HomeMy WebLinkAboutResolution 094-2024 k� 1� �, ? 1 �rak � - i Wyi 'M'ru✓N/�oAlfJ 10 MONROE COUNTY, FLORIDA RESOLUTION NO. 094 -2024 A RESOLUTION APPROVING THE ISSUANCE OF A SPECIAL PERMIT ALLOWING A TEMPORARY CONSTRUCTION STAGING AREA FOR A CANAL RESTORATION/WATER QUALITY IMPROVEMENT PROJECT AT PROPERTY LEGALLY DESCRIBED AS LOT 260 AND WEST 10 FEET OF LOT 261 HAMMER POINT PARK, PLAT BOOK 6, PAGE 35, OFFICIAL RECORDS OF MONROE COUNTY, FLORIDA, HAVING A CURRENT ADDRESS OF 137 IVANHOE COURT ("CT.") AND CURRENTLY BEARING PROPERTY IDENTIFICATION NUMBER 00480111-026000. 1 WHEREAS, an application has been received seeking a special permit to allow a temporary 2 construction staging area at the above-referenced property located at 137 Ivanhoe Ct., Tavernier 3 approximately located at mile marker 93.5 (bayside); and 4 5 WHEREAS, the subject property is more particularly legally described as Lot 260 And 6 West 10 Feet Of Lot 261 Hammer Point Park, Plat Book 6, Page 35, Key Largo, as recorded at 7 Plat Book 6, Page 35, of the Official Records of Monroe County, Florida; and 8 9 WHEREAS, the Monroe County Board of County Commissioners ("Monroe County", 10 `Board", `BOCC", or the "County") desires to grant the special permit allowing a temporary 11 construction staging area; and 12 13 WHEREAS, the temporary construction staging area would facilitate a canal 14 restoration/water quality improvement project being carried out by Monroe County; and 15 16 WHEREAS, due notice has been carried out and a public hearing has been held in 17 accordance with Monroe County Code of Ordinances Section 6-3; and 18 19 WHEREAS, at said public hearing, the Monroe County BOCC considered the full record 20 created before it; and 21 22 WHEREAS, the Monroe County BOCC hereby makes the following findings of fact and 23 conclusions of law: 24 1 of 3 1 1. The temporary construction staging area is not inconsistent with any of the criterion 2 provided in Monroe County Code of Ordinances § 6 3; 3 4 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 5 COMMISSIONERS OF MONROE COUNTY, FLORIDA: 6 7 Section 1. Title, Recitals, Findings of Fact, and Conclusions of Law. The foregoing title, 8 recitals, findings of fact, and conclusions of law are true and correct, and are hereby 9 incorporated as if fully set forth herein. 10 11 Section 2. The foregoing findings of fact and conclusions of law support the Monroe County 12 BOCC's decision to approve the instant request for issuance of this special permit, subject to 13 the following approval conditions: 14 15 1. The temporary construction staging area shall only be used in association with the canal 16 restoration project for Canal No. 90 backfilling at said site. 17 2. The expected commencement date of the temporary construction staging area is February 18 2024. The termination date of the temporary construction staging area shall be no later than 19 June 2024. 20 3. Other than fencing, no temporary structure associated with the temporary construction 21 staging area shall be located in any required setback. 22 4. Upon termination of the temporary construction staging area,the property shall be restored 23 to its prior condition. 24 25 Section 3. Construction and Interpretation. This Resolution and its interpretation shall be 26 liberally construed and enforced in favor of the Monroe County BOCC and such interpretation 27 shall be entitled to and granted great weight in adverse administrative proceedings, at trial, in 28 bankruptcy, and on appeal, and all provisions of the Monroe County Comprehensive Plan, 29 Monroe County Codes, Florida Statutes, floodplain management regulations, and Florida 30 Building Code whose interpretation arises out of,relates to, or is interpreted in connection with 31 this Resolution shall be liberally construed and enforced in favor of the Monroe County BOCC 32 and such interpretation shall be entitled to and granted great weight in adversarial 33 administrative proceedings, at trial, in bankruptcy, and on appeal. 34 35 Section 4. No Liability. Monroe County expressly reserves and in no way shall be deemed to 36 have waived, for itself or for its officer(s), employee(s), or agent(s), any sovereign, 37 governmental, and any other similar defense, immunity, exemption, or protection against any 38 suit, cause-of-action, demand, or liability. 39 40 Section 5. Severability. If any provision of this Resolution, or any part or portion thereof, is 41 held to be invalid or unenforceable by any administrative hearing officer or court of competent 42 jurisdiction,the invalidity or unenforceability of such provision, or any part or portion thereof, 43 shall neither limit nor impair the operation, enforceability, or validity of any other provision of 44 this Resolution, or any remaining part(s) or portion(s) thereof.
