A RESOLUTION CONFIRMING THE ADMINISTRATIVE
BOUNDARY INTERPRETATION OF THE PLANNING DIREC-
TOR IN LAND USE DISTRICT MAP BOUNDARY INTER-
PRETATION NUMBER 101 REGARDING TRACTS 2,
3, AND 6 OF A SUBDIVISION OF LOTS 3 & 4,
UPPER MATECUMBE, PLAT BOOK 2 PAGE 59 OF THE
PUBLIC RECORDS OF MONROE COUNTY, FLORIDA,
APPROXIMATELY MILE MARKER 81.
WHEREAS, the property described as Tracts 2, 3 and 6, subdi-
vision of Lots 3 & 4, Upper Matecumbe, according to the Plat
thereof as recorded in Plat Book 2, Page 59 of the Public Record
of Monroe County, Florida, is located half in th.e Nativ~ (~)

WHEREAS, in the Upper Keys, lands located in the Natige l~d

use district are usually reserved for wetland and mangro~ ha5i-

use district; and

tats, and lands located in the Suburban Residential land use
district are usually reserved for hammocks; and
WHEREAS, the current Land Use district boundaries which indi-
cate that a portion of the upland property is zoned Native, were
placed in error with the adoption of the September 15, 1986 Land
Development Regulations, and therefore the subsequent maps were
also in error, as they did not follow the properly demarcated
habitat boundary; and
WHEREAS, the Interim Planning Director recommends approval
of the boundary changes 'as indicated in Staff Recommendation by
Antonia Gerli dated February 20, 1996; and
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSION-
ERS OF MONROE COUNTY, FLORIDA THAT:
1) The action of the Interim Planning Director, Antonia
Gerli, recommending approval of a district boundary change in
Land Use District Map Boundary Interpretation Number 101, dated
April 18, 1996, is hereby found to be in conformance with the
standards set forth in Section 9.5-227 (c), Monroe County Code;
and is therefore approved; and
2) The entire upland portion of Tracts 2, 3 and 6, a subdivi-
sion of Lots 3 and 4, Upper Matecumbe Key, should have been
designated Suburban Residential; and
3) The above conclusion of law, is predicated upon the find-
ing of facts and conclusions outlined in the staff recommenda-
tion which this Board hereby adopts as its own; and
4) The Clerk of the Board is hereby directed to forward a
certified copy of this Resolution to the Monroe County Planning
Department; and

5) The Clerk of the Board is hereby directed to forward a
certified copy of this resolution, referring to Boundary Inter-
pretation #101, to the Florida Department of Community Affairs.
PASSED AND ADOPTED by the Board of County Commissioners of Mon-
roe County, Florida, at regular meeting of said Board held on
the 20th day of March, A.D., 1996.
