Resolution 132-2024 RESOLUTION NO. 132-2024 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA APPROVING THE WRITE-OFF OF A$45,000.00 SHIP SECOND MORTGAGE WHEREAS,the Monroe County SHIP Program executed a SHIP Second Mortgage between the County and MICHAEL J.AND KAREN D. CHAUSTIT in the amount of$45,000.00 on September 25, 2008, recorded on September 30, 2008,as Document#1713533, Book 2382, Page 508 of the public records of Monroe County, Florida,secured by the property located at 1231 Flagler Avenue, Key West, Florida 33040;and WHEREAS,the First Mortgagee(IBERIABANK)filed a foreclosure action as well as a Notice of Lis Pendens on April 12, 2013,which was recorded on May 30, 2013 as Document#1935158, Book 2631, Page 392;and WHEREAS, a Final Judgment of Foreclosure was Ordered on October 31, 2013, Document #1956215, Book 2656, Page 2335,and recorded November 1,2013,sale by auction was set for February 28, 2014, and the property was sold to the highest bidder on February 28, 2014, Document#1970803, Book 2673, Page 778 and recorded February 28, 2014;and WHEREAS,the SHIP Mortgage was unable to be satisfied as the proceeds from the sale were insufficient to allow for a recovery;and WHEREAS,OB FLORIDA RRE HOLDINGS, LLC took title to the property on March 12,2014, Document#1972223, Book 2674, Page 2046;and recorded on March 12, 2014. NOW THEREFORE,BE IT RESOLVED, by the Board of County Commissioners of Monroe County, Florida that the County hereby: Authorizes the write-off of a SHIP Second Mortgage Loan in the amount of$45,000.00 formerly secured by the property located at 1231 Flagler Avenue, Key West, Florida, 33040. PASSED AND ADOPTED, by the Board of County Commissioners of Monroe County, Florida at a regular meeting of said Board on the 17thday of April 2024.
