Approval of a Resolution of the Monroe County Board of County Commissioners waiving fines and
costs for code compliance case CE19080104 for real property at 159 Florida Avenue, Lots 22 and 23,
Burtons Addition to Tavernier (PB2-82), with Parcel ID Number 00479430-000000, purchased by the
Monroe County Land Authority to be used for affordable housing development.
ITEM BACKGROUND:
The Land Authority has a contract to purchase real property consisting of Lots 22 and 23, Burton's
Addition to Tavernier(PB2-82), with Parcel ID Number 00479430-000000, along with 6 Rate of
Growth Ordinance (ROGO) Exemptions to be used for affordable housing development. The Land
Authority will remove the structures and work to find a development partner for redevelopment.
There is a pending Code Compliance case, CE19080104, against the Property for failure to connect to
the central sewer. There is a lien recorded against the Property at Book 3147, Page 1728 of the Official
Records of Monroe County.
The MCLA are seeking waiver of code fines, liens, and costs for this property so it can be redeveloped
and used as long-term affordable housing.

A RESOLUTION OF THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS WAIVING FINES AND
COSTS FOR CODE COMPLIANCE CASE CE19080104
FOR REAL PROPERTY AT 159 FLORIDA AVENUE, LOTS
22 AND 23, BURTONS ADDITION TO TAVERNIER (PB2-
82), WITH PARCEL ID NUMBER 00479430-000000,
PURCHASED BY THE MONROE COUNTY LAND
AUTHORITY TO BE USED FOR AFFORDABLE HOUSING
DEVELOPMENT.
WHEREAS, the Monroe County Comprehensive Plan Land Authority has the ability to
purchase properties to redevelop them as affordable workforce housing; and
WHEREAS, the Monroe County Comprehensive Plan Land Authority will acquire real
property consisting of Lots 22 and 23, Burtons Addition to Tavernier (PB2-82), with
Parcel ID Number 00479430-000000, along with 6 Rate of Growth Ordinance (ROGO)
Exemptions ("the Property") to be used for affordable housing development; and
WHEREAS, there is a pending Code Compliance case, CE19080104, against the
Property, with a lien recorded at Book 3147, Page 1728 of the Official Records of
Monroe County; and
WHEREAS, the Board of County Commissioners has the ability to waive any fines,
fees, or costs that may either currently or in the future be due to the County.
NOW, THEREFORE, BE IT RESOLVED BY THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS, THAT:
Section 1. The above recitals are true and correct and incorporated herein.
Section 2. The fines and costs for Code Compliance Case 19080104 are hereby waived
upon transfer of the Property to the Monroe County Comprehensive Plan Land
Authority.
Section 3. The Monroe County Attorney is authorized to release the lien recorded at
Book 3147, Page 1728 of the Official Records of Monroe County.
