AGENDA ITEM WORDING: Rescind approval given at the August 16, 2006, item D-22, "to
rescind an existing lease agreement with one month remaining with Deputy Dawn Leird for one-half of
the duplex located at the Marr Property, Key Largo and approval to enter into a one-year revised
residential lease agreement with a Deputy recommended by the Monroe County Sheriff to reside in the
vacated side ofthe duplex located at Key Largo Community Park."
Approval to accept early termination of lease and "forgive" Sgt. Leird the August 2006 rent in the
amount of $229.06 due on her lease which was expiring August 31, 2006 since she was not in
residence for the last month of her lease.
ITEM BACKGROUND: The Public Works Facilities Maintenance Department received
notification from Sgt. Dawn Leird that she would not be renewing her residential lease which was
terminating August 31, 2006, and that she would be vacating the premises on July 31, 2006. She also
requested that she not have to pay the August rent since she would have already moved out. Facilities
Maintenance confirmed the vacancy with the Monroe County Sheriff s Office and another deputy was
recommended. However, during processing of the paperwork, the Deputy recommended by MCSO
decided not to rent the unit as he felt the rent was too high for that area. Currently, this duplex is not
rented and MCSO continues to advertise the unit for rent.
PREVIOUS RELEVANT BOCC ACTION: August 16,2006, Item D-22, the Board approved
rescinding Deputy Leird expiring lease for one-half of the duplex at Key Largo Community Park and
approved entering into a new lease with another MCSO-recommended Deputy. Previously, since
September 1, 1998, the Board had approved Deputy Leird to reside in one-half of the Key Largo
duplex.

Sgt. Dawn Leird, Key Largo Duplex
RE:
Sgt. Dawn Leird leased one-half of the duplex and Key Largo Park. Her lease was expiring
August 31, 2006 and the Public Works Facilities Maintenance Department received notification
from Sgt. Leird that she would not be renewing her residential lease, and that, in fact, she would be
vacating the premises as of July 31, 2006. She also requested that she not have to pay the August
rent since she would have already moved out. Facilities Maintenance confirmed the vacancy with
the Monroe County Sheriff's Office and another deputy was recommended.
On August 16, 2006, the Board rescinded the lease expiring August 31, 2006 and approved a new
residential lease with a MCSO recommended deputy. Sgt. Leird was notified of the approval that
she need not pay the August rent and that the MCSO approved deputy could rent the property.
While processing the paperwork for the new deputy, the deputy, however, decided the rent was too
high for that area and declined to complete the documentation.
I hereby request rescission of the August 16, 2006 item D-22, and request approval to accept early
termination of lease and forgive Sgt. Leird the last month's rent on her now expired lease.
