36 WHEREAS, Magnolia 101 LLC, via Island Construction Management Inc. acting as an
37 authorized agent, has solicited for the Monroe County Board of County Commissioners
38 ("BOCC", "Board", "Monroe County", or the "County") to voluntarily abandon a portion of
39 public right-of-way located on a portion of the Hibiscus Street right-of-way situated within the
40 Key Largo Ocean Acres plat, as recorded in Plat Book 1, Page 188, Official Records of Monroe
41 County, Florida, situated as more particularly described below, which is bounded on the west by
42 a portion of the Hibiscus Street right-of-way already abandoned in favor of and over to the
43 Monroe County BOCC as record owner of Square 19 of the subject plat and State of Florida as
44 record owner of Square 22 of the subject plat, bounded on the south by Square 23 of the subject

I plat, bounded on the east by Hibiscus Street right-of-way, and bounded on the north by Square
2 20 of the subject plat; and

4 WHEREAS, Magnolia 101 LLC is bound by that certain recorded Settlement
5 Agreement4 approved following extensive code compliance litigation against the Monroe County
6 BOCC in which the BOCC prevailed, and the proposed portion of public right-of-way Magnolia
7 101 LLC seeks abandonment of is south of its existing permitted waste separation facility
8 located at 215 Magnolia Street which constitutes, under the Monroe County Comprehensive Plan
9 and Monroe County Land Development Code, a permitted light industrial use approved for a
10 portion of Square 20 of the subject Ocean Acres plat; and
11
12 WHEREAS, a BOCC decision on whether to abandon this portion of public right-of-way
13 would not constitute a form of development/permitting approval or approval of expansion of any
14 existing permitted development; and
15
16 WHEREAS, the abandonment of a right-of-way (or a portion thereof) does not sanction
17 violations of the limits and requirements of the Monroe County Comprehensive Plan and
18 Monroe County Land Development Code; and
19
20 WHEREAS, under the Monroe County Code and Florida Statutes Chapter 336, it is
21 necessary to hold a public hearing of the Monroe County Board of County Commissioners to
22 publicly consider renouncing its rights to the instant Monroe County right-of-way after
23 publishing due notice of said hearing in accordance with said Chapter; and
24
25 WHEREAS, due notice has been published and a public hearing has been held in
26 accordance with Chapter 336, Florida Statutes; and
27
28 WHEREAS, at said public hearing, the Board has considered the application requesting
29 for it to renounce and vacate its public right of way in and to the hereinafter described public
30 right-of-way as delineated on the hereafter described legal description,plan, or map;
31
32 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
33 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

35 Section 1. Title and Recitals. The foregoing title and recitals are true and correct,
36 and are hereby incorporated as if fully set forth herein.

38 Section 2. Findings of Fact and Conclusions of Law. The findings of fact and
39 conclusions of law set forth above constitute the BOCC's findings of fact and conclusions of law
40 and are hereby incorporated as if fully stated herein.

I Section 3. BOCC Resolution No. 089-2024 attached hereto as Exhibit"A." is hereby
2 incorporated as if fully set forth herein, except to the extent plainly inconsistent with this

5 Section 4. The BOCC accepts all of the findings of fact and conclusions of law in the
6 January 26, 2024-dated Monroe County Planning and Environmental Resources Department
7 professional staff report accompanying this BOCC agenda item, by and through Senior Director
8 Emily Schemper, A.LC.P., C.F.M., and Transportation Planner Janene Sclafani, and hereby
9 adopts them as the BOCC's own legal and factual determinations and incorporates said
10 professional staff report as if fully set forth herein.

18 Section 6. Construction and Interpretation. This Resolution and its interpretation
19 shall be liberally construed and enforced in favor of the Monroe County BOCC and such
20 interpretation shall be entitled to and granted great weight in adverse administrative
21 proceedings, at trial, in bankruptcy, and on appeal, and all provisions of the Monroe
22 County Comprehensive Plan, Monroe County Land Development Code, Monroe County
23 Code of Ordinances, Florida Statutes, floodplain management regulations, and Florida
24 Building Code whose interpretation arises out of, relates to, or is interpreted in
25 connection with this Resolution shall be liberally construed and enforced in favor of the

1 Monroe County BOCC and such interpretation shall be entitled to and granted great
2 weight in adversarial administrative proceedings, at trial, in bankruptcy, and on appeal.

4 Section 7. No Liability. Monroe County expressly reserves and in no way shall be
5 deemed to have waived, for itself or for its officer(s), employee(s), or agent(s), any
6 sovereign, governmental, and other similar defense, immunity, exemption, or protection
7 against any suit, cause-of-action, demand, or liability.

9 Section S. Severability. If any portion of this Resolution, or any part or portion
10 thereof, is held to be invalid or unenforceable by any administrative hearing officer or
11 court of competent jurisdiction, the invalidity or unenforceability of such provision, or
12 any part or portion thereof, shall neither limit nor impair the operation, enforceability, or
13 validity of any other provision of this Resolution, or any remaining pert(s) or portion(s)
14 thereof. All other provisions of this Resolution, and remaining part(s) or portion(s)
15 thereof, shall continue unimpaired in full force and effect.
