Resolution 292-2023 Wn {r t` 1( 2 3 4 5 MONROE COUNTY, FLORIDA MONROE COUNTY BOARD OF COUNTY COMMISSIONERS RESOLUTION NO. 292 -2023 10 A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY 11 COMMISSIONERS ("BOARD") GRANTING APPROVAL OF THE REQUEST 12 TO WAIVE THE NON-RESIDENTIAL INCLUSIONARY HOUSING 13 REQUIREMENT FOR REDEVELOPMENT WITH AN EXPANSION LOCATED 14 AT 5 HOMESTEAD AVENUE, KEY LARGO, MILE MARKER 99, CURRENTLY 15 HAVING PROPERTY IDENTIFICATION NUMBER 00453410-000000. 1§ 18 19 WHEREAS, on August 22, 2023, the Monroe County Planning & Environmental Resources 20 Department received an application from Belle Construction Services, LLC, on behalf of Wesley House 21 Family Services, Inc. (the "Applicant"), to waive the inclusionary housing requirement for the 22 construction of a 4,171 square foot addition (an institutional use) located at 5 Homestead Avenue, Mile 23 Marker 99, Key Largo (the "property"); and 24 25 WHEREAS,the subject property contains an existing institutional use that is to be redeveloped 26 with a 4,171 square foot addition; and 27 28 WHEREAS,pursuant to Monroe County Land Development Code Section 139-1(f)(3)(b.)each 29 redevelopment project not exempted by subsection(4)shall mitigate fifty percent(50%)of the workforce 30 housing demand created by the proposed redevelopment by one or a combination of the methods 31 identified in subsection (5). The workforce housing required for non-residential development when an 32 existing use is expanded shall be calculated based on the incremental increase in size of the existing use 33 (net additional square footage); and 34 35 WHEREAS, in accordance with Monroe County Land Development Code Section 139- 36 1(f)(5)(a.), redevelopment with a 4,171 square foot addition for an institutional use generates the need 37 for 1.40 affordable dwelling units with an in-lieu fee equivalent of $151,323.88, based upon the 38 Affordable Workforce Housing Support Study for Non-Residential Development prepared by 39 Clarion Associates, LLC, for the Monroe County Board of County Commissioners ("Monroe County 40 BOCC"); and 41 42 WHEREAS, the Applicant's mitigation requirement, should the Applicant choose to comply 43 with the Land Development Code by constructing an affordable dwelling unit either on-site or off-site, 44 would be one(1)affordable dwelling unit(rounded up from .70)or payment of the in-lieu fee equivalent 45 of$75,661.94; and 46 47 WHEREAS, under Monroe County Land Development Code Section 139-1(f)(4)(b.)(2.) 48 provides that the requirements of said subsection (f.) may be reduced, adjusted, or waived if the Board 49 is of the view that due to the nature of the proposed non-residential development that non-residential 1 of 2 I development furthers Comprehensive plan policies and the purpose and intent of this subsection through 2 means other than strict compliance with the requirements set forth herein; and 3 4 WHEREAS, at a regularly scheduled meeting held on September 20, 2023, the Board took the 5 view that the particularized facts presented by this application were such that the aforesaid fee waiver 6 request is to be granted under above-referenced Section 139-1(f)(4)(b)(2); 7 8 NOW, THEREFORE, BE 11' RESOLVED BY THE BOARD OF COUNTY 9 COMMISSIONERS OF MONROE COUNTY, FLORIDA: 10 I I Section 1. The foregoing title and recitals of this Resolution are hereby incorporated as if fully set 12 forth herein and the request for the aforesaid fee to be waived is hereby granted pursuant 13 to LDC Section 139-1(1)(4)(b.)(2.). 14 15 Section 2.
