Ordinance 001-1995 Sheriff Richard D. Roth ORDINANCE NO. 001-1995 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA. IMPOSING A SURCHARGE OF TWELVE DOLLARS AND FIFTY CENTS ($12,50) FOR MOVING TRAFFIC VIOLATIONS WITH THE PROCEEDS TO BE USED TO FUND MONROE COUNTY'S PARTICIPATION IN AN INTERGOVERNMENTAL RADIO COMMUNICATION PROGRAM; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Monroe County has been approved by the Division of Communications of the Department of Management Services (formerly known as the Department of General Services) for participation in an intergovernmental communication program; and WHEREAS, Sec. 316.655(6), Fla. Stat., allows for the imposition of a $12.50 surcharge on moving traffic violations to fund the County's participation in the intergovernmental communication program, including the purchase of equipment: now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA. that: Section 1. There is hereby imposed a surcharge of twelve dollars and fifty cents ($12.50) for each moving traffic violation of Chaps, 316 or 318, Fla. Stat. The Board shall reduce the surcharge in the event the revenue generated exceeds that reasonably necessary to fund the County's participation in the intergovernmental radio communications program. Section 2. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately numbered to conform to the uniform numbering system of the Code. This Ordinance shall take effect 60 days after receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said office. WHEREAS, Monroe County has been approved by the Division of Communications of the Department of Management Services (formerly known as the Department of General Services) for participation in an intergovemmental communication program; and WHEREAS, Sec. 316.655(6), Fla. Stat., allows for the imposition of a $12.50 surcharge on moving traffic violations to fund the County's participation in the intergovernmental communication program, including the purchase of equipment; now, therefore, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. There is hereby imposed a surcharge of twelve dollars and fifty cents ($12.50) for each moving traffic violation of Chaps. 316 or 318. Fla. Stat. The Board shall reduce the surcharge in the event the revenue generated exceeds that reasonably necessary to fund the County's participation in the intergovemmental radio communications program. Section 2, If any section. subsection, sentence, clause. or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity, Section 3, All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extend of said conflict. Section 4. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe. Florida. as an addition or amendment thereto. and shall be appropriately numbered to conform to the uniform numbering system of the Code. Section 5. This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said office.
