in the bid invitation, it is for the purpose of item identification and to
establish standards for quality, style and features. Bids on equivalent items of substantially the same quality, style and features
are invited unless items are marked "No Substitute." All equivalent bids, regardless of whether brand or trade names are used
in the bid invitation, must be accompanied by descriptive literature and/or specifications to receive consideration.
Demonstrations and/or samples may be required and shall be supplied at no charge to the County. The County reserves the right
to determine if bid goods are equivalent to specified goods.
15. WARRA~: Goods or services furnished as a result of this bid shall be covered by the most favorable commercial warranties,
expresse or implied, that the bidder and/or manufacturer gives to any customer. The rights and remedies provided herein are
in addition to and do not limit any rights afforded to the County by any other clause of this bid. The,County reserves the right
to request from bidders a separate manufacturer certification of aU statements made in the response.
16. DELIVERX' TERM~ AN~ PACKAGt~G: All prices offered shall be F.O.B. Destination and all freight charges shall be included in
the bid pnce. Insi e de Ivery is reqUIred. All goods delivered shall be securely packaged. All shipping containers shall be suitable
for storage or shipment and all bid prices shall include standard commercial packaging.
17. CREf?JT ;}RMS: Bidder shall indicate all discounts for full and/or prompt payment. Such discounts, however, shall not be
conSI ere as a cost factor in the determination of award. Bidders are encouraged to reflect cash discounts in the unit prices

18. TAX EXEM~: The County and its offices are exempt from Federal Excise Taxes and all sales taxes. Situs of aU transactions
under any or er(s} that shall be derived from this bid request shall be deemed to have been accomplished within the State of
Florida.
19. METHOD OF AWARD AND NOTIFICATION: Bids will be analY2ed and the award made to the lowest and best, responsive and
responsible bidder(sl whose bid conforms to the specifications and whose bid is considered to be the best value in the opinion
of the County.
The County reserves the right to reject any or all bids and any part of a bid; to waive informalities, technical defects and minor
irregularities in bids received; and to award the bid on an item by item basis, by specified groups of items or to consider bids
submitted on an "all or nothing" basis if the bid is clearly designated as such or when it is determined to be in the best interest
of the County.

Procurement Services's opinion, is beyond the control of the contractor. Under such circumstances, however, the County may
cancel the contract if such action is deemed to be in the best interest of the County.
24. RECEIPT AND A~CE~A~CE: Goods shipped as a result of the award of this bid request will be received by the County ordering

25. DAMAGED AND/OR LATE SHIPMENTS: The County has no Obligation to accept damaged shipments and reserves the right to
return, at the contractor's expense, damaged goods even though the damage was not apparent or discovered until after receipt
of the items. The contractor is responsil:ile to notify the County Office of Purchasing of any late or delayed shipments. The
County reserves the right to cancel all or any part of an order if the shipment is not made as offered:
26. INVOICE: Invoices shall be prepared and submitted in duplicate to address shown on the purchase order. Separate invoices
are required for each purchase order. Invoices shall contain the following information: purchase order number, contract number,
item number, description of supplies or services, sizes, unit of measure, quantity, UOlt price and extended totals. Payment of
invoices shall be governed by the Florida Prompt Payment Act, Sections 218.70 through 218.79, Florida Statutes. Time of
payment shall be computed from receipt of a correct invoice or the date of the County's receipt and acceptance of the bid
goods, whichever is later. The County will not entertain offers that require prepayment.
27. MATERIAL SAFffi DAT~ SH6~ rMSDS): It is mandatory for a manufacturer, supplier, or distributor to supply an MSDS as
reqUIred by 29 191 .12 with the first shipment of hazardous material. Also, at any time the content of an MSDS is
revised, the contractor is required to provide ne\'\( information relevant to the specific material.
28. CDQES AND RE~ULATI~NS: All goods and work within the scope of this request shall be completed by the contractor to all

29. SAFETY: All practices and goods furnished as a result of this request shall comply with the federal Occupational Safety and
Health Act, as well as any pertinent federal, state and/or local safety or environmental codes.

Within the contract period, the County reserves the right to verify prices by examination of
dealer or distributor's invoices and to evaluate all proposed purchases with respect to
reasonableness of price. The County may reject any proposal made by the contractor in
favor or renegotiation or bidding.
3. CONTRACT PERIOD: Any contract derived from this request shall be effective for the
approximate twelve (12) month period immediately following the date of award.
4. OPTION TO RENEW CONTRACT: The County reserves the sole right to renew said contract
for four (4) additional twelve (1 2) month periods at the same pricing structure,
specifications, and terms and conditions of any contract derived from this bid request.
5. ESTIMATED QUANTITIES: Any contract entered into will be of the "open end" type. The
contractor will deliver such quantities as may be ordered, and the contract shall be binding
only for the actual quantities ordered during the contract period. Orders will be issued
throughout the contract period as needs are determined.
The quantities indicated on the bid sheet are the apparatus that will be ordered initially with
award of this bid request. The County anticipates ordering six (61 additional apparatus in
fiscal year 2000 and six (6) additional apparatus in fiscal year 2001.
6. CONTRACT PRICING: The set pricing structure bid (percentage above bidder's dealer net
cost for vehicles, equipment options and vehicle accessories and percentage discounts from
identified price lists for cab and chassis parts and body parts) shall remain firm throughout
the original contract period for apparatus and for any subsequent contract renewal periods

