ITEM BACKGROUND: Mutual Aid or Assistance is a system whereby fire and emergency service providers assist neighboring providers in controlling or extinguishing fires or other emergencies when a quicker response may be provided due to being closer or more available, This practice is already being successfully carried out throughout the county, however it is preferable to have an executed agreement in place. The current MOU approved by the Board on December 17, 2003 requires a triennial review, which would be due December 2006. During September 2006, Clark Martin, Monroe County Emergency Services Fire Chief/Director and David White, Naval Air Station Key West Fire Chief, conducted a review of said MOU, and drafted an updated applicable version ofthe MOU, deleting a paragraph with verbiage authorizing and encouraging the development of any Standard Operating Procedures necessary to effect said agreement, and requiring attachment as an exhibit. Said parties agreed that this verbiage was not considered necessary in meeting the intent of the agreement, and its' directive was impractical requiring such a large exhibit attaclnnent. PREVIOUS RELEVANT BOCC ACTION: On December 17, 2003 the Board approved a Memorandum of Understanding between Naval Air Station Key West and Monroe County regarding Mutual Fire and Emergency Services Assistance Agreement. CONTRACT/AGREEMENT CHANGES: Deletion ofa paragraph deemed unnecessary in meeting the intent of the agreement, i.e. verbiage authorizing and encouraging the development of any Standard Operating Procedures necessary to effect said agreement, and requiring attachment as an exhibit. Immediately determine if apparatus and personnel can be spared in response to the call. b, Determine what apparatus and personnel might most effectively be dispatched. c. Determine the exact mission to be assigned in accordance with the detailed plans and procedures of operations drawn in accordance with this Agreement by the technical head of fire departments involved. d. Forthwith dispatch such apparatus and personnel as, in the judgment of the Senior Fire Officer receiving the call, should be sent, in accordance with the terms of this agreement; provided, however, that when a call for assistance is received by a Navy fire department, it shall be referred at once to the Commanding Officer ofNASKW, or the authorized duty officer, before any equipment or persOlmel is dispatched, 2, While the rendering of assistance under the terms of this Agreement shall not be mandatory, the party receiving the request for assistance should immediately inform the requesting service if service cannot be rendered, A failure to inform or failure to render assistance shall not be considered a negligent act. 3, The parties agree that neither is the agent ofthe other. Each party is responsible for any acts of negligence by its agents or employees. 4. All services performed under this agreement shall be rendered without reimbursement to either party. 5. The Chief Fire Officers and personnel ofthe fire departments of both parties to this agreement are invited and encouraged, on a reciprocal basis, to frequently visit each other's activities for guided familiarization consistent with local security requirements and conduct joint pre-incident planning, inspections, and drills, 6. This agreement shall become effective upon the date hereof and shall be reviewed triennially. Either party upon written notice to the other may tenninate this agreement at any time. 7. This agreement constitutes the entire agreement between the patiies; it may be amended only in writing signed by both patiies. Each party to this agreement waives any and all claims against the other party for compensation for any loss, damage to property, personal injury, and death occurring in consequence of the performance of this agreement. 4. All services performed under this agreement shall be rendered without reimbursement to either party. 5. The Chief Fire Officers and personnel of the fire departments of both parties to this agreement are invited and encouraged, on a reciprocal basis, to frequently visit each other's activities for guided familiarization consistent with local security requirements and conduct joint pre-incident planning, inspections, and drills. 6. The technical heads of the fire departments of the parties to this agreement are authorized and encouraged to draft any Standard Operating Procedures necessary to effect this agreement. Such plans will become effective when ratified by the signatories, and shall be attached to this agreement as an exhibit. 7, This agreement shall become effective upon the date hereof and shall be reviewed triennially. Either party upon written notice to the other may terminate this agreement at any time. 2 8.
