ITEM BACKGROUND: Florida Statute Section 197.3632 specifies that a public hearing to adopt a resolution of intent to use the uniform method of collection for an assessment program must be held in the calendar year prior to the collection. The uniform method refers to the tax bill method of collection. The annual connection fee payment due will appear on the property’s tax bill unless payment is made in full. The resolution of intent st must be adopted by January 1, 2007 and sent to the Monroe County Tax Collector, the Monroe County Property Appraiser, and the Florida Department of Revenue by January 10, 2007. A notice of the public hearing to adopt the resolution of intent was advertised four consecutive weeks immediately before the date of the hearing, as required by statute. The Monroe County and FKAA attorneys concur that Shark Key residents will be mandated to connect because the system will abut the property owned by the Shark Key Homeowner’s Association. PREVIOUS RELEVANT BOCC ACTION: At the January 25, 2006 Special Meeting, approval was granted to levy a $4,500 per EDU sewer connection fee for those properties designated as Tier III in the Duck Key and Big Coppitt Key sewer service areas through Little Torch Key excluding Baypoint. The Interlocal Agreement between Monroe County and the Florida Keys Aqueduct Authority specifies that, “citizens do not have to pay in excess of $4500 per EDU in non-ad valorem special assessments.” At the November 15, 2006 BOCC meeting, approval to advertise the public hearing required to adopt the resolution of intent was granted. Planning for the Lower Sugarloaf and Big Pine Key sewer areas is anticipated to occur in late FY07 or early FY08, therefore, the levy of the ad valorem special assessments for December 15, 2006 the Lower Sugarloaf and Big Pine Key areas was not recommended for FY07. Ramrod Key, as well as Little, Middle, and Big Torch Keys are part of the Big Pine Key service area; therefore, collection of the $4500 connection fee should also be postponed until FY09. CUDJOE - SUMMERLAND WASTEWATER SERVICE AREA That portion of the unincorporated area bounded on the west by Harris Channel and on the east by Niles Channel, on the north by Florida Bay, and on the south by the Atlantic Ocean (Between Mile Markers 16 and 26). DUCK KEY WASTEWATER SERVICE AREA That portion of the unincorporated County bounded on the north by U.S. Highway 1, on the west by Tom’s Harbor Channel, on the South by Hawk’s Channel, and on the East by Tom’s Harbor Cut; an area commonly known as “Duck Key”, including islands known as Center Island, Harbor Island, Plantation Island, and Yacht Club Island, but excluding Indies Island. STOCK ISLAND WASTEWATER SERVICE AREA All of Stock Island located south of the centerline of US Highway No. 1 (State Road No. 5), and lying east of Cow Key Channel and west of Boca Chica Channel.
