Recertification Assessment Marathon Professional Center 1st Amendment FIRST AMENDMENT TO TASK ORDER FOR PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES BETWEEN MONROE COUNTY AND MCFARLAND-JOHNSON, INC. FOR MARATHON PROFESSIONAL CENTER BUILDING RECERTIFICATION ASSESSMENT In accordance with the Agreement for Professional Architectural and Engineering Services, made and entered into on January 18,2023, ("Agreement"),between MONROE COUNTY, ("County") and MCFARLAND-JOHNSON, INC., ("Consultant"), where professional services are allowed if construction costs do not exceed $4,000,000.00, or for study activity if the fee for professional services for each individual study under the contract does not exceed$500,000.00 ("Agreement"). All terms and conditions of the Agreement apply to this First Amendment to the Task Order,unless this First Amendment amends, adds, or modifies a provision or an Article of the Agreement, in which case, the provision or Article will be specifically referenced in this First Amendment and the amendment, addition, or modification thereof shall be precisely described. This Task Order is effective on the 22nd day of March , 2024. WHEREAS, Monroe County received a Notice of Required Inspection letter from the City of Marathon dated July 31, 2023, with respect to the Marathon Professional Center Building located at 2945-2975 Overseas Highway. The notice referenced Section 6-95, City of Marathon Code requiring that buildings older than seventeen(17)years have an inspection performed to determine the general structural condition of the building and general condition of its electrical system; and WHEREAS, the Parties executed a Task Order for the Marathon Professional Center Building Recertification Assessment on September 6, 2023; and WHEREAS, the assessment report identified needed structural repairs in order to complete the building recertification process necessitating additional documentation from the Consultant. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the parties agree as follows: 1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Agreement, the Consultant will assist the County in the needed structural repairs for the Marathon Professional Center Building located at 2945-2975 Overseas Highway, Marathon, Florida. Scope of Services shall include: a. Field Data Acquisition —The Consultant shall conduct two (2) site visits to gather field data, observe and record data from potentially required destructive testing, and prepare base drawings. The destructive testing, if required, will consist of minor Page 1 of 2 selective demolition to expose the reinforcing in select walls. The Consultant will determine if destructive testing is required and assist the County in developing the scope of testing. All testing services will be performed by others. b. Repair Drawings — The Consultant shall prepare structural repair drawings, procedures, and details. Drawings will show approximate repair locations in a plan view and details. c. Construction Observation—The Consultant shall: i. Review structural shop drawings submitted by the Contractor for general conformance with the design concepts indicated in the Construction Documents and Specifications. ii. Perform a maximum of two visits to observe structural repairs and prepare a written report summarizing its observations. iii. Review and assist in the resolution of structural related construction questions. iv. Update the City of Marathon Structural Recertification Form. 2. In accordance with Article VII, Subparagraph 7.1.1 of the Agreement,the County shall pay the Consultant a lump sum total of Twenty-Five Thousand, Five Hundred and 00/100 dollars ($25,500.00)paid on a percent complete basis. The contract amount for this Task Order including this First Amendment is a lump sum total of $46,200.00. All other Terms and Conditions of the Agreement remain unchanged and in full forces and effect.
