RESOLUTION NO. 142-1996
A RESOLUTION BY THE MONROE COUNTY BOARD OF
COMMISSIONERS APPROVING AN EXEMPTION FROM THE
NONRESIDENTIAL PERMIT ALLOCATION SYSTEM FOR THE
CONSTRUCTION OF A SCHOOL CLASSROOM BY ST. JUSTIN
MARTYR CATHOLIC CHURCH LOCATED AT 105500 US 1
KEY LARGO, MONROE COUNTY, FLORIDA, MILE MARKER

WHEREAS, St. Justin Martyr Catholic Church has applied
for an as-of-right building permit to construct a classroom,
covered entryway, deck, stairs, handicapped ramp and septic
tank; and
WHEREAS, pursuant to the Year 2010 Comprehensive Plan,
Monroe County shall regulate nonresidential development
through a permit allocation system and complete an economic
base analysis to determine the demand ~or f~tur~

WHEREAS, Policy 101. 3.4 of the Year: 2?10 ~~i1~reh~siV~
plan, allows the Board of County Commlssloner~ to ~xemp;
federally tax-exempt nonprofit organizations~ 'fromA the
nonresidential permit allocation systems after review bdr t~
Planning Commission upon a finding that such actiilty wi~ n~~
adversely affect the hurricane evacuation objectives ~ t~
comprehensive plan; and ..' .b.
WHEREAS, St. Justin Martyr Catholic Church has
requested an exemption from the residential and nonresidential
permit allocations systems; and
WHEREAS, on March 7, 1996, the Planning Commission
heard the request of St. Justin's for an exemption and
recommended approval of the request to the Board of County
Commissioners with the condition that only the development
enumerated above be exempted based on the following findings
of fact:
1. The classroom does not create an increase in the
hurricane evacuation time since the students and staff
who already live in the Keys have been counted in the
original study of hurricane evacuation times; and
2. New staff must either live in a pre-owned home which has
already been counted in the hurricane evacuation
clearance time or they must submit an application to
build a new home under the permit allocation system in
which case they will be accounted for in the reserve
clearance time upon which the ROGO allocations were
based; and

WHEREAS, the BO~Dj ~f Ccunty Commissioners has
considered the recommendation and findings of fact of
Planning Commission and adopts the findings of fact as
own; NOW THEREFORE,

BE IT RESOLVED BY THE MONROE COUNTY BOARD OF COMMISSIONERS,
that the preceding Findings of Fact support their decision to
APPROVE the request filed by St. Justin Martyr Catholic
Church, a federally tax exempt institution, for an exemption
to the nonresidential permit allocation for one classroom,
covered entry, deck, stairs, handicapped ramp and septic
system.
PASSED AND ADOPTED by the Board of County Commissioners of
Monroe County, Florida, at a regular meeting of said Board
held on the 20th day of March ,A. D., 1996.
