Block 22, Big Pine Cove Subdivision (PB 3-131) (hereinafter referred to as the Receiver Site),
contingent upon approval by the County of a Minor Conditional Use transferring the market rate ROGO
as an affordable ROGO exemption.
ITEM BACKGROUND:
MCLA acquired Lots 1, 2, 15, 16, 17, Block 8, Palm Villa Subdivision, RE# 00278950-000000 (Luong
property), including a ROGO Exemption. The lots will be conservation and MCLA will seek to sell
those lots to the State of Florida Forever Program.
MCLA also acquired Lot 15, Block 22, Big Pine Cove Subdivision, RE# 00308540-000100 (Clancy
property). This lot will be used for a future affordable housing unit, that will utilize the ROGO
Exemption from RE# 00278950-000000.
This agenda item authorizes MCLA staff to apply for a minor conditional use approval to move the
ROGO Exemption and authorizes the Executive Director as authorized agent for the application. It also
authorizes the recording of an "Assignment of Rate of Growth Ordinance (ROGO) Exemption"
contingent upon approval of the minor conditional use.

October 18, 2023 - GB approved adding RE# 00278950-000000 (Luong property) to the acquisition list
for affordable housing and purchasing the property for $750,000.

Comprehensive Plan Land Authority (hereinafter "Land Authority") to acquire real
property with the provision found in 380.0666(3)(a). To provide affordable housing to
families whose income does not exceed 160 percent of median family income for the
area"; and
WHEREAS, the Land Authority acquired 30447 Oleander Boulevard, Big Pine
Key, Parcel Identification Number 00278950-000000 legally described as: Lots 1, 27 157
16, and 17, Block 8, Palm Villa Subdivision (PB 1-89), (hereinafter referred to as the
"Sender Site"); and
WHEREAS, the Land Authority acquired 31562 Avenue D, Big Pine Key, Parcel
Identification Number 00308540-000100 legally described as: Lot 15, Block 22, Big Pine
Cove Subdivision (PB 3-131) (hereinafter referred to as the "Receiver Site")

WHEREAS, the Land Authority seeks to transfer the ROGO exemption from the
Sender Site to the Receiver Site so the Sender Site can be restored to natural habitat.
NOW, THEREFORE, BE IT RESOLVED BY THE MONROE COUNTY
COMPREHENSIVE PLAN LAND AUTHORITY THAT:
Section 1. The above recitals are true and correct and incorporated herein.
Section 2. The Land Authority Executive Director is hereby authorized to apply for a
Minor Conditional Use permit for the Transfer of a ROGO exemption (TRE), including
the payment of applicable application fee(s), as well as property owner notification
costs.
Section 3. The Land Authority Chairman is authorized to sign all documents related to
the THE transfer, on behalf of the Land Authority.
Section 4. The Land Authority Executive Director is authorized to serve as the Land
Authority Agent on the THE transfer applications for Sender Site and Receiver Site.
Section 5. The Land Authority attorney is authorized to record "Assignment of Rate of
Growth Ordinance (ROGO) Exemption" from 30447 Oleander Boulevard, Big Pine Key,
Parcel Identification number 00278950-000000 legally described as: Lots 1, 2, 15, 16,
and 17, Block 8, Palm Villa Subdivision (PB 1-89), (hereinafter referred to as the
"Sender Site") to 31562 Avenue D, Big Pine Key, Parcel Identification number
00308540-000100 legally described as: Lot 15, Block 22, Big Pine Cove Subdivision

THIS ASSIGNMENT OF DEVELOPMENT RIGHTS ("Assignment")is entered into this

LAND AUTHORITY, a land authority under section 380.0663(l), Florida Statutes, and Monroe County
Ordinance Number 031-1986("MCLA") as to the following:
WHEREAS MCLA owns real property located at 30447 Oleander Boulevard, Big Pine Key,
Florida 33043,Parcel Identification Number 00278950-000000 and more particularly described as:
Lots 1, 2, 15, 16, and 17, Block 8, Palm Villa Subdivision as recorded in Plat Book 1,
Page 89, of the Public Records of Monroe County, Florida (hereinafter referred to as
the"Sender Site").

WHEREAS pursuant to the ROGO Exemption Request File 92017-R085, with approval letter
dated November 1, 2017, a copy of which is hereby attached to and incorporated herein as Exhibit"A" the
Sender Site has a total of one (1)Rate of Growth("ROGO")market rate residential allocation; and

WHEREAS MCLA desires to assign one (1) ROGO allocation from the sender site to the receiver
site, in accordance with Monroe County Minor Conditional Use Permit Development Order No. XX-XX
approving the transfer of the ROGO allocation from the Sender Site to the Receiver Site.
NOW, THEREFORE, Monroe County for good and valuable consideration, the sufficiency of
which is acknowledged hereby agrees as follows:
Section 1. The above recitals are true and correct.
Section 2. Monroe County hereby transfers the one (1) market rate ROGO allocation as evidenced by
ROGO Exemption Request File 92017-RO85 with approval letter dated November 1, 2017,
attached hereto and incorporated herein as Exhibit "A" from Lots 1, 2, 15, 16, and 17,
