Pavilion Repair 05/07/2024 TASK ORDER
FOR PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES BETWEEN
MONROE COUNTY AND BENDER&ASSOCIATES ARCHITECTS, P.A. FOR THE
HIGGS BEACH PAVILIONS REPAIR PROJECT
In accordance with the Agreement for Professional Architectural and Engineering Services, made and
entered into on January 18, 2023, between MONROE COUNTY, ("County") and BENDER &
ASSOCIATES ARCHITECTS, P.A., ("Consultant"), where professional services are allowed if
construction costs do not exceed$4,000,000.00,or for study activity if the fee for professional services
for each individual study under the contract does not exceed$500,000.00 ("Agreement").
All terms and conditions of the Agreement apply to this Task Order, unless this Task Order amends,
adds, or modifies a provision or an Article of the Agreement, in which case, the provision or Article
will be specifically referenced in this Task Order and the amendment, addition, or modification will
be precisely described. These additions apply only to the project referenced in this Task Order.
This Task Order is effective on the 7th day of May 2024.
WHEREAS,the two (2)pavilions at Higgs Beach were originally built as gun turrets circa 1942 and
are listed as historical/cultural resources in the State of Florida Division of Historical Resources Master
Site Files; and
WHEREAS, the County has closed one of the pavilions in an abundance of caution due to visible
deterioration and also had an assessment completed of the pavilions to determine existing conditions
and future repair needs; and
WHEREAS, the County anticipates performing the needed repairs in-house and desires to have the
Consultant assist with the permitting requirements due to the historic nature of the pavilions.
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the
parties agree as follows:
1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Professional Architectural
and Engineering Services Agreement,the Consultant will perform services as described below:
• Consultant shall assist with permitting process, including submittal of documents to
the City of Key West Historic Architectural Review Commission(HARC)and the City
of Key West Building Department for the repair of the two (2) pavilions on Higgs
Beach.

2. In accordance with Article VII paragraph 7.1.1 of the Agreement, the County shall pay the
Consultant a lump sum total of Four Thousand, Five Hundred and 00/100 Dollars
($4,500.00)paid on a percent complete basis for the following phases:
• Existing condition and design drawings - $1,350.00 lump sum upon receipt of
documentation and approval by the Director of Project Management.
• HARC Approval - $1,800.00 lump sum upon HARC approval and approval by the
Director of Project Management.
• Permitting Documents - $1,350.00 lump sum upon receipt of building permit and
approval by the Director of Project Management.
All other Terms and Conditions of the Agreement remain unchanged and in full force and effect.
IN WITNESS WHEREOF, each party caused this Task Order to be executed by its duly authorized
representative.