although the County's purchase net prices may increase or decrease.
7. CONTRACT PRICING MODIFICATIONS: If the price paid by the contractor (successful
bidder) to the manufacturer is either increased or decreased after the contract date, the
corresponding contract unit prices may be adjusted according to the following procedures.
A. Price Increases
1 . Any requests for price increases must be in writing and must be direqted to
Procurement Services Contracting Officer (hereinafter Officer) responsible for
the contract. Requests must fully document the rationale for such increases
and include a copy of the manufacturer's notification to the contractor of
same. The increase must apply to all dealers of the same class as the
contractor. Contractor originated increases shall not be allowed.
2. No modification incorporating an increase in contract prices will be executed
pursuant to this section until the requested increase in the prevailing contract
.prices has been verified and approved by the applicable Officer.
3. Any approved increased contract prices will be effective on the effective date
of the increase in the applicable manufacturer's price if the contractor's
written request is received by the Officer within ten (10) days thereafter, but jf
not, the effectfve date of the increased prices' wilf De the date of receipt and
verification by the Officer of such request.
4. Once issued under terms of the contract, a County purchase order is not
subject to price escalation regardless of whether the date of delivery on the
purchase order is before or after the effective date of the increased contract
prices,
B. Price Decreases
The contractor shall promptly notify the Officer as to the amount and effective date
of each decrease in any applicable manufacturer's price, and each corresponding
contract, unit price will be decreased by the same percentage. Such decrease will
apply to items delivered on and after the effective date of the decrease in the
manufacturer's established price and the contract will be modified accordingly.
8. ADDITIONAL GOODS: Goods not specifically identified in this bid request may be added to
any resultant contract upon mutual consent of the contracting parties.
9. DELIVERY DATE: Delivery dates shall be negotiated annually. When quoting a delivery
date, bidder shall state time in days from the receipt of a County purchase order or contract,
not time in days from the date of the bid opening.
10. FAILURE TO SUPPLY; The contractor will make every attempt to supply the awarded
equipment within the time framers) requested on each order. Failure to supply may be cause-
in-need for the County to procure in the open market equipment meeting or similar to those
specified in the contract. The contractor shall be liable for liquidated damages for delay or
nonperformance in the amount of $ 75.00 per calendar day from date set for cure until either
the County reasonably obtains similar equipment if the contractor is terminated for default, or
until the contractor supplies the equipment if the contractor is not terminated for default.

Said apparatus and equipment are to be built and shipped in accordance with the specifications
hereto attached, delays due to strikes, war, or intentional conflict, failures to obtain chassis, materials, or
other causes beyond our control not preventing, within about 230-250 working days after receipt of this
order and the acceptance thereof at our office at Appleton, Wisconsin, and to be delivered to you at
Monroe County, Florida
The specifications herein contained shall form a part of the final contract, and are subject to
changes desired by the purchaser, provided such alterations are interlined prior to the acceptance by the
company of the order to purchase, and provided such alterations do not materially affect the cost of the
construction of the apparatus.
The proposal for fire apparatus conforms with all Federal Department of Transportation (DOT)
rules and regulations in effect at the time of bid, and with all National Fire Protection Association (NFPA)
Guidelines for Automotive Fire Apparatus as published at the time of bid, except as modified by customer
specifications. Any increased costs incurred by first party because of future changes in or additions to said
DOT or NFP A standards will be passed along to the customers as an addition to the price set forth above.
Unless accepted within 30 days from date, the right is reserved to withdraw this proposition.

SUBJECT: Revised Apparatus Replacement Program

Since early in my tenure here I have expressed my concern on several occasions that the funding
of the Fire Rescue Apparatus Replacement Program from 304 funds was insufficient. My
concerns were not only the fact that a constant $500,000 per annum was not keeping up with the
rising cost of fire and rescue vehicles, but that in future years it would actually drop to $250,000
which is not currently enough to buy a single pumper. I am requesting that additional funding be
allocated to this program as described on the attached spreadsheet.
Relevant History
When the apparatus replacement program was first begun in 2002, $500,000 was a sufficient
amount to replace two engines (pumpers), or an engine and a tanker, per year. Though no
increases were programmed for inflation, this was sufficient at the time. However in intervening
years, four attacks on this fund have severely affected the capacity for $500,000 to remain a
realistic figure:
· Fire apparatus costs are experiencing an average inflation rate of 4% per year
· With the consolidation of fire suppression and emergency medical services into a single
Fire Rescue Department, the ambulance replacement program has merged with the fire
apparatus replacement program, creating a significant additional drain on the fund.

