ORDINANCE NO. 002-1995
AN ORDINANCE REVISING MONROE COUNTY CODE, SECTION 6-55 TO
BRING THE SECTION INTO COMPLIANCE WITH THE STATE STATUTES,
EXEMPTING FROM LICENSURE OWNERS OF PROPERTY WHEN ACTING
AS THEIR OWN CONTRACTOR IN PROVIDING MATERIAL SUPERVISION;
REVISING THE EXEMPTION TO APPLY TO ONE-FAMILY OR TWO-FAMILY
RESIDENCES AND COMMERCIAL BUILDINGS AT A COST OF UNDER
$25,000; PROVIDING FOR THE EXEMPTION NOT BE AVAILABLE WITHIN
ONE YEAR OF COMPLETING A STRUCTURE BUILT UNDER THIS
EXEMPTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE
REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING
FOR INCORPORATION INTO THE MONROE COUNTY CODE OF
ORDINANCES: AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, that:
Section 1.
Sec. 6-55, Monroe County Code, is hereby amended to read as follows:
Licensure under this article does not apply to:
(7) Owners of property when acting as their own contractor and providing
all material supervision themselves, when building or improving farm
outbuildings or one-family or two-family residences on such property for the
occupancy or use of such owners and not offered for sale or lease, or building
or improving commercial buildings at a cost of under $25,000 on such property
for the occupancy or use of such owners and not offered for sale or lease. In
an action brought under this part, proof of the sale or lease, or offering for sale
or lease, of any structure by the owner-builder within 1 year after completion of
same creates a presumption that the construction was undertaken for
purposes of sale or lease. This subsection does not exempt any person who
is employed by such owner and who acts in the capacity of a contractor. For
the purposes of this subsection, the term "owners of property" includes the
owner of a mobile home situated on a leased lot. To qualify for exemption
under this subsection, an owner must personally appear and sign the building

Section 2. If any section, sub_van, sentence, clause or provision of this
ordinance is held invalid, t~:rf'Bai~~\fi"" t~. ordinance shall not be affected by such
invalidity.

Section 3. All ordinances or parts of ordinances in conflict with this ordinance are
hereby repealed to the extent of said conflict.
Section 4. The provisions of this ordinance shall be included and incorporated in
the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment
thereto, and shall be appropriately renumbered to conform to the uniform numbering system of
the Code.
Section 5. This ordinance shall take effect immediately upon receipt of official
notice from the Office of the Secretary of State of the State of Florida that this ordinance has
been filed with said Office.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting of said Board held on the 18th day of Januarv, 1995.

Dear Mrs. Cloud:
Enclosed please find a certified copy of Monroe County Ordinance No. 002-1995
revising Monroe County Code, Section 6-55 to bring the section into compliance with the
State Statutes, exempting from licensure owners of property when acting as their own
contractor in providing material supervision; revising the exemption to apply to one-
family or two-family residences and conunercial buildings at a cost of under $25,000;
providing for the exemption not be available within one year of completing a structure
built under this exemption; providing for severability; providing for the repeal of all
ordinances inconsistent herewith; providing for incorporation into the Monroe County
Code of Ordinances; and providing an effective date.
This Ordinance was adopted by the Monroe County Board of County
Commissioners at a Regular Meeting in fonnal session on January 18, 1995.

NOTICE OF INTENTION TO CONSIDER
ADOPTION OF COUNTY ORDINANCE
NOTICE IS HEREBY GIVEN TO WHOM IT MAY CONCERN that on Wednesday,
January 18, 1995, at 10:00 a.m. in Courtroom B, 500 Whitehead Street, Key West, Monroe
County, Florida, the Board of County Commissioners of Monroe County, Florida, intends to
consider the adoption of the following County ordinance:
ORDINANCE NO -1995
AN ORDINANCE REVISING MONROE COUNTY CODE, SECTION 6-55 TO
BRING THE SECTION INTO COMPLIANCE WITH THE STATE STATUTES,
EXEMPTING FROM LICENSURE OWNERS OF PROPERTY WHEN ACTING
AS THEIR OWN CONTRACTOR IN PROVIDING MATERIAL SUPERVISION;
REVISING THE EXEMPTION TO APPLY TO ONE-FAMILY OR TWO-FAMILY
RESIDENCES AND COMMERCIAL BUILDINGS AT A COST OF UNDER
$25,000; PROVIDING FOR THE EXEMPTION NOT BE AVAILABLE WITHIN
ONE YEAR OF COMPLETING A STRUCTURE BUILT UNDER THIS
EXEMPTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR THE
REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING
FOR INCORPORATION INTO THE MONROE COUNTY CODE OF
ORDINANCES: AND PROVIDING AN EFFECTIVE DATE.
Pursuant to Section 286.0105, Florida Statutes, notice is given that if a person decides
to appeal any decision made by the Board with respect to any matter considered at the
hearing, he will need a record of the proceedings, and that, for such purpose, he may need to
ensure that a verbatim record of the proceedings is made, which record includes the testimony
and evidence upon which the appeal is to be based.

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that:
Section 1.
Sec. 6-55, Monroe County Code is hereby amended to read as
follows:
Licensure under this +his article does not apply to:
(7) The provisions of this article GO not apply to an G\Vfler of
residential property altering or repairing his own home if occloIpied by the
oomer and not intended for sale. An Qwner of r-esidential preperty may
construct one (1) single family residence for his O'Nn use and occloIpancy
y.'ithout q..alifying for a certificate of competency, but the appliGatien for
a blolilding permit for construction of more than one (1) single family
residence in three (3) years' time shall be oonstrued as engaging in the
construction business and such Ql.v-ner mUlt secure a certifiGate of
competency before the permit will be issued; eligibility for subsequent
permits will be oonsidered upon issuance of a certificate of competency.
Owners of property when actina as their own contractor and
providina all material supervision themselves, when buildina or improvina
farm outbuildinas or one-family or two-family residences on such
property for the occupancy or use of such owners and not offered for
sale or lease. or buildina or improvina commercial buildinas at a cost of
under $25,000 on such property for the occupancy or use of such
owners and not offered for sale or lease. In an action brouaht under this
part, proof of the sale or lease, or offerina for sale or lease, of any
structure by the owner-builder within 1 year after completion of same
creates a presumption that the construction was undertaken for
purposes of sale or lease. This subsection does not exempt any person
who is employed by such owner and who acts in the capacity of a
contractor. For the Durooses of this subsection. the term "owners of
propertY' includes the owner of a mobile home situated on a leased lot.
To Qualify for exemption under this subsection. an owner must
personally appear and sian the buildina permit application.
Section 2.
If any section, subsection, sentence, clause or provision of this
ordinance is held invalid, the remainder of this ordinance shall not be affected by such
invalidity.
Section 3. All ordinances or parts of ordinances in conflict with this ordinance
are hereby repealed to the extent of said conflict.
Section 4. The provisions of this ordinance shall be included and incorporated
in the Code of Ordinances of the County of Monroe, Florida, as an addition or
amendment thereto, and shall be appropriately renumbered to conform to the uniform
numbering system of the Code.
Section 5.
This ordinance shall take effect immediately upon receipt of official
notice from the Office of the Secretary of State of the State of Florida that this ordinance
has been filed with said Office.
