RESOLUTION NO. 128 -2024
A RESOLUTION OF THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS APPROVING ISSUANCE OF A
SPECIAL PERMIT ALLOWING A TEMPORARY
CONSTRUCTION STAGING AREA FOR A CANAL
RESTORATION/WATER QUALITY IMPROVEMENT PROJECT
AT PROPERTY MORE PARTICULARLY LEGALLY DESCRIBED
AS LOT 244 HAMMER POINT PARK, PLAT BOOK 6, PAGE 35,
OFFICIAL RECORDS OF MONROE COUNTY, FLORIDA,
CURRENTLY HAVING PROPERTY IDENTIFICATION NUMBER
00480111-024400.
1 WHEREAS, an application was filed for a special permit allowing a temporary construction
2 staging area at property located at 132 Hilson Court ("subject property" or the "property"),
3 approximately situated at mile marker 93.5;1 and
4
5 WHEREAS, the subject property is legally described as Lot 244 Hammer Point Park,
6 Tavernier, Plat Book 6 Page 35, Official Records of Monroe County, Florida, currently having
7 Property Identification Number 00480111-024400; and
8
9 WHEREAS, the Board of County Commissioners of Monroe County, Florida (`BOCC",
10 `Board", "Monroe County", or the"County"), desires to grant the subject special permit allowing
11 a temporary construction staging area; and
12
13 WHEREAS, the temporary construction staging area would facilitate a canal
14 restoration/water quality improvement project being carried out by Monroe County; and
15
16 WHEREAS, due notice has been carried out and a public hearing has been held in
17 accordance with Monroe County Code of Ordinances Section 6-3; and
18
19 WHEREAS, at said public hearing, the Board considered the public comment and
20 argument of all persons and parties present wishing to speak on the matter; and

1 WHEREAS, the Board makes the following findings of fact and conclusions of law:
2 1. The temporary construction staging area is not inconsistent with any of the criterion
3 provided in Monroe County Code of Ordinances § 6-3;

5 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
6 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

8 1. Title and Recitals. The foregoing title and recitals are true and correct, and are hereby
9 incorporated as if fully stated herein.

11 2. Findings of Fact and Conclusions of Law. The findings of fact and conclusions of law
12 set forth above are hereby incorporated as if fully stated herein.

14 3. These findings of fact and conclusions of law support the Board's decision to approve this
15 request for a special permit subject to the following conditions:

17 A. The temporary construction staging area shall only be used in association with the canal
18 restoration project for Canal No. 90 Backfilling on Tavernier/Key Largo.
19 B. The expected commencement date of the temporary construction staging area is March
20 2024. The termination date of the temporary construction staging area shall be no later
21 than June 2024.
22 C. Other than fencing, no temporary structure associated with the temporary construction
23 staging area shall be located in any required setback.
24 D. Upon termination of the temporary construction staging area, the property shall be
25 restored to its prior condition.

28 Florida, at a regular meeting of the Board held on the 20th day of March, 2024.