Ell The County Administrator has directed that major apparatus repairs, (such as refurbishing
of two aerial ladder apparatus to extend their service life) are appropriate expenditures
from the 304 fund
€I Ocean Reef Fire Rescue was inadvertently not considered as part of this replacement
program at the outset. In the current fiscal year the fund has replaced their 1986 engine.
Program Assumptions
· There are eleven front-line engines (pumpers) operating in unincorporated Monroe
County. Engines are the primary frrefighting vehicle whose function is to deliver water at
sufficient pressures to combat fires. Most of their space is dedicated to a 1250 gallon-
per-minute pump, up to 1000 gallons of water in a tank, and some 1600 feet of hose of
various dimensions and lengths. Actual experience has shown that the service life
expectancy for pumpers in this operating environment is fifteen years, so each front-line
engine should be replaced every 15 years, and moved to reserve status. We should
maintain two reserve pumpers in the field in addition to two training pumpers for use at
the Joe London Fire Training Facility.
iii There are nine front-line rescue units (ALS Ambulances) operating in unincorporated
Monroe County. Due to the higher volume of emergency medical services incidents, and
to provide sufficient additional ambulances to be placed into service for disasters, we
maintain a reserve fleet of seven additional ambulances. The current type of ambulances
that are based on a pick-up truck chassis have a front-line service life expectancy of four
years. We are migrating to a larger medium-duty chassis that lasts seven years in front-
line service. Therefore, each front-line rescue should be replaced every seven years.
iii There are six tankers operated in unincorporated Monroe County. With tank capacities of
1500 to 3000 gallons, typically 2000 to 2500 gallons, their primary purpose is to provide
mobile water supply in the many areas of the county that do not have fire hydrants.
They typically are equipped with a 1250 gpm pump so that they can pump water from a
hydrant or a drafting source when one is available. The service-life expectancy for
tankers is eighteen years, so each tanker should be replaced every eighteen years. We do
not maintain reserve tankers.
I) There are three squads (heavy duty rescue squads) operated in unincorporated Monroe
County. Squads axe large tool boxes on wheels, carrying heavy rescue tools that cut or
pry wreckage, such as Jaws-of-Life, circular saws, chain saws, hydraulic rams,
compressed-air lifting bags, and other specialized rescue tools that are either, too
expensive, too rarely used, or too space-consuming to make it practical to so-equip every
fire station. Squads have a service~life expectancy of eighteen years and should be
replaced on that cycle. We should maintain one reserve squad.
€I Three aerial ladder apparatus protect the unincorporated areas of northern Monroe
County. A fourth aerial apparatus, the second aerial platform, needs to be acquired for
the lower Keys to provide coverage from Big Pine Key to Stock Island. Th,is fourth aerial
apparatus is tentatively projected to be stationed at the Big Coppitt Key fite station (No.
9), providing service to the lower Keys and back-up capacity for the City of Key West's

sole ladder truck. Aerial ladders have a service-life expectancy of twenty years. On a
twenty-year replacement schedule one should be acquired every five years. Recent
expenditures to extend the service life of the aerial apparatus at both the Tavernier and
the Key Largo fire stations will enable us to acquire this aerial platform in 2007, by which
time there should be additional space in new fire stations to accommodate relocation of
other apparatus as needed.
G A number of specialized support vehicles, shown on the schedule as "utilities", serve the
county in such capacities as mobile air-cascade supplies, hose reel trucks, and firefighter
rehabilitation units. They have a service life expectancy of twenty years and need to be
replaced periodically.
Rationale
· In 2004, the cost of an average pumper is $263,000. The cost of a squirt (a pumper with
a pre-piped, elevated water stream capability) is about $500,000. Of the eleven front-line
engines, seven should be standard pumpers; four should be squirts. Averaging the costs:
$263,000 x 7 engines =
$500.000 x 4 squirts =
$1,841,000
$2.000.000

$3.841.000 -:- 11 total frontline engines = $349.000 (average cost per engine 2004)
e The prevailing inflation rate applied to ambulance costs is 2%
e The prevailing inflation rate applied to fire apparatus is 3.5% to 5%. A 4% factor was
used to project future costs of fire apparatus.
G In addition to pumpers, as described above, the average costs in FY2004 for other types
of fire apparatus are:
Tankers: $300,000
Squads: $475,000
Aerials: $800,000
Utilities: $100,000
Recommendation
e The average yearly allocation needed is $1,175,400 for the projected apparatus purchases.
However, we begin the plan with a $940,000 allocation with a 2.6% inflation factor for
each succeeding year.
· This is a 20-year replacement plan than can be repeated for a second and perhaps a third
twenty-year cycle. However, an important assumption is that the number of stations
servicing unincorporated Monroe County remains constant. If Monroe County Fire
Rescue should either add stations in the unincorporated area, or should we assume

contract responsibilities for any of the municipalities, additional apparatus replacement
needs would need to be factored-in and the schedule revised accordingly.
Summary
I hope you will agree that the current fire apparatus replacement program is severely under
funded at the current rate. It is important that we maintain as modem a fleet of fire and rescue
vehicles as possible to assure dependable response and performance on emergency scenes.

A RESOLUTION CONCERNING THE TRANSFER OF FUNDS
WHEREAS, it is necessary for the Board of County Commissioners of Monroe County,
Florida, to make budgeted transfers in the Monroe County Budget for the Fiscal Year
